GOVERNMENT REGULATION
of 5 April 2004. October 2016,
amending Government Decree No. 567/2006 Coll., on the minimum wage, about
the lowest levels of guaranteed wage, on the definition of difficult work
environment and the amount of the payroll allowance for work in difficult working
the environment, as amended, and regulation of the Government No. 589/2006
Coll., laying down the provisions of the working time and rest periods
workers in the transport sector, as amended by regulation of the Government No. 353/2008 Sb.
The Government directs pursuant to § 100 para. 1, § 112 para. 2 and § 117 of law No.
262/2006 SB., labour code, as amended by Act No. 362/2007 Coll.:
PART THE FIRST
Changing government regulations on the minimum wage, the lowest levels of guaranteed
on the definition of wages, difficult working environment and the amount of the supplement to the
wages for work in difficult working environment
Article. (I)
Government Regulation No. 561/2006 Coll., on the minimum wage, the lowest levels
guaranteed wage, on the definition of difficult working environment and the amount of
payroll allowance for work in difficult working environment, as amended by
Decree-Law No 249/2007 Coll., regulation of the Government No. 452/2009 Coll.,
Cabinet regulations no 246/2009 Coll., regulation of the Government No. 210/Sb.
Government Regulation No. 204/2014 Coll., regulation of the Government No. 233/2015 and
Decree-Law No 336/2016 Coll., is amended as follows:
1. In paragraph 6 of the dot at the end of paragraph 2 is replaced by a comma and the following
the letter l) is added:
"l) the allocation of shifts or work by the employer, which in summary
is at least 90 minutes, if at the time of the interruption of work for
employee unavailable his usual social environment and social
facilities, or is their availability significantly impeded by, or is impeded by the
protection of the place where the employee must spend a period of work is interrupted,
against weather and other adverse effects. ".
2. in article 7 the present text shall become paragraph 1 and the following
paragraph 2, which reads as follows:
"(2) the amount of the payroll allowance for work in difficult working environment
When you split shifts or work according to § 6 paragraph 1. 2 (a). l) is
at least 10% of the basic hourly rate of the minimum wage laid down in § 2 and §
5 (3). 1 per hour of work completed in a split shift, or when
split work. ".
3. in annex v, part II, in the field of Transport at the end of the following text
which reads as follows:
"
5. the Group
Management, maintenance and repair of motor vehicles, whose length exceeds 8
meters, and which are intended for the transport of more than 16 persons. ".
PART TWO
Change of government regulation, which lays down the provisions of the working time and
rest periods for workers in transport
Article II
Government Regulation No. 589/2006 Coll., laying down provisions
working time and rest periods for workers in transport, as amended by regulation
No 353/2008 Coll., is amended as follows:
1. in the last sentence of paragraph 1, the word "i" is replaced by "members of the
the crew of the bus for the time to wait between connections and local time
timetable in the public line passenger traffic and ".
2. in paragraph 2 of the introductory part of the provision, after the word "are" the words "for
the purpose of this regulation ".
3. In article 2, subparagraph (a) at the end of the text), the words "(hereinafter referred to as ' the
the crew of a lorry or bus ").
4. In paragraph 2 (a). (d)), after the words "the members of the crew of the bus", the words "in the
city bus transport ^ 27) ".
Footnote 27 is added:
"27) § 2 (2). 7 (b). a) Act No. 111/1994 Coll. on road traffic,
as amended. ".
5. In paragraph 2 (a). (d)), the words "and members of the crew of the bus line passenger
transport, in which the length of any of the connections does not exceed 50 km ' shall be deleted.
6. In paragraph 2, point (d)) the following point (e)), which read as follows:
"e) members of the crew bus on regular passenger services, which are
drivers, driver assistants and crew, for which the length of any of the joints
does not exceed 50 km (hereinafter referred to as "member of the crew of a regular passenger bus
transport "); for this employee is not a member of the crew bus
referred to in subparagraph (d)) ".
Subparagraph e) to (g)) are known as the letters f) to (h)).
7. In paragraph 2, point g) including footnote No. 10 shall be deleted.
Letter h) is renumbered as paragraph (g)).
8. In paragraph 3 (b). and) the words "with the exception of waiting time between connections in
public line passenger services within specified time-lines and locally
timetable, ' shall be deleted.
9. in section 3, the letter b) the following point (c)), which read as follows:
"(c) waiting between connections) in the public line passenger transport by
time-time of buses and locally determined timetable, in which
an employee referred to in section 2 (a). and) e) does not follow the vehicle nor shall he exercise
any other work for the employer; This time is not included in the
working time (hereinafter referred to as "waiting time between connections"), ".
Subparagraph (c)) to (h)) shall be renumbered as subparagraph (d)) to (i)).
10. section 9a is repealed.
11. in part two, title I, part 3, part 4, which added including
the title and footnote # 28 is added:
"Part 4
The reward for the wait time between connections
§ 9a
For every full hour waiting time between connections, it is for the Member of the crew
the bus under section 2 (b). and at least in the amount of remuneration) 90% of the hourly rate
the lowest level of guaranteed wage laid down for the fifth group work ^ 28).
Waiting time between connections for the purposes of determining pay in a calendar
Moon added.

12. In the second with his head in the following title VI, including the
Title:
' TITLE VI
THE CREW BUS ON REGULAR PASSENGER TRANSPORT
§ 19a
On working hours, rest periods and security break crew member
the bus in regular passenger transport shall apply the provisions of § 16 to 19.
§ 19b
For the waiting time between connections belong to the Member of the crew of a regular passenger bus
transport the remuneration pursuant to § 9a. ".
The former title VI to VIII are referred to as title VII to IX.
13. in part two, title IX, including the title.
14. In article 28, paragraph 3 shall be deleted.
PART THREE
The EFFECTIVENESS of the
Article. (III)
This Regulation shall enter into force on 1 January 2000. January 2017, with the exception of
the provisions of part two of the article. (II) points 7 and 13, which will become effective
on 1 January 2004. January 2018.
