Decree No. 12/036 of 02 October 2012 establishing, organizing and operating the Civil Aviation Coordination Framework

The Prime Minister,

Having regard to the Constitution, as amended by Act No. 11/002 of 20 January 2011 on the revision of certain articles of the Constitution of the Democratic Republic of the Congo of 18 February 2006, specifically in its article 92;

Considering the Convention on International Civil Aviation, signed in Chicago on 07 December 1944;

In light of Act No. 10/014 of 31 December 2010 on civil aviation, especially in its section 5;

Having regard to Order No. 12/003 of 18 April 2012 appointing a Prime Minister, Head of Government;

Having regard to Order No. 12/004 of 28 April 2012 appointing Deputy Prime Ministers, Ministers, Minister Delegate and Deputy Ministers;

Having regard to Order No. 12/007 of 11 June 2012 on the organization and operation of the Government, practical modalities for collaboration between the President of the Republic and the Government and between the members of the Government;

Having regard to Order No. 12/008 of 11 June 2012 establishing the powers of the Ministries;

Having regard to Decree No. 011/29 of 10 June 2011 on the Statutes of a public institution known as the "Aviation Civile de la République Démocratique du Congo" in acronym "AAC/RDC";

Considering the necessity;

On the proposal of the Minister of Transport and Communication Paths;

The Council of Ministers heard;

DECRETE:

Chapter 1: From creation

Article 1:

It is established, with the Minister with civil aviation in his or her functions, a consultative framework for civil aviation consultation, in the acronym "CCAC", hereafter referred to as "Cadre".


Chapter He: Missions

Article 2:

The Framework is mandated to issue advisory opinions on:

- Congolese State policy on civil aviation;

- amendments to international conventions and treaties relating to international civil aviation or any other international organization of that sector;

- proposals to amend the infrastructure according to the interests of the aeronautical industry;

- means to promote and guide the development of civil aviation in the Democratic Republic of the Congo;

- the strategies to be put in place to safeguard the interests of the national aeronautical industry;

- all matters submitted to him for consultation by the Minister with civil aviation in his duties.

Chapter Ill: De la composition

Article 3:

The Framework comprises 18 (ninety-eight) members, appointed by order of the Minister with civil aviation in his or her functions, on the proposal of the following institutions and organizations:

1. Department with civil aviation in its powers;

2. Ministry having the Interior in its powers;

3. Ministry with foreign affairs in its responsibilities;

4. Ministry having the National Economy in its powers;

5. Ministry with National Defence in its responsibilities;

6. Ministry having the Plan in its responsibilities;

7. Civil Aviation Authority;

8. Transport Studies Group (GET)

9. Airport service provider;

10. Air Navigation Service Provider;

11. Soil service provider;

12. Air services operators;

13. National Union of Pilots;

14. Association of Air Traffic Controllers;

15. Standing Bureau of Accident Investigations and Aviation Incidents;

16. Meteorological Data Provider;

17. Medical Council of Civil Aviation;

18. Insurance sector.

Article 4:

The Office of the Framework is constituted as follows:

1. Presidency: delegate of the Ministry with civil aviation in its functions;

2. Vice-Chair: delegate of the Ministry with Foreign Affairs in its responsibilities;

3. Rapporteur: delegate of the Civil Aviation Authority;

4. Deputy Rapporteur: delegate from the air navigation service provider.


Article 10:

The Minister of Transport and Communication Paths is responsible for the execution of this Order which comes into force on the date of its signature.
