Department of health public ministerial order n ° 1250/CAB/MIN/SP/069/CJ/MKO/2010 of December 6, 2010, on the renewal of the suspension of imports of certain drugs the Minister of health, pursuant to the Constitution of the Democratic Republic of the Congo, specifically in article 93;
Saw order No. 010/025 of 19 February 2010 appointing Deputy Prime Ministers, Ministers and Vice Ministers of the Government;
Given order No. 08/073, December 24, 2008, on the Organization and functioning of the Government, practical arrangements for collaboration between the President of the Republic and the Government as well as between members of the Government;
Having regard to Decree n ° 08/074 24 December 2008 fixing the functions of departments, especially in its article 1 litera A and B item 23;
Ministerial decision No. 1250/CAB/MIN/S/027/DS/2006 07 September 2006 on the temporary suspension of imports of certain drugs, today arrived in term;
Whereas no national pharmaceutical policy cannot rely on imports;
Whereas by addition the opportunity to promote the domestic pharmaceutical production;
Whereas finally the report of the assessment mission of the local pharmaceutical industry conducted in April and may 2010 advocating the extension of the suspension of the imports of some drugs;
Having regard to the urgency and the need;
Decree: Article 1: all imports in any capacity whatsoever drug list in the annex is prohibited throughout the country for a period of 36 months.
Article 2: Local producers affected by this decision are required to establish outlets throughout the national territory.
Article 3: Pharmacy and the drug Directorate is responsible for controlling the quality of locally manufactured medicines and carry out regular surveys of the production sites of the first materials used by local producers.
Article 4: The prices of drugs covered by this order as well as the follow-up of the execution of the are subject to a review by an ad - hoc Committee chaired by the Director of the Directorate of Pharmacy and medicines including representatives of producers premises and those of the Department of public health.
Article 5: Any contravention of the provisions of this order is punishable by the competent bodies in accordance with the legal and regulatory texts in force in Democratic Republic of Congo.
Article 6: Shall be repealed all prior provisions contrary to this order.
