Law amending the law on the State educational support (SU-law)

(Increase in the tax-free amount, dependency allowance and disability allowance, termination of double clip system, mandatory digital application, flexible loan scheme, etc.)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

The law on State educational support (SU-law), see. lovbekendtgørelse nr. 983 of 27. July 2007, as amended by section 2 of Act No. 208 by 31. March 2008 and Act No. 374 of 26. May 2008, shall be amended as follows:

1. In article 2, paragraph 3, 2. paragraph, the words ' the ' to: ' Duborgskolen in Flensburg Duborg-Skolen in Flensburg or a. p. Møller School in Slesvig '.

2. In article 2, paragraph 3, the following is inserted as a 3. item:

» The condition applies in addition not for learners who are not registered in the CPR as a point of departure, see. section 24 (5) and (6) of the law on the Central Person register. '

3. In section 7 shall be inserted after paragraph 1 as new paragraph: "(2). Student loans in accordance with paragraph 1, nr. 2, shall only be granted with scholarship. '




Paragraph 2-6 becomes paragraph 3-7.



4. In article 8, paragraph 4, nr. 2, 2. paragraph, the words ' name, address and social security numbers ': ' name and address '.

5. In paragraph 10 (a), paragraph 1, section 24, paragraph 7, nr. 2, 2. paragraph and paragraph 9, and section 46, paragraph 5, the words ' article 7, paragraph 2 ' is replaced by: ' § 7 paragraph 3 '.

6. In paragraph 10 (a), paragraph 1, the words ' 6370 DKK ' for: ' $ 7120. ' 7. In section 10 (a), paragraph 2, the words ' § 14, § 19, paragraph 5, and article 20, paragraphs 2 to 5 ' to: ' section 14 and section 19, paragraph 5 '.

8. In paragraph 10 (b) (1) and § 39, paragraph 2, 1. paragraph, the words ' article 7, paragraph 3, nr. 1 ' to: ' section 7, paragraph 4, nr. 1 '.

9. In paragraph 10 (b), paragraph 2, the words ' article 7, paragraph 3, nr. 2 ' to: ' section 7, paragraph 4, nr. 2 ' and ' 715 DKK ' for: ' $ 400. ' 10. In section 10 (b), (3) and section 22, paragraph 2, the words ' article 7 (4) ' to: ' section 7, paragraph 5 '.

11. section 10 (b), (4), 2. paragraphs, are hereby repealed.

12. In article 11, paragraph 2, the words ' section 20, paragraphs 2-6 ' to: ' rules laid down under section 20 (a) '.

13. Article 12 is replaced by the following: ' article 12. The amounts referred to in sections 8 to 11, are adjusted once a year the 1. January.

(2). The amounts adjusted by 2.0%. attributed to or deducted from an adjustment percentage for that fiscal year, see. law on a rate adjustment percentage. Adjustment percentage attributed increased or decreased, depending on the basic wage for the calculation of the adjustment percentage is higher or lower than 2 percent Adjustment is done on the basis of the regulatory time limits applicable. The regulated amount rounded to the nearest penny amount. '

14. section 13 (1). 1, is replaced by the following: ' 1) education at primary school level, and general adult education. Together with training support for general adult education can be given educational support to the preparatory adult education (FVU) to learners at 18 and 19 years old. '

15. In article 13, paragraph 3, and section 22, paragraph 2, the words ' article 7, paragraph 5 ' to: ' section 7, paragraph 6 '.

16. section 20 is repealed, and instead is inserted: ' article 20. Learners can select clips from for one or more months in support of the year. The Minister may lay down rules on opting out of the clip, including deadlines for fravalget.

section 20 (a). The Minister may lay down rules to the effect that in education, which includes a paid internship, training support with double rate may be paid in the month preceding the first paid internship period. '

17. In article 22, paragraph 2, the words ' article 7 (2) and (3) ' is replaced by: ' § 7 (3) and (4) '.

18. Article 24, paragraph 1 is replaced by the following: ' Lowest Excemption amount represents





1) 6370 DKK for learners who receive SU outside cut card, and

2) 7870 DKK for learners who receive SU within rock card. '





19. In article 24, paragraph 5, and article 25, paragraph 5, the words ' article 12, paragraph 3 ' to: ' article 12 '.

20. In article 24, paragraph 7, nr. 2, 1. paragraph shall be added after ' in accordance with the law on workers ' compensation ': ', '.

21. In article 25, paragraph 4, shall be replaced by ' each of the applicant's sibling ' to: ' each of the parents ' children '.

22. In article 25, paragraph 7, the words ' name, address and social security number ': ' name and address '.

23. Article 25, paragraph 8, no. 1, is replaced by the following: ' 1) about when the Affairs of only one parent to be taken into account for the calculation of the supplement to the basic scholarship, see. paragraph 2 and 4.0 '

25. Under section 38 shall be inserted:

Application for and payment of educational support, etc.

section 38 (a). The applicants must submit an application and receive the training aid decisions and communications in electronic form, in accordance with article 3. section 43 (a), paragraph 1, and the rules thereunder, see. However, paragraph 2.

(2). The Minister shall lay down detailed rules on





1) in which case the application regardless of the provision in paragraph 1 may be submitted in paper form, and

2) what decisions and messages regardless of the provision in paragraph 1 may be in paper form.





(3). The Minister may also lay down rules on





1) content and design of applications,

2) time limits for applications,

3) deadlines for the submission of information and

4) deadlines for repayments.





section 38 (b). Training aid shall be paid to the education seekers Nemkonto.

(2). Training aid shall be paid in advance in monthly installments, without prejudice. However, § § 38 (c) and 38 (d), and may not be paid from the beginning of the month in which the application for aid is received





1) in the Agency's electronic self-service system, see. section 38 (a), paragraph 1, or

2) at the educational institution or agency, see. rules laid down under section 38 (a), paragraph 2, no. 1.





(3). The Minister shall lay down detailed rules concerning the conditions laid down in paragraph 2.

section 38 c. student loans covered by section 9 and section 10 (b) of paragraph 3 shall be released to the outline with a monthly amount, see. section 7, paragraphs 2 and 5, and shall be paid when the students have filed a request for payment through the Agency's electronic self-service system, see. section 43 (a), paragraph 1, and the rules thereunder. Student loans under section 10 (b), (3), is given in conjunction with slutlån of the basic regulation. section 7, paragraph 5, however, first be released for disposal when the learners in the same month get final loan paid, without prejudice. section 38 d.

(2). The learners must specify with what amount the available student loans must be paid.

(3). Amount referred to in paragraph 1 that are available, but not paid, cancelled by





1) support the end of the year,

2) curtailment of education,

3) leave and

4) inactivity.





(4). The Minister shall lay down the detailed rules for payment of student loans, including about deadlines, payment dates, limit for minimum payout and communication about loan terms and conditions.

§ 38 d. Slutlån, covered by section 10, be released to outline with a monthly amount and paid when the students have filed a request for payment through the Agency's electronic self-service system, see. section 43 (a), paragraph 1, and the rules thereunder.

(2). Amount referred to in paragraph 1 that are available, but not paid, cancelled by





1) support the end of the year,

2) curtailment of education,

3) leave and

4) inactivity.





(3). The Minister shall lay down detailed rules concerning the payment of slutlån, including about deadlines, payment dates and notice of loan terms and conditions.

§ 38 e. The learners must provide his/her social security number when applying for training aid and contact the Agency in General. '

26. § 39, paragraph 1 1. paragraph is replaced by the following: ' the Board may with the Customs and tax administration, the Central Person register and other authorities to obtain the information about the learners and their parents, which is necessary for the award, calculation and repayment of educational support, including information about income and property, place of residence, the number of the applicant and his parents ' children under 18 years of age and residency of foreign nationals. "

27. § 39, paragraph 9 is replaced by the following: ' (9). The Minister may lay down rules on access to obtain information in accordance with paragraphs 1 to 4 and can including setting, what information must be provided in electronic form. '

28. section 41 is repealed.

29. section 42, paragraph 1, is replaced by the following: ' The decisions taken by the Board may make, may, in accordance with the Agency's determination completely or partially assigned to educational institutions. Agency may also decide that an educational institution shall take decisions on educational support for students who are enrolled in and undergoing training at another educational institution. The educational institution may obtain the information referred to in section 39, paragraphs 1 to 3 of the basic regulation. paragraph 9, and information from other educational institutions that have an impact on decisions on training aid, if a decision is filed to the institution, or if the consequences of the law, the institution must make the decision. '

30. section 43 (1), (2). paragraph, shall be repealed, and replaced by:
' The Minister may lay down rules on the administration of the institutions in connection with the granting of aid, and can including setting rules on institutions ' assistance to the trainees in relation to the application for and payment of educational support. Agency may determine that an educational institution shall assist the Agency in another or several other educational institutions on behalf of the community. '

31. In section 43 (a) (1), (2). paragraph, the words ', loan documents and by submitting the information referred to in article 6. § 39, paragraph 9, nr. 2, 3 and 6 ' to: ' and by submitting information '.

32. section 62, paragraph 7, shall be repealed.

§ 2

(1). The law shall enter into force on the 1. January 2009, see. However, paragraphs 2 and 3.

(2). section 10 (a), paragraph 2, article 11, paragraph 2, section 20 and section 20 (a) of the law on State educational support (SU-Act) as amended respectively amended by this Act, section 1, no. 7, 12 and 16, as well as the repeal of the same article 10 b, paragraph 4, 2. section, and section 62, paragraph 7, of the basic regulation. This law § 1, nr. 11 and 32, shall enter into force on the 1. July 2009.

(3). The Minister shall determine the time of the entry into force of the SU-12, § § § 38 a-38 e, § 39, paragraph 9, and section 43 (a) (1), (2). paragraph, as amended, respectively, as amended by this Act, section 1, no. 13, 19, 25, 27 and 31 of the basic regulation. However, paragraph 5, as well as for the repeal of section 41 of the basic regulation. This law § 1, nr. 28.

(4). § 2, paragraph 3 3. point, in SU-act as added by this Act § 1, nr. 2, have effect for applications for approval of study programmes abroad as aid eligible, received in the National Board of the 1. January 2009 or later.

(5). Adjustment after SU-article 12, paragraph 3, takes place for the first time with effect from the 1. January 2009 for the aid rates and limits referred to in article 10 (a), SU-(1) section 10 (b), paragraph 2, and article 24, paragraph 1, as amended, respectively, as amended by this Act, section 1, no. 6, 9 and 18.
