DECREE



of 12 October. may 2016



the disclosure forms for the purposes of the Act on public procurement

and elements of the contracting authority's profile



Ministry for regional development, establishes, pursuant to § 212 paragraph. 9, § 214 paragraph.

4 and section 219 paragraph. 4 of Act No. 134/2016 Coll., on public procurement:



§ 1



The subject of the edit



This Decree regulates the following a directly applicable regulation

The European Union ^ 1)



and the form that is used for the publication of) information in accordance with the law on

public procurement (hereinafter referred to as the "Act"), for which the form is not

determined by the directly applicable EU regulation ^ 1)



(b)) the way to fill out forms including the establishment of compulsory to fill in

data,



(c) conditions of acceptance forms to) the publication,



(d)) how to modify data in forms,



e) access to published forms,



(f)) method of service forms



g) to remedy the defects in the published forms and filling defects

h) access to published information on the profile of the contracting authority,



and data published on) the structure of the profile of the contracting authority,



(j)) how to change the profile of the sponsor and

§ 2



The conditions of access to published forms



(1) the operator of a journal of public procurement (hereinafter referred to as the "operator")

at the request of the contracting authority submits the form referred to in

the applicable legislation of the European Union "^ 1") in the official journal of the European

the Union, and this within 3 working days from the date of its submission by the sponsor.

The operator shall publish in the Bulletin of public procurement form to 3

working days from receipt of the acknowledgement of receipt form for publication in the

(2) if the contracting authority did not ask for a form submission to the official journal of the

§ 3



The conditions of acceptance for publication form



(1) the form shall be delivered

(c)) by other electronic means to the electronic address of Registrar

of the operator.



(2) the Permitted format of a data message containing a form is delivered

§ 4



Defects in forms



(1) if the form is received by the operator does not meet the conditions referred to in

§ 212 paragraph. 3 of the Act, the operator submits to the contracting authority within 1 business

the preamble to this fact. At the same time, the operator shall invite the contracting authority to

remove the defects of form.



(2) in the event that the defect is detected, the performance of the operator, the operator

sends to the contracting authority within 1 business day from the date when it was detected, or

reported the defect notification, which will include the design of the remedial

measures to eliminate the defects. The operator shall ensure that, immediately upon written

consent of the contracting authority with the proposed corrective measures to remedy the defect in the

§ 5



Edit the data in the published form

§ 6



How to fill the form in the case of framework agreements and dynamic

purchasing system



(1) in the case of a general notification of the conclusion of the contract on the basis of a framework

mode

system pursuant to § 139 paragraph 2. 1 of the Act, or a notice of a change in the duration of

the dynamic purchasing system referred to in § 139 paragraph 2. 9 (a). and) of the Act,

§ 8



Forms for publication of information to public procurement in lower

mode



(1) the sponsor of a public contract in lower mode it for publication

3. notification of the establishment of the dynamic purchasing system referred to in § 139 paragraph 2.

8 of the Act or a notice of the termination of the dynamic purchasing system referred to in section

paragraph 139. 9 (a). (b)) of the Act, or



4. the individual or summary notice of conclusion of the contract on the basis of

the framework agreement pursuant to section 137 of the Act or the dynamic purchasing system

pursuant to section 142 of the Act.



(2) in the event that the contracting authority requires the disclosure of information about public

1. initiation of the restricted procedure or a negotiated procedure with the publication in accordance with §

paragraph 164. 1 (b). (b)) of the Act, or



2. the introduction of a system of qualification pursuant to § 165 paragraph. 2 of the Act.



§ 10



Forms for the publication of the information design contests



The sponsor of a design contest shall apply to the publication of the information in the Journal

public procurement and the official journal of the European Union



standard form 12) "notice of the initiation of the design competition"

laid down in the applicable legislation of the European Union directly to ^ 1) to begin

design contests pursuant to § 145 of paragraph 1. 1 or § 146 paragraph. 1 of the Act,



(b)) the standard form 13 "notice of the results of design contest"

laid down in the applicable legislation of the European Union directly to ^ 1) for notification of

results of design contest according to § 150 of paragraph 1. 1 of the law.



§ 11



Forms for the publication of the information to the concessions



The sponsor of a contract that is a public works concession or

services concessions, apply to the publication of information in the public

contracts and the official journal of the European Union

laid down in the applicable legislation of the European Union directly to ^ 1) to begin

the award procedure under section 180 paragraph. 1 of the Act,

mode

§ 15



Forms for publication of information concerning the contracting authority's profile



(1) the contracting authority shall apply to the publication of information in the public

contracts which relate to the contracting authority's profile



and) national form CZ 05 "Announcement of the profile of the contracting authority" referred to in

Annex No. 5 to this notice for notification of the contracting authority's profile



(b)) the national form CZ 06 "Cancellation/zneaktivnění profile of the contracting authority"

referred to in annex 6 to this Ordinance to cancel or zneaktivnění

profile of the contracting authority.



(2) the sponsor shall ensure that the Internet address of the contracting authority's profile

§ 17



Information and documents released on the contracting authority's profile



(1) the amount of the actually paid the price for the performance of the contract pursuant to § 219

(3) the contracting authority may, for documents published on the contracting authority's profile

agreement under section 219 paragraph. 1 of the Act, which contains multiple documents in the

formats referred to in paragraph 2 or 3, may be on the contracting authority's profile

published as one or more compressed files in zip format,

RAR or 7z, without using a password. The compressed file, published on the

profile of the contracting authority may not contain any other compressed file.



(5) basic information about the selected public order published on the profile

§ 19



How to change the profile of the contracting authority
