GOVERNMENT REGULATION
of 11 December 1997. may 2016
on the establishment of mandatory specifications for public works contracts
acquisition of road vehicles
The Government ordered in accordance with § 37 para. 7 (b). and § 118 paragraph 1). 3 of Act No.
134/2016 Coll., on public procurement:
§ 1
Introductory provisions
(1) this regulation incorporates the relevant provisions of the European Union ^ 1) and
governs the determination of the binding terms of the award of public
supply contracts the object of which is the acquisition of a road vehicle
category N1, N2, N3, M1, M2 or M3, under the law governing the terms of
the use of vehicles on roads ^ 2).
(2) the contracting authority in determining the terms of the contract,
the object of which is the acquisition of the road vehicles of category N1, N2, N3,
M1, M2 or M3, taking into account, under the conditions laid down in this regulation
energy and environmental impacts of the use of vehicles for the duration of their
the service life. These impacts for the purposes of this regulation, means a consumption of
the energy produced by the emission of carbon dioxide (CO2), oxides of nitrogen
(NOx), non-methane hydrocarbons (NMHC) and particulate matter.
§ 2
Taking into account the energy and environmental impact
(1) the sponsor in the case of a contract for the supply of vehicles
categories N2, N3, M2 and M3 in the specification provides a reference to the
emission limits EURO referred to in annex 1 to this regulation, if
unless otherwise provided in the request to meet higher emission standards EURO.
(2) the sponsor in the case of a contract for the supply of vehicles
category N1, and M1 in the specification provides

unless the requirement to meet the higher standards of emission limits EURO
and maximum fuel consumption for combined ^ 3), which
must not exceed the values specified in annex 2 to this regulation, or
(b)) for the evaluation of life-cycle costs of a common method for the determination
life cycle costs pursuant to § 4.
§ 3
Special purpose vehicles or vehicles with alternative propulsion
The contracting authority is not obliged to provide maximum fuel consumption by
§ 2 (2). 2 (a). and) in the case of public contracts for the supply of vehicles
category N1, and M1, if they are the subject of
a) special purpose vehicles referred to in the Decree on the approval of the technical
eligibility and technical conditions of the use of vehicles on the road
^ Highway 4), or
b) Alternatively powered vehicles, of which at least one
alternative fuel or energy source are liquefied petroleum gases
(LPG), compressed natural gas (CNG), liquefied natural gas (LNG), mixed
motor fuel containing at least 50% bio-ethanol, the clean biofuel
hydrogen or electricity.
§ 4
A common method for the determination of life cycle cost for vehicles
category N1, and M1
Life cycle costs for vehicles of category M1 or N1 shall lay down
the contracting authority for the lifetime of the sum of the

(b)) the monetary value of operating costs for energy consumption, pursuant to section 5 and the
(c)) the monetary value of the operating costs of the emissions of CO2, NOx, NMHC and hard
particles in accordance with § 6.
§ 5
Determining the monetary value of the operating costs of the energy consumption
(1) the operating costs for energy consumption, the contracting authority shall fix by multiplying the
energy costs per kilometre and mileage for the period
life according to the annex 3 to this regulation.
(2) if the amount of energy per kilometre is not stated directly, shall be calculated
on the basis of the energy content of the fuel as specified in annex No.
4 to this regulation.
(3) to calculate the energy cost per mile shall apply the lower of
the values of the cost per unit of energy of petrol or diesel before
tax under the law governing value added tax or law
adjusting the excise duty if they are used as fuel for
the purpose of transport.
§ 6
Determining the monetary value of the operating costs of the emissions of CO2, NOx, NMHC and
solid particles
(1) the operating costs of the emissions of CO2, NOx, NMHC and particulate matter for a period of
life of the vehicle, the contracting authority shall establish by multiplying the

§ 7
The effectiveness of the
