GOVERNMENT REGULATION

amending Government Decree No. 135/2009 Coll. on the provision of

a one-time contribution to alleviate some of the grievances caused by

the Communist regime



Government orders under section 8 (2). 1 Act No. 198/1993 Coll., on the

the illegality of the Communist regime and on resistance against it, as

Act No. 220/2011 Coll.:



Article. (I)



Government Decree No. 135/2009 Coll., on granting a one-time contribution to the

alleviate some of the grievances caused by the Communist regime, is amended

as follows:



1. In paragraph 1, the following paragraph shall be inserted after paragraph (2), including notes

footnote # 2 and 3:



"(2) the entitlement to the allowance are also of citizens United

of the Republic, who were enrolled in the battalions of troops, ženijního road

auxiliary technical battalions and military mine sections (hereinafter referred to as

"the military camp of forced labour"), referred to in § 18 para. 1 of law No.

87/1991 Coll. on out-of-court rehabilitation, as amended by Act No. 265/1992

Coll. and Act No. 78/1998 Coll., if they have been for the inclusion in the military

forced-labour camp, granted a special pension contribution ^ 2) or

a claim for compensation under other legislation issued to perform the

§ 8 para. 1 Act No. 198/1993 Coll., on the illegality of the Communist

regime and on resistance against it, in the wording of Act No. 220/2011 Coll. ^ 3).



2) section 5 of the Act No. 361/2005 Coll., on the evaluation of the participants of the national struggle for

the emergence and the liberation of Czechoslovakia and some of the survivors, about

a special contribution to the annuity certain persons, one-time cash

the amount of some participants in the national struggle for liberation in 1939

up to 1945 and amending certain laws, as amended.



3) of Decree-Law No 102/2002 Coll., on payment of a one-time financial

refunds to alleviate some of the grievances caused by the Communist regime

the persons listed in the military camps of forced labour ".



The former paragraph 2 becomes paragraph 3.



2. In article 1 (1). 3, the word "or" is replaced by a comma.



3. in paragraph 1 of the text at the end of paragraph 3, the words "or the inclusion in the

military camp of forced labour ".



4. In section 2, paragraph 1, the following paragraph 2 is added:



"(2) a claim for payment of the allowance shall be decided by the Ministry of the Interior

upon written request of the person referred to in section 1 (1). 2 that the application

attaches the documents certifying the claim. The application can be submitted no later than

31 December 2013, otherwise entitlement to the payment of the allowance shall cease to exist. ".



The former paragraph 2 becomes paragraph 3.



5. In section 3, the following shall be added at the end of the text "or 2; This does not apply if the

the widow of a citizen of the United States meeting the conditions referred to in paragraph 1 of the

paragraph. 2, the application submitted in good time for assistance under section 1 (1). 1 was

rejected ".



Article. (II)



Transitional provision



If the person entitled to payment of the allowance under regulation of the Government

No 135/2009 Coll., in the version in force before the date of entry into force of this

Regulation, not be entitled to payment of the allowance, based on the same

the facts again.



Article. (III)



The effectiveness of the
