Ministry of infrastructure, public works and Reconstruction order departmental No. CAB/MIN-ITPR/002/FBL/MT/2010 from 09 February 2010 establishing tolls on the road Mongata-Bandundu.
The Minister of infrastructure, public works and Reconstruction, having regard to the Constitution of the Republic;
Pursuant to law n' 08/006 of 07 July 2008 establishing a Fund of National maintenance road, in abbreviation "FONER".
Mindful of Decree No. 08/027 of December 24, 2008, establishing a public institution called National road maintenance funds, in abbreviation "FONER".
Having regard to the order No. 08/067 of October 26 appointing Deputy Prime Ministers, Ministers and Deputy Ministers;
Having regard to the order No. 71/078 26 March 1971 on the classification of roads in the Democratic Republic of the Congo;
Having regard to the Ordinance No 08/73 of 24 December 2008 on the Organization and functioning of the Government, practical arrangements for collaboration between the President of the Republic and the Government as well as between members of the Government, especially in its article 19;
Saw the Ordinance No 08/74 of November 24, 2008 determining the functions of departments;
Whereas maintenance, the maintenance of the roads of general interest and the Organization of the toll are the jurisdiction of the central Government;
Viewed inter-ministerial order No. 09/CAB/MIN-ITPR/002/KM/2009 March 06, 2009, no CAB/finance/DTS/2009 of March 06, 2009, n ° 001/CAB/MIN/ECONAT / COM/2009 of March 06, 2009 & 409/CAB/MIN/TVC/2009 06 March 2009, on setting rates, amounts and procedures for the collection of the resources of the National Fund of road maintenance ", in abbreviation FONER" especially in its articles 13, 14, 15, 16 and 17;
Having regard to the urgent need for the permanent maintenance and ordered said axis;
Having regard to the need and urgency;
ADOPTED Article 1: It is instituted tolls for any vehicle on the road axis Mongata-Bandundu, in the Province of Bandundu.
Article 2: Tolls on road sections of the said axis are fixed by vehicles in accordance with the table contained in the annex to this order.
Article 3: Are exempt from the payment of tolls: 1. ambulances and fire-fighting vehicles;
2. vehicles as hearses;
3. vehicles of the administration des Ponts et chaussées and utilities with construction and maintenance in their object;
4. the military vehicles and the National Police;
5. any undertaking of civil engineering vehicles with direct activity on the relevant route;
6. the official vehicles;
7. mopeds and bicycles.
Article 4: All prior provisions contrary to this order are hereby repealed.
