Dated September 5, 2016,

Implementing certain provisions of the pyrotechnics

Ministry of Industry and Trade, pursuant to § 11 para. 5, § 17.
2, § 26 par. 3, § 28 and § 38 par. 2 and 4, § 39 par. 2 and § 52 .
3 of Act no. 206/2015 Coll., on pyrotechnic articles and the handling
and amending some laws (the fireworks)

§ 1
Subject Matter


This Decree stipulates

A) the format pattern register pyrotechnics
whereby a notified body has granted a certificate

B) requirements for safety measures to ensure fire
measures, labeling, storage and use of pyrotechnic products
defining and ensuring the danger area and conditions for issuing
pyrotechnics

C) the content of the records stored pyrotechnics

D) requirements for the construction of walls, partitions, doors and roof structures
, finishing interior walls, ceiling and floors
safety distance and obložnost fire and security warehouse
protection against the effects of external influences,

E) the extent and duration of vocational training plan theoretical and practical
training and trial order

F) the content of medical examinations, medical opinion and the requisites
conditions for assessing fitness for the treatment
pyrotechnic articles of category P2, T2 or F4

G) diseases, defects or conditions that exclude or limit health
eligibility for dealing with pyrotechnic articles of category P2, T2 or
F4

H) the description and content of the test detonation of pyrotechnic
characteristics of the product.

§ 2

Index pyrotechnic

§ 3

Precautions when issuing

(1) When issuing operator shall ensure that
security measures, so that pyrotechnic products were exhibited and stored


A) in the smallest packages for sale or in the original packaging
manufacturer, which bear the exhibition is a sample

B) in such a manner that complied with the conditions set out in the instructions for use
or the manufacturer's instructions

C) away from flammable and combustible supporting materials

D) dry and such that the temperature did not exceed 40 ° C,
unless the manual or the manufacturer's instructions otherwise stated

E) in such a way as to prevent their accidental fall

threat to life and health of persons or property, and

F) the amount and type of which correspond to fire security

(2) In an area where the economic operator is exposed
pyrotechnic articles shall be located for immediate use at least one portable fire extinguisher
water or foam extinguishing capability of at least 13

(3) Endangered space in which you can pyrotechnic products used in
exposure shall be defined by the user manual or the manufacturer's instructions for
the pyrotechnic article. In the event that the user manual or instruction
manufacturer does not define the endangered area, define the endangered area according to the instructions

pyrotechnic articles to be used.

§ 4

Records stored pyrotechnic

(1) Evidence storage of pyrotechnic products contain at least
name, type, category, registration number and batch or lot
pyrotechnic article and an indication of the amount of pyrotechnic products
warehouse storage and handheld sales room.

(2) The records stored pyrotechnic articles for vehicles
data referred to in paragraph 1, with the exception of data on quantity
pyrotechnic products in the store, warehouse and handheld sales

§ 5

Construction and technical requirements for storage

§ 6

Security warehouse and storage requirements

(1) Fire protection warehouse:

A) on all doors leading into the warehouse space are placed

unauthorized persons may enter only when accompanied by authorized persons and must take care of their
instructions

C) the depot is closed except for the time it is done
stacking or retrieving warehouse; if in store nobody should be
warehouse locked

D) the maintenance of the store that may threaten stored
pyrotechnic products, these products must be for maintenance of the warehouse
relocate to another warehouse

E) to clean the interior walls, ceilings, floors, doors, shelves and other equipment

(2) Storage requirements:

A) in the warehouse can be stored for pyrotechnic articles in Class 1

B) pyrotechnic articles which satisfy the requirements of subparagraph a), the

European Agreement concerning the International Carriage of Dangerous Goods
(ADR) are stored separately so as to avoid any confusion,

E) temperature and humidity is maintained so that they comply with the conditions laid down for storage
pyrotechnic products in accordance with the instructions
manufacturer

F) in the case of storing multiple types of pyrotechnic products is crucial
pyrotechnic article with the most stringent conditions that
simultaneously must not be adversely affected by storage conditions

G) products are stored so as to prevent their accidental fall

(3) The fulfillment of the obligations under paragraphs 1 and 2 shall not affect the obligations
laid down in other legislation ^ 2).

§ 7


Clearance
(1) The location of the store with pyrotechnic articles classified into subclasses
1.1 in accordance with the European Agreement concerning the international carriage of dangerous goods
(ADR) must comply with safety
distances. The method of calculating the safety distance is given in Annex
no. 2 hereto.

(2) Method of calculation pursuant to Annex no. 2 to this Decree shall not apply in the case
that the warehouse stored a maximum of 100 kg net
explosive pyrotechnic substances contained in products classified under Class 1.1
in accordance with the European agreement on international road
carriage of dangerous goods (ADR).

(3) The safety distance is not

§ 8

Protection against external influences

§ 9

Vocational training to obtain a certificate of professional competence

Length of lessons is 45 minutes. Schedule theoretical and practical
vocational training is given in Annex no. 3 hereto.

(2) The test procedure is given in Annex no. 4 hereto.

§ 10

The content of medical examinations

(1) The content of each medical examinations to assess health
eligibility basic evaluation that includes

A) analysis of data about the historical development of health and yet they have suffered
disease, condition or defects (hereinafter the "disease")
targeted with a particular focus on the occurrence of diseases that may reduce or eliminate health
eligibility for dealing with pyrotechnic articles category
P2, T2 or F4

B) a comprehensive physical examination, including preliminary examination hearing
eye, skin and indicative of neurological examination, with an emphasis on finding
diseases that exclude or limit the fitness for
handling pyrotechnic articles of category P2 T2 or F4; disease
which exclude or limit eligibility for medical treatment
pyrotechnic articles of category P2, T2 or F4, are listed in Annex
no. 5 hereto.

(2) The examination will be extended by another expert examinations if
such examinations are indicated by surveying physician if

A) it is necessary to exclude diseases listed in Annex no. 5 to this
decree or other diseases that limit or preclude safe
handling pyrotechnic articles of category P2, T2 or F4 or

B) the person is assessed in the continued care of another physician or clinical psychologist
for the diseases listed in Annex no. 5 to this Decree or other
disease that excludes or restricts the safe handling of pyrotechnic products category
P2, T2 or F4, if this fact is known

(3) Other special examinations can be carried out only after the basic examination
surveying physician.

(4) The request form for further expert examination in addition to the requirements according
legal regulation governing the terms and content of health documentation

persons under investigation for the treatment of pyrotechnic articles Category P2, T2
F4 or the extent of the medical expertise of the person performing
professional examination.

(5) The assessment of persons may be eligible for health or health condition

§ 11

This decree was notified in accordance with the Directive of the European Parliament and the Council
2015/1535 / EU of 9 September 2015 on the procedure for the provision
information on technical regulations and rules on information society services

§ 14
Efficiency


This Decree shall take effect on the fifteenth day following its publication.

Test Procedure

Examination Board
First Examination Committee compiles Czech Office for the testing of weapons and ammunition
in cooperation with the Czech Mining Office. The board has three members.

Second The board has a quorum if an absolute majority of its members

Test


First The test verifies the acquired expertise of the applicant to obtain
certificate of professional competence for dealing with pyrotechnic articles

Second The exam consists of three parts - written, oral and practical.

product determined by the applicant's request to obtain a certificate of professional competence
for dealing with pyrotechnic articles.

Third The written part of the exam is done by a test of knowledge from across

A) a description of the pyrotechnic article,

B) use of pyrotechnics product

C) methods of initiation of the pyrotechnic article,

D) a description of the safe disposal of the product.

6th Oral and practical examination to evaluate the degree
"pass" - "fail". The results of each test will test the

Protocol

A) atrophic dementia-degenerative origin, dementia secondary,
organic amnesic syndrome, chronic or recurrent disorder organically

C) clinically severe form of specific personality disorders, and it
paranoid, schizoid, dissocial or emotionally unstable personality disorder

Second untreated, recurrent or chronic psychotic disorders, namely

A) schizophrenia

D) schizotypal disorder

Third untreated, recurrent or chronic mood disorder, and it

A) manic episode

B) a depressive episode or

Fourth personality disorders or behavioral effect induced by abuse of alcohol

A) inability to give up alcohol use or abuse

immediately and repeatedly ability to handle the pyrotechnic articles

B) an active addiction to alcohol, psychoactive drugs, drugs
or their combinations

C) residual conditions or a psychotic disorder, late-onset
due to use of alcohol, psychoactive substances, drugs or their combinations
, and personality disorders or behavioral, psychotic
reminiscence, amnesic syndrome, dementia | ||
Fifth mental retardation,

6th system atrophy primarily affecting the central nervous system,

7th extrapyramidal and movement disorders

8th degenerative diseases of the nervous system unclassified above

9th epilepsy and epileptic syndromes when deployed

10th Episodic states of impaired consciousness or movement, for example
uncompensated narcolepsy or cataplexy,

11th decrease in visual acuity below 06/12 in each eye separately after correction

12th ear disorder that prevented spoken voice communication over a distance
less than 6 meters

13th Diseases of inner ear balance disorders accompanied by severe
while standing or walking,

14th severe heart and vascular diseases significantly limiting functional ability.

B. Diseases that restrict eligibility for medical treatment
pyrotechnic articles of category P2, T2 or F4

First symptomatic organic mental disorder or persistent organic mental disorders
clinical severity, including postencephalitic or

A) acute psychotic disorder with symptoms of schizophrenia or without symptoms of schizophrenia

C) or dysthymia

D) cyclothymia,

Fourth severe form of obsessive-compulsive disorder, phobic anxiety disorders
or persistent personality change after catastrophic experience,

A) clinically severe form of specific personality disorders, and it
histrionic, anankastická or anxiety disorder,

B) personality disorders or behavioral disorders due to use of alcohol,
psychoactive substances, medicaments or combinations thereof, especially
dependence on alcohol or psychoactive drugs or medicaments or their combinations
; eligible for health restriction may be recognized under consideration
person, if the length of the abstinence period lasts continuously for at least 2 years

:

I) disease of the nerves, nerve root and plexus,

Ii) polyneuropathy, and other diseases of the peripheral nervous system,

C) epilepsy, epileptic syndromes or condition after an epileptic seizure, if
was deployed antiepileptic medication, 10 years after discontinuation of therapy
,

7th binge colaps conditions and history,

8th severe heart and vascular diseases limiting functional ability,

9th Diseases of the eye and adnexa:

A) other diseases of the eye and adnexa, which undeniably limit
safe handling of pyrotechnic articles

B) reduction of visual acuity requires correction, whereby jednookost

C) severe color vision deficiency,

D) change of visual field,

10th Diseases of the ear and mastoid process:

A) hearing impairment that prevented spoken voice communication over distances greater than 6

standing or walking,

11th Serious diseases of the musculoskeletal system and connective tissue
affecting the function of the musculoskeletal system or fine motor
upper extremities,

12th uncompensated and stabilized Endocrine and metabolic diseases,
well as other diseases that unequivocally exclude or limit
safe handling pyrotechnic articles of category P2, T2 or F4.
Appendix 6


Description and content test detonation characteristics

First The test is intended to determine whether the defined secondary explosive can be initiated
the present product. It serves to assess its
detonation or nedetonačního character; when an initiation has
