Publication of the spread of pharmaceutical repositories in supply emergency situations and in the event of accidents and disasters, including acts of war

In accordance with section 76 and section 104 (4), 2, and paragraph 1. 3, in the case of medicinal products, cf. law no. 1180 of 12. In December 2005 :

§ 1. The provisions of this notice shall apply to supply emergency situations and in the event of accidents and disasters, including acts of war. The provisions shall apply in advance of any contradictory provisions as laid down in accordance with other legislation.

Paragraph 2. If one of the items referred to in paragraph 1 The situation referred to in paragraph 1 shall be those which are subject to section 3 (3). 1, and 2, via the Medicinal Products Agency, shall be informed by the Minister for Health and Prevention.

Paragraph 3. The announcement shall apply to stocks of medicinal products.

§ 2. The Board of Health shall carry out the general coordination of pharmacovigilance if any of the situations referred to in Section 1 are entered.

§ 3. Importers of medicinal products and pharmaceutical wholesalers must reduce their stocks of medicinal products to a minimum through the distribution of medicinal products through the usual distribution channels.

Paragraph 2. Producers of medicinal products must, by means of distribution through the usual distribution channels, reduce their stocks of the individual medicinal product with what equivalent to 45 days of normal consumption of the medicinal product concerned.

Paragraph 3. The application of the stocks referred to in paragraph 1. 1, and 2, shall be carried out in a proportionate distribution to the usual takers on the basis of the number of packages delivered in the quarter preceding receipt of the notification that one of the items referred to in paragraph 1 (1). 1, mentioned situations have been met.

Paragraph 4. Medicinal products that are distributed in accordance with paragraph 1. 1, and 2, are provided in the trade conditions in the trade in the sector ; however, due to the payment of the goods received only 60 days from the end of the month on which the item was received.

§ 4. In specific cases, the Board of Health may decide that a company should diversify its warehouse in a different manner than in section 3 or that the establishment should not spread its supply. The health management decision must be approved by the Minister for Health and Prevention. The Board of Health shall, after the decision of the Board of Health, communicate an injunction to the person concerned, in accordance with the decision of the Board of Health, in accordance with the Board of Health.

§ 5. A corpsman may, in the situations referred to in section 1, supply medicinal products to other health potees as well as pharmacies.

Paragraph 2. A pharmacy may in the situations referred to in section 1 provide medicinal products to other pharmacies and to hospital potees.

§ 6. The penalty shall be penalised by the person who violates Section 3 and the person who does not comply with an injunction issued by the Danish Agency for the Mediation Management Board pursuant to section 4.
