Arrested interdepartmental No. 068/CAB/MIN/INTERSEC/2009,212/CABIMIN/J/2009, no CAB/MIN/PTT/011/2009 of December 21, 2009, amending and supplementing the Interministerial Decree No. 25/CAB/MINETAT/INTERDESEC/010/2008 and n ° 003/CAB/MIN/PTT/2008 of 08 March 2008 laying down conditions of subscription to the subscription telephone in Democratic Republic of the Congo.
The Minister of the Interior and security, the Minister of Justice and the Minister of post, Telephones and Telecommunications;
Pursuant to the Constitution, specifically in article 93;
Pursuant to Act No. 013/2002 of 16 October 2002 on Telecommunications in the Democratic Republic of the Congo, specifically in article 6;
Having regard to the order No. 08/067 of October 26, 2008, appointing Deputy Prime Ministers, Ministers and Vice-Ministers;
Given order No. 08/073, December 24, 2008, on the Organization and functioning of the Government, practical arrangements for collaboration between the President of the Republic and the Government as well as between members of the Government, especially in its article 19, paragraph 2;
Having regard to the order No. 08/074 24 December 2008 laying down the attributions of the ministries, especially in its article 1 ", letter b, items 1, 6 and 20;  
Reviewed the Interministerial Decree No. 25/CAB/MINETAT / INTERDESEC/010/2008 and n ° 003/CAB/MIN/PTT/2008 of 08 March 2008 laying down conditions of subscription to the telephone subscription in the Democratic Republic of the Congo;
Taking into account Decision No 005/ARPTC/CLG/2007 of 29 June 2007 College of the regulatory authority of the post and the Telecommunications of Congo on the identification of subscribers to mobile telephony services;
Taking into account the minutes dated December 16, 2009, consultations between the ARPTC, ANR and representatives of operators in the sector of telecommunications on the evaluation of the mandatory identification of subscribers;
Whereas it is necessary to determine the legal and financial measures necessary for the identification of subscribers of telephone services open to the public and the modalities of activation, deactivation and reactivation of subscribers.
Having regard to the need and urgency;
STOP: Article 1 re: this order amends and supplements the identification procedures of the subscribers of telephone services open to the public as provided for in the Decree interdepartmental No. 25/CAB/MINETAT/INTERDESEC/0 10 / 200 8 and n ° 003/CAB/MIN/PTT/2008 of 08 March 2008 laying down conditions of subscription to the telephone subscription in the Democratic Republic of the Congo as well as the modalities of activation deactivation and reactivation of subscribers.
Article 2: All open to the public telecommunications network operator is required to identify its subscribers at the time of the subscription services of telephony in post-paid or paid mode.
For this purpose, it takes the material safety data sheets completed by its subscribers.
Identification via phone call, SMS, e-mail or any mode other than the physical material safety data sheet is prohibited.
Article 3: The operator of a telecommunication network open to the public can activate on network subscriber who has been previously identified.
Article 4: To a sufficient identification, the material safety data sheet must contain the following minimum substantial information: has) for legal persons:-name or the name of the Corporation;
-The number of shopping the new register of trade (CNRC) and national (IDN) for legal persons identification number;
-The address of the registered office;
-The name and contact information of an individual statutory representative or his delegate;
-The commitment signed and dated the Subscriber stating his criminal liability in the event of false information on the MSDS.
Any false statement exposes the moral person in the person of its statutory representative to lawsuits.

-Current physical address;
-Nationality;
-Place and date of birth;
