The DECREE
of 9 June. June 2003,
amending Decree No. 38/2001 Coll. on hygienic requirements for
products intended to come into contact with foodstuffs and dishes
The Ministry of health provides under section 108, paragraph. 1 of law No.
258/2000 Coll., on the protection of public health and amendment to certain
related laws, (hereinafter referred to as "the Act") for the implementation of section 26, paragraph. 1 (a).
b) and d) (a). 2 and 3 of the Act:
Article. (I)
Decree No. 38/2001 Coll. on hygienic requirements for products intended for
to come into contact with foodstuffs and dishes, is hereby amended as follows:
1. In section 2, paragraph 5, the word "beverage", the words "and liquid foods
consistency ".
2. In article 2, point 19 shall be deleted.
Items 20 to 29 shall be renumbered as paragraphs 19 to 28.
3. In section 2, the following shall be added after point 28, paragraphs 29 to 31, as follows:
"29. plastics, organic macromolecular compounds obtained by polymerization,
polycondensation, polyaddition or any other similar process from molecules with
lower molecular weight or by chemical alteration of natural
macromolecules. To such macromolecular compounds can be added
other substances or materials referred to in annex 3 to this Decree, and
under the conditions of this order,
30. the addition of a polymer substance that is physically in polymers
dispergována without significantly influenced the structure of the polymer, and is
added due to the influence of the processing properties of or for the purpose of
modification of utility properties of the polymer,
31. good manufacturing practice, established and maintained by a set of measures, which
ensures the management of the production processes and reproducible quality of the products with the
the required properties. ".
4. In section 3, paragraph 3. 1, after the word "produced", the words "in accordance with the
the principles of good manufacturing practice ".
5. In section 3, paragraph 3. 1, after the word "health" shall be inserted after the words "or
bring about an unacceptable change in the composition of the foodstuffs or affect the

6. In section 3, the following shall be added in paragraph 5 paragraph 6 and 7 are added:

must comply with the hygiene requirements laid down in annex 15 to this
the Decree.
(7) the requirements referred to in paragraph 6 shall not apply to containers and
storage tanks having a capacity greater than 10 000 litres, as well as on their

7. In section 8 (2). 3 (b). and at the end of section), 1 the word "or" is deleted.

9. In section 10, paragraph 1 shall be deleted.
Paragraphs 2 and 3 shall become paragraphs 1 and 2.
10. In section 10, paragraph 1. 1 at the end of paragraph (e) shall be replaced by a comma and dot)

11. In section 11 on the end of the text, the words "and the specifications".
12. In article 11 the present text becomes paragraph 1 and the following
paragraphs 2 and 3 shall be added:
"(2) the general specifications related to plastic products and their materials
are set out in Appendix II to the annex No. 3. Other specifications
concerning certain substances listed in positive lists of annex
No 3 set out in Appendix II, part B of this annex.

The requirements on plastics and plastic products LIST of MONOMERS, additives and OTHER
STARTING SUBSTANCES, WHICH MAY BE USED FOR THE MANUFACTURE OF PRODUCTS FROM PLASTIC
1. This annex contains the list of monomers, additives and other default
substances, which may be used for the production of plastics and plastic products,
intended to come into contact with foodstuffs. In the list are included
-default substance for polymerization, which includes polykondenzaci, polyadici
or any other similar process of formation of macromolecules,
-natural or synthetic macromolecular substances used for the manufacture of
of modified macromolecules, if the monomers or the other starting
the substances necessary for their manufacture are not included in the list,
-substances used to modify existing natural or
synthetic macromolecular substances
-substances which are added to plastics to achieve a technical effect
on the final product and are intended to be contained in the final
products,
-substances, which are used to create the environment in which
polymerization occurs (e.g. emulsifiers, surfactants,
buffer solutions, etc.).
2. In the list are included salts of aluminium, calcium, iron, magnesium,
potassium, sodium, zinc and salts (including double salts and acid salts)
of authorised acids, phenols or alcohols, as are also allowed.
The name "salt" appears in the list only if the corresponding free
acid (acid free) is not in the list (not in the list
listed). In such cases, the term "salt" means salt
"aluminum, calcium, iron, magnesium, potassium, sodium, zinc and salts
ammonium ".
3. the following are not included in the list of substances, although they may be
present:
and) substances that may be present in the final product:
-impurities in the substances used,
-reaction intermediates,
-degradation products,
b) oligomers and natural or synthetic macromolecular substances and their
mixtures, if the monomers or starting substances required for their synthesis
included in the list,
(c) mixtures of substances),
(d)) the substances which directly influence the formation of polymer (e.g. catalytic
systems).
Products, which contain the substances referred to in (a)), (b)) and (c)) must
comply with the requirements set out in § 3 (3). 1 of this order.
4. substances shall be of good technical quality as regards the criteria
purity.
5. For contact with foodstuffs can be applied only to products obtained
bacterial fermentation in accordance with Appendix I to this annex.

-column 1 (Ref. No.): the EEC packaging material reference number for the

-column 2 (CAS): CAS registration number (Chemical Abstracts

-column 3 (name): the chemical name,
-column 4 (restrictions and/or specifications) contains:
-specific migration limit (SML),
-maximum permitted quantity of the substance in the finished material or product
(QM),
-maximum permitted quantity of the substance in the finished material or product
expressed in mg/6 dm2 in contact with foodstuffs (QMA),
-any other restriction specifically mentioned,
-all specifications related to the substance or polymer.
7. If a substance that is listed in the list individually, is also
in the General Group, for this group, the restrictions referred to in
individually listed substances.
8. If the CAS number does not match the chemical name, chemical name
precedence over the CAS number. If the CAS number, the EINECS, according to registry
does not match the number of CAS in accordance with the CAS registry, the CAS registry shall apply according to the CAS.
9. In the tables in column 4 are used abbreviations and expressions that have
the following meanings:
DL = detection limit of the analytical method,
FP = final material or product
NCO = isocyanates,
ND = not to be detected. For the purposes of this order means that the substance
may not be detected by certified analytical method is specified by the
the limit of detection (DL). If such a method does not exist, proceed to
in drawing up the proven methods in accordance with section 4, paragraph 4. 1 of the Decree,
QM = maximum permitted quantity of the "residual substances" in the material, or

For the purposes of this Ordinance, the amount of the substance in the material or product
provides validated method of analysis. If such a method
does not exist, proceed to the elaboration of the proven methods in accordance with § 4
paragraph. 1 of the Decree,
QMA = maximum permitted quantity of the "residual" substance in the material or
the product, expressed in mg per 6 dm2 of the area in contact with foodstuffs,
QMA (T) = maximum permitted quantity of the "residual substances" in the material, or
the product, expressed as the total content of substances or groups of substances listed in
mg per 6 dm2 of the area in contact with foodstuffs. For the purposes of this Ordinance,
the quantity of the substance in the material or a product certified by the analytical
method. If such a method does not exist, proceed to the
developing proven methods according to the section 4, paragraph 4. 1 of the Decree,
SML = specific migration limit in food or in the food
