Amending some acts concerning travel documents

Parliament has passed this Act of the Czech Republic:
PART ONE


Changing the law on travel documents
Article I


Act no. 329/1999 Coll., On travel documents and amending Act no.
283/1991 Coll., On the Police of the Czech Republic, as amended,
(Travel Documents Act), in as amended by Act no. 217/2002 Coll., Act No.
. 320/2002 Coll., Act 539/2004 Coll. and Act no. 559/2004 Coll., is amended as follows
:

First In § 2 para. 1 second sentence after the word "registered" the words "or
processed".

Second In § 2, the following paragraph 4 is added:

"(4) Data processed in the data carrier with biometric data (§ 5 para. 2)
not processed in any manner other than that prescribed by law.".

Third In § 3 para. 1, third sentence, the words "whose travel document"

11th in § 9, Subsection 1 reads:

" (1) Police in checking the passport of a citizen at the border
transition writes at his request into the passport record

children accompanied by a parent when his travel card

Third code to the public section of the electronic signature of the person who entered the data into the data carrier

D) of lost, stolen or invalid diplomatic or official passports
: number and kind of lost, stolen or invalid
diplomatic or service passport,

E) the detention of diplomatic or service passport:

First type and number of diplomatic or service passport, which is to be or

F) a refusal to issue or withdrawal of a diplomatic or service passport:

First type and number of diplomatic or service passport, which was withdrawn,

Second the authority that requested the refusal to issue or withdrawal
diplomatic or service passport,

Third the authority that decided on the refusal to issue or withdrawal
diplomatic or service passport,

Fourth date and reason for refusal to issue or withdrawal
diplomatic or service passport,

Fifth date and reason for return withdrawal of diplomatic or service passport,

6th date and reason for cancellation refusing to issue diplomatic or service passport
,

7th the name or names, surname and ID number of the citizen, to which the data subject
refusal to issue or withdrawal
diplomatic or service passport,

G) an hour, day, month and year to provide information.

(3) The records of diplomatic and official passports when granting
statements pursuant to § 30 paragraph. 5 also keep records of access to this
information system containing data on:

A) a username recipient data

B) day, month, year and time to provide data

C) birth certificate number holders, whose details are provided, or other
data, which is crucial to find this holder, the search
respective holders will be made through other
holders for whom it is crucial a joint statement,

D) because of access to the records of travel documents.

The data referred to in paragraph 2. a) Section 2 after the handover

first in § 5, at the end of subparagraph d) is replaced by a comma and a letter

technical instrument enabling comparison of currently displayed

(7) Data processed in the data carrier with biometric data (paragraph 1)
not processed in any manner other than that prescribed by law.

(8) Aliens passport issued by the Police

A) at the request of an alien staying on the territory under a permit to stay

"(2) if an application is the number of applications under this Act

(3) A citizen who applies for issuing an identity card, or other
person who is entitled under this Act to submit an application for this
citizen, is entitled to request the withdrawal ^ 20) of an application
at the time of the request to dispatch technologically processed data from
application to the Ministry to ensure the production of an identity card, or
case of identity card without machine-readable data, until the commencement of processing civil
card.

Ninth in § 24, paragraphs 3, 4 and 5 shall be deleted.

10th after § 24 the following new § 24a and 24b, including the title added:

"§ 24a

Issuance of identity cards without machine-readable data with a period of one year


(1) Municipal authorities with extended powers may issue civil
cards without machine-readable data with the prior consent of the Ministry
if

A) there was a technical failure of the device, guaranteeing
processing and transfer of data on manufacturing technology for more than 7 calendar days
,

B) as a result of a disaster or other emergency
not issue identity cards with machine readable data,

C) citizens need an identity card issued in a period shorter than 30 days
in connection with the exercise of voting rights.

(2) identity cards issued pursuant to paragraph 1 shall be valid for a period of 1 year
date of their issue.

(3) To issue identity cards without machine-readable data
citizen must submit 2 photos.

§ 24b

Issuance of identity cards without machine-readable data with a period of validity of one month


(1) Municipal authorities with extended powers issued due to loss,
theft, damage or destruction of identity card at the request of a citizen identity card
without machine-readable data with a validity of one month from the date of issue
. Identification cards without machine-readable data in these cases
issued without the prior consent of the Ministry.

(2) An application for the issuance of identity cards without machine-readable data
served concurrently with the application for issuing an identity card with machine readable data
. ID card without machine readable data into
time of issuing an identity card with machine readable data does not issue
repeatedly.

(3) To issue identity cards without machine-readable data
citizen must submit 2 photos. ".



PART SIX Amendment to the Act on Administrative Fees

Act no. 634/2004 Coll., on administrative fees, as amended by Act no. 217/2005 Coll
., Act no. 228/2005 Coll, Law no. 357 / 2005 Sb., and Act no. 361/2005 Coll
., is amended as follows:

1st part IX in item 115 letter a) reads:

"a) Issue tourism passport is machine readable
as a data carrier CZK 600
- Citizens over 5 years and younger than 15 years CZK 100 ".

2nd Part IX in item 115 letter b) reads:

" b) Issue passport without machine-readable
Data CZK 1,500
- Citizens under the age of 5 years CZK 50
- Citizens over 5 years and younger than 15 years CZK 1,000. "


Third In Part IX under 115 point. e) the word "document" is replaced
word "card".

Fourth In Part XII under 157 point. c) the word "document" is replaced
word "card".

EFFICIENCY Article XI


This Act comes into force on September 1, 2006, with the exception of the provisions of Article
. II, Section 2, which comes into force on 15 August 2006.
