Cabinet of the Deputy Prime Minister of employment, labour and the foresight social order No 005/CAB/PVPM/PSTA/2010 April 01, 2010, laying of annual statement of the situation of labour the Deputy Prime Minister, Minister of employment, labour and social security;
Given the Constitution of the Democratic Republic of the Congo on 18 February 2006, especially in article 93;
Having regard to Act No. 015/2002 of 16 October 2002 on the Labour Code, especially in articles 218 and 219;
Saw the Ordinance No 08/74 of 24 September 2008 determining the functions of departments;
Having regard to the order No. 08/073, December 24, 2008: on the Organization and functioning of the Government, practical arrangements for collaboration between the President of the Republic and the Government as well as between members of the Government;
Given order No. 10/025 of 19 February 2010 appointing desVice first Ministers, Ministers and Deputy Ministers reviewed order departmental No. 27/75 of October 31, 1975 laying down the procedures of the labour situation, annual return ' having regard to the urgency and the need;
ORDER: Article ler any leader of enterprise or institution is required pursuant to section 216 of the Act No. 015/2002 of 16 October 2002 on the Labour Code, of faireparvenir in the Provincial Division of the Labour Inspectorate et.au Provincial Office of the national Office for employment no later than January 31 of each year, a statement of the situation of labour - domestic and foreign it employs.
 
Article 2: This declaration should are established in four copies on a form. Declaration conforming to the model annexed to this order.
Two of these dated and signed copies must be sent to the labour inspector of the spring by registered mail recommended with acknowledgement of receipt or deposited at its office against acknowledgement of receipt and in the same conditions one of these copies dated and signed must be addressed: to the National Office of employment of spring.
The fourth copy shall be kept by the registrant to be presented to the inspectors and controllers or control work.
 
    Article 3 employers can get the forms of statements from the provincial offices of the National Office of employment and the Labour Inspectorate.
 
Article 4 infringements of the provisions of this order shall be punished with the penalties provided in article 321 of the Code of labour.
 
    Article 5 all earlier provisions contrary to the present weapon, are repealed.
 
    Article 6 the Secretary General is responsible for the execution of this order which enters into force on the date of its signature.
