of 16 December 2002. March 1992,
amending and supplementing Decree of the Czech Mining Authority no 72/1988
Coll. on explosives
The Czech mining Office lays down pursuant to § 21 para. 6, § 24 para. 3, § 27 para.
5, § 32 para. 7, § 33 para. 5 and § 36 odst. 6 of the Act of the Czech National Council
No 61/1988 Coll. on mining activities, explosives and the State mining
the Administration, as amended by Act of the Czech National Council No. 542/1991 Coll.:
Article. (I)
Decree of the Czech Mining Authority no 72/1988 Coll. on explosives, is amended
and supplemented as follows:
1. name of the Decree "about the use of explosives."
2. In article 1 (1). 2 (a). (b)) shall be deleted, the words "and in the case of explosives and accessories for
which scan quality leads to their destruction, proposal evaluation
statistic acceptance. 1) ".
3. In article 1 (1). 2 (a). (b)), the link 1) deleted.
4. the following paragraph 4 is added to § 4a, which including the title reads as follows:
"§ 4a
Checking for explosives and equipment
(1) the Czech mining Office in the authorization to place the explosive or an aid to circulation
pursuant to section 4, paragraph 4. 2 may determine the term of their examinations. At the same time

(2) the assessment carried out by the examination shall submit to the organization that
the examination conducted by the Czech Mining Authority, and to the applicant.
(3) If, during the examination determined that the explosive or the Widget

5. § 12 para. 3 in the first sentence shall be replaced by the number "2.1" number "1.8".
6. in the section 18 reference 5) is added:
"5) Decree of the CZECH MINING OFFICE No. 22/1989 Coll., on safety and health at
work and safety in mining activities and in the activities
by using mining techniques in the underground. Directive of the Ministry of
Health United States on sanitary requirements for working
environment no HEM-340.2-30.9.77 of 11 March. 5. the 1978 (reg. in the amount
21/1978 Coll.), as amended by Directive of the Ministry of health of the Czech
No. j. HEM-340-2-21.3.85 from 2.4.1985 (reg. in amount of 16/1985
SB.). ".
7. in section 21 para. 3 reference 7) reads as follows:
"7) Law No. 133/1985 Coll., on fire protection, as amended by law the CZECH NATIONAL COUNCIL
No. 425/1990 Coll., Decree of the CZECH MINING OFFICE No. 22/1989 Coll., on safety and protection of the
occupational health and safety in mining activities and in the
activities carried out in the manner of mining underground. ".
8. In section 27, the following paragraph 10 is added:
"(10) a simple kinds of explosives (e.g.. a mixture of ammonium nitrate with
fuel) must be registered from the time of their construction ".
9. In paragraph 36, the words "a local National Committee" and the "district administration
National Security Corps "are replaced by the words" the village "and" the district
the Police Department "and the words" established longer "shall be replaced by
"unless otherwise provided".
10. the third section name: ", Fireworks operators,
Technical Manager and head of the blasting, blasting ".
11. in section 40 para. 1 in the first sentence, the words "have at least secondary education"
replaced by the words ", successfully complete primary school".
12. in section 40 para. 2 in the first sentence, the words "the theoretical part of the training"
shall be replaced by "teaching courses" and in the second sentence, the words "of the choir
national security and border guards "are replaced by the words" and the armed
security forces ".
13. under section 40, the following new section 40a, which including the title reads as follows:
"§ 40a
Fireworks operators
Seeking permission to successfully stop the launchers Fireworks must base
school and teaching. ".
14. in § 41 para. 1, after the word "education", the words "or with the
complete professional education ".
15. In § 42 para. 1 link 9) shall be deleted.
16. In article 42, the following paragraph 3 is added:
"(3) course in which the theoretical and practical training job applicants
the permissions of the launchers of fireworks must have a range of at least 40 teaching
hours in five days; for the duration of the course may not be commissioned to candidates in other
tasks. ".
17. in § 43 para. 1, after the word "střelmistra", the words "the imploders
Fireworks ".
18. in § 43 para. 4, the words "the assessment of the National Committee of the civil
integrity "deleted.
19. in § 43 para. 3 reference 10) reads as follows:
"10) Act No. 61/1988 Coll. on mining activities, explosives and
the State Mining Administration, as amended by Act No. 542/1991 ".
20. section 44, including the title reads as follows:
"§ 44
Registration of certificates and permissions
(1) the register of střelmistrovských's and permissions and licences the launchers
Fireworks leads the district mining Office, which issued it; Register permission
technical leaders blasting, leads the Czech mining Office.
(2) the organization keeps records of certificates and permissions střelmistrů and
technical leaders blasting, and licences the launchers of fireworks, who
are its workers.
(3) holders of certificates referred to in paragraph 1 shall be required to report the change to the data
in these licences referred to within one month from the date of the change
occurred, the authority which issued the licence.
(4) if the holder of the launchers of fireworks not
ohňostrojné work for a period longer than 5 years, must be preceded by another

21. in section 44 refers to the new link 10a) is inserted:
"10a) § 36 odst. 2 of the Act No. 61/1988 Coll. as amended by Act No.
542/1991 ".
22. § 56 para. 1 reads as follows:
"(1) detonating cords should only be cut with a knife to clean wooden backing or
other approved equipment in accordance with the instructions on their use. ".
23. in § 57 para. 2 delete the words "and are from the same resistance group".
24. section 90 para. 1 reads as follows:
"(1) permissible safe explosives Charges in vývrtech shall not be closer
other náložím or other neutěsněným vývrtům on a smaller distance than
40 cm in coal and 30 cm in the stone. ".
25. § 104 paragraph. 1 reads as follows:
' (1) on the use of explosives in mining-safe bezvýmolové blasting work
not covered by the provisions on the boundary fitted (section 88 (2)) and the provisions of §
paragraph 115. 3 (b). a), as regards the inadmissibility of the use of the permissible
safe protiplynových explosives category. ".
26. § 104 paragraph. 3 is deleted.
27. In article 115 paragraph. 1 in the second sentence, the words "danger mines" are replaced by
the words "workings of pertaining to a danger level ^ 13)".
28. Reference 13):
"13) Yield the CBU no 1820/1989 of 15.6.1989, establishing the
safety regulation for mines with a rescuer of rock and gases. ".
29. in paragraph 147 reference 15):
"15) CSN 73 5530 Warehouses of explosives and explosive articles.".
30. section 177:
"§ 177
For the purposes of this Decree:

31. in § 178 odst. 1 the term "firework" is replaced by "ohňostrojné

32. § 178 odst. 2 is added:
"(2) the head of the Fireworks operators responsible for the security in the preparation and
perform Fireworks work and identify measures to ensure the safety

33. the heading of § 179:
"Ohňostrojné work".
34. In section 179 paragraph. 2 in the first sentence, the word ' Fireworks ' is replaced by
"Fireworks works".
35. In section 179 paragraph. 4, the words "Fireworks" are replaced by the words
"pyrotechnics".
36. In section 179 paragraph. 5 in the first sentence, the word ' Fireworks ' is replaced by
"Fireworks", and in the second sentence, the words "Fireworks
funds or other "deleted.
37. In section 179 paragraph. 6 the word ' Fireworks ' is replaced by
"Fireworks" and the words "National Security Corps" are replaced by
the words "Police Department".
38. In section 180 paragraph. 2, the word ' Fireworks ' is replaced by ' batting
pyrotechnic articles ".
39. In section 180 paragraph. 4 the word ' Fireworks ' is replaced by ' ohňostrojné
the work ".
40. the title of part four:
"Common, transitional and final provisions".
41. before § 181 the following new Section 180a, including title and link
16A):
"Section 180a
Common provisions
The provisions of this Ordinance also apply to pyrotechnic articles and
products containing explosives, if the explosion may endanger the safety of
persons and property [explosive articles ^ 16a)].
16A) § 21 para. 2 of the Act No. 61/1988 Coll. as amended by Act No.
542/1991.
42. section 181 paragraph. 3 read as follows:
"(3) the permission to střelmistrů, launch tube Fireworks and technical
leaders issued according to present regulations blasting shall remain in
effect. ".
43. section 182 paragraph. 2 is added:
"(2) in addition to the cases referred to in paragraph 1, an organization may, from
the provisions of this order to depart with the approval of the Czech Mining Authority and
under the conditions laid down by them on the proposal of the head of the Organization's documented
the necessary alternative measures. The proposal shall be submitted through
the district mining Office, and that only in exceptional cases and under
provided that it ensures the safety of work and service. ".
44. section 182 paragraph. 3 is deleted.
45. In paragraph 183, the following new paragraphs 15 to 34, which reads as follows:

47. in annex 2 section and at the end the words "and the application" shall be replaced by
the words "use heading and the method of tagging plastic explosives for
detection purposes ".
Article II
This Decree shall take effect on the date of publication.
