DECREE
of 5 April 2004. December 2011,
amending Decree No. 545/2006 Coll., on the quality of the supply of gas and
related services in the gas industry
The Energy Regulatory Office shall, pursuant to section 98, para. 2 (a). (c)) of the Act
No. 458/2000 Coll., on conditions for business and the public administration in
energy sectors and on amendments to certain acts (the Energy Act),
as amended by Act No. 158/2009 Coll.:
Article. (I)
Decree 545/2006 Coll., on the quality of the supply of gas and related
services in the gas industry, is amended as follows:
1. in the introductory sentence, the words "§ 98 para. 7 "shall be replaced by" section 98a of paragraph 1. 2
(a). (c)) "," 670/2004 "is replaced by" 158/2009 "and the words"
for the implementation of section 17(2). 7 (b). and) Energy Act "shall be deleted.
2. In paragraph 1, the word "deadlines" shall be replaced by the words "procedures and deadlines".
3. In article 2 (2). 1, § 2, paragraph 1. 2, § 14 para. 1 and 2, the word "underground"
repealed.
4. In article 2 (2). 2 the words "the end" are replaced by the word "to".
5. In article 2 (2). 2, section 4, paragraph 4. 1, § 6 (1). 1 and 2, section 10, paragraph 1. 2, § 11
including the title and paragraph 1. 1, § 11 (1) 2, § 12 para. 1, § 13 para. 1
(a). and, section 13 paragraph 1). 1 (b). (b)) § 13 para. 1 (b). (c)), § 14 para. 1
(a). and, § 14 paragraph 2). 1 (b). (b)), section 15, including the title and paragraph 1. 1, § 15
paragraph. 2, § 16 para. 1 (b). and section 16, paragraph 1). 1 (b). (b)), the word
"final" is deleted.
6. § 3, including the title reads as follows:
"§ 3
The application of refunds
(1) the customer or trader of gas which, on the basis of the Treaty on
associated gas supplies gas supply services to the customer (hereinafter referred to as
"supplier of pooled services"), or apply a claim for supplier
and failure to comply with the standard by) section 8 within 60 calendar days from the date of

the contract gives the customer the gas.
(2) if the customer shall negotiate with supplier of syndicated service treaty
associated gas supply services, can assert the standards referred to in paragraph 4,
6, 7, 8, 11 and 13 to 15 and of compensation for non-compliance with the vendor
syndicated service that reaches the customer's request a refund
the operators of the respective gas devices. In this case,
shall be borne by the operator of the gas equipment to pay customer
through vendor services and associated deadlines for fulfilment of the
standards extend about 2 working days for a vendor combined
services that are used for ensuring the transmission of information between the supplier
syndicated services and operator of the respective gas. ".
7. in section 4, paragraph 4. 1, the words "or a pass-through" and "operator
local distribution system or operator of underground gas storage
gas ' are deleted.
8. In section 4, paragraph 4. 4, § 8 para. 2 and § 10 (1). 3 letters a) to (c)):
"and 1 500 Czk) for the category of residential and home; the Grand total
compensation does not exceed 15 000 CZK
(b)) 6 200 Eur for the medium category of the Subscriber; the total sum of compensation is
no more than 124 000 CZK
(c)) 10 500 $ for the commercial customer category; the total sum of compensation is
not more than 210 000. ".
9. in section 4, paragraph 4. 4, § 6 (1). 2 and 3, § 7 (2). 1 (b). a), b) and (c)), § 7
paragraph. 2, § 8 para. 1 and 2, section 10, paragraph 1. 3, § 11 (1) 2, § 13 para. 2, §
14. 2, article 15, paragraph 2. 2 and § 16 para. 2, the word "final" is deleted.
10. in paragraph 5, the word "final" is deleted.
11. In paragraph 6 (1). 3, § 11 (1) 2, and article 15, paragraph 2. 2 a) to (c)):
"and $375) for the category of residential and home; the total sum of refunds
is less than $3 750
(b)) 1 250 Czk for the medium category of the Subscriber; the total sum of compensation is
a maximum of 25 000 CZK
(c) for category 2 200 Czk) commercial customer; the total sum of compensation is
no more than 44 000. ".
12. In paragraph 7 (2). 2, § 13 para. 2, § 14 para. 2 and § 16 para. 2 a)
(c)):
"and $750 for the category) residential and home; the total sum of refunds
does not exceed 7 500 CZK
(b) for category 3 100 Czk) central subscriber; the total sum of compensation is
not exceeding 62 000 CZK
(c) Eur 7 900 for the category) the commercial customer; the total sum of compensation is
a maximum of 158 000. ".
13. In section 8 including the title, the words ", distribution or warehousing"
replaced by the words "or distribution".
14. in § 8 para. 1 and 2, the words ", distribution or warehousing"
replaced by the words "or distribution".
15. In § 8 para. 1 and 2, the words "or underground gas storage"
shall be deleted.
16. section 9, including title and footnote No 1 is added:
"section 9
Standard time limits for the assessment of applications for the connection of the device to the customer
a transmission or distribution system
(1) the standard period for examining applications for device connection
customer to the transmission or distribution system, it is the assessment of the application for

17. in section 10, paragraph 1 reads:
"(1) Standard allow the transport or distribution of gas is an option
the implementation of the transport or distribution of gas within 5 working days
from the day when the customer has fulfilled technical conditions of connection and when
customer or vendor combined services requested by the transmission
or distribution system to transport or distribution of gas to the

18. in section 10, paragraph 1. 2 the words "gas under a special legal
prescription ^ 2) "including footnote 2 shall be deleted.
19. in section 10, paragraph 1. 2, § 11 (1) 1, § 13 para. 1 (b). (b)) and § 15 para. 1
the word "ultimate" is deleted.
20. In paragraph 11 (1) 1, § 12 para. 1, and article 15, paragraph 2. 1 the words "7
Calendar "is replaced by" 5 working ".
21. in section 11 (1) 1, the words ", including the costs associated with interruption and
by restoring the transportation or distribution, "and the words", including the cost of
associated with the interruption and restoration of transport or distribution of gas "
shall be deleted.
22. in paragraph 11 (1) 1, the words "with the final" shall be replaced by "shall".
23. in paragraph 11 (1) 1 the words "pass-through, or ' shall be deleted.
24. In article 12, paragraph 2 shall be deleted and shall be deleted at the same time, paragraph
1.
25. In § 13 para. 1 (b). (b)), the words "pass-through, or ' shall be deleted.
26. in § 13 para. 1 at the end of subparagraph (b)) § 14 para. 1 at the end of
(a)) and § 16 para. 1 at the end of subparagraph (a)), the word "and" shall be replaced
the word "or".
27. in § 13 para. 1 (b). (b)), the number "80" is replaced by "90".
28. in § 14 para. 1 (b). (b)) after the word "system", the words "or
stack gas ".
29. in article 15, paragraph 2. 1, the words ", including the costs associated with interruption and
Restore supplies, "and the words", including the costs associated with interruption and
restoring gas supplies "are deleted.
30. in article 15, paragraph 2. 1, after the words "supplier", the words "or with the
supplier of pooled services. "
31. in article 16, paragraph 1, the following paragraph 2 is added:
"(2) if the reason for the billed gas supplies in your Bill
transmission, distribution or storage of gas and the supplier or vendor
pooled service within the time limit referred to in paragraph 1 (b). and he/she is the expense report)
transmission, distribution or storage of the gas referred to in § 2, the time limits referred to in
paragraph 1, for the processing of complaints under section 14 is not running. ".
The former paragraph 2 becomes paragraph 3.
