The DECREE

of 6 December. October 2015,

amending Decree No. 5/2011 Coll., on the definition of hydrogeological

main resorts and groundwater, how to evaluate the status of groundwater

and details of the programmes, surveys and assessment of the State of groundwater

The Ministry of environment and Ministry of agriculture lays down

According to § 21. 3 of Act No. 254/2001 Coll., on the waters of and amendment to certain

laws (the Water Act), as amended by Act No 150/2010 Sb.:

Article. (I)

Decree No. 5/2011 Coll., on the definition of hydrogeological main resorts and services

groundwater, how to evaluate the status of groundwater and the constituent

detection and evaluation of the programmes, the status of groundwater, is hereby amended as follows:

1. In article 2 (d)):

"(d)) the threshold standard of environmental quality, which is listed in the

table 1 of annex 5 of this Decree ".

2. In section 7, paragraph 3, including the footnote No. 10:

"(3) the assessment of the chemical status of bodies of groundwater are used

groundwater quality standards. If the administrator or authorized Professional basin

body according to § 21. 4 water law with regard to the results of the

the detection and assessment of the State of groundwater for the body

water assumes that the groundwater quality standards could thwart

achievement of the environmental objectives of the related services

surface waters referred to in Section 23a of the water act or lead to significant

the deterioration of the ecological or chemical quality of such bodies, or to

significant damage to terrestrial ecosystems which are at the service of the

groundwater directly dependent, in accordance with table no. 1 of the annex

No 5 of this Ordinance more stringent threshold values. Programmes and measures

related to these thresholds shall apply also to the

the operations covered in section 33 of the Act and regulation of the water of the Government for the establishment of

vulnerable zones and action programme ^ 10).

10) Government Regulation No. 262/2012 Coll., on the determination of vulnerable areas and

the programme of action, as amended. ".

3. in annex 3, part A, including the title:

"Part of the Criteria and the good and unsatisfactory: the chemical status of groundwater

waters

(1) the chemical status of a body of groundwater, it is considered good if:

the results of the monitoring programmes and) groundwater:

1. do not show any symptoms of zasolení or other vniků pollutants

substances into groundwater,

2. polluting substances are not such as to have caused the failure

the objectives of the protection of water related bodies of surface water, the deterioration of the

chemical or organic status of these bodies of surface water, or

damage directly dependent terrestrial ecosystems,

(b)) the values of the groundwater quality standards or threshold values

set out in table 1 of annex 5 of this Decree are not exceeded

at any monitoring point in that body of groundwater or group of

bodies of groundwater.

(2) if the value of the quality standards or threshold laid down in

table 1 of annex 5 of this order is exceeded on one or more of the

monitoring locations, is for this groundwater carried out

the investigation procedure laid down in part B of this annex.

(3) the chemical status of a body of groundwater, it is considered good if

the investigation carried out in accordance with paragraph 2 shows that the

and the concentration of pollutants in excess of) quality standards

groundwater or the threshold values set out in table 1 of the annex No.

5 of this Ordinance pose a significant risk to the environment, and

taking into account the extent of the disability of groundwater,

(b)) are met the conditions laid down in point a of paragraph 1 of this annex),

c) requirements are met for the protected areas established pursuant to

special legislation ^ 8) and

d) function of groundwater, from which groundwater is used

for the various needs of society, in particular for the supply of the population

drinking water has not been significantly impaired by pollution.

(4) the chemical status of a body of groundwater, it is considered unsatisfactory,

If the conditions are not fulfilled, the good chemical status of a body of

groundwater as defined in paragraphs 1 to 3 of part A of this annex.

for example, section 8) 30 to water Act § 35. ".

4. in annex No 5 section, and including a title:

"Part of the evaluation process: groundwater quality

(1) for the evaluation of groundwater quality will make use of the results obtained from

surveillance programmes or operational monitoring (hereinafter referred to as the ' competent

program monitoring "), and the data obtained through the requirements of the

other legal předpisů2).

(2) the evaluation of the quality of groundwater is carried out for all

monitoring space monitoring network of groundwater chemical status

the program monitoring.

(3) the evaluation of the quality of groundwater is carried out for the indicators set out

in the program of monitoring, at least for all indicators

set out in table 1 of this annex.

(4) the evaluation of the quality of groundwater for monitoring sites, which

are not part of the monitoring network of groundwater chemical status,

done for all indicators, which are obtained through the

requirements of other legal předpisů2), and at the same time are determined

the relevant monitoring programs.

(5) the evaluation of the quality of groundwater lies in a comparison of the average annual

(arithmetic mean) of the values of the individual monitoring points with

the appropriate quality standard or the threshold value. In cases in which it is to

There is only one measurement, the average does not apply.

(6) the result of the evaluation of the quality of groundwater for the substance, and the indicators

Group A (table no. 1 of this annex) is compliant or non-compliant

the quality of the groundwater.

(7) groundwater quality is considered satisfactory, if no

the average annual value does not exceed the indicators to the monitoring site

quality standard or the threshold value specified in table 1 of this

Annex.

(8) the result of the evaluation of the quality of groundwater for the characteristics of the Group (B)

(table no. 2 of this annex) is the presence or absence of the potential impact of human

activity.

(9) the result of the evaluation of the quality of groundwater for the characteristics of the Group (C)

(table no. 3 of this annex) is only a determination of their average annual

values.
