Fixing the 1999 programs of support
non-productive functions of agriculture, to promote activities involved
landscape maintenance and assistance programs to support less-favored areas
Government directs pursuant to § 2 para. 5 of the Act no. 252/1997 Coll., On agriculture
:
PART ONE
GENERAL PROVISIONS
§ 1
(1) Based on support programs in accordance with § 2 para. 3 of the Act-1) or
assistance programs, according to § 2 para. 4 of the Act provides state in 1999
financial support or assistance (hereinafter "support or assistance ")
according to the criteria laid down in this Regulation to natural or legal persons who
A) agricultural farms on the basis of ownership rights, leases
or other legal reason ^ 2) on arable land, hop fields, vineyards,
gardens, orchards, meadows, pastures and other areas ^ 3) | || (hereinafter referred to as "agricultural land"), whose total area
First at least 5 hectares or
Second in the case of agricultural land in national parks or protected areas
(hereinafter referred to as "specially protected areas"); 4)
or in the protection zones established to protect the yield, quality or health
water of surface or groundwater
water intended for drinking water supply, ^ 5) is at least 2 hectares or
Third in the case of farming organically on arable land
hop fields, vineyards, gardens and orchards, at least 1 ha
And
B) Zálesná in accordance with special legal regulations 6)
agricultural land on which the agricultural area farmed, based on ownership rights
.
(2) Agricultural management on other surfaces ^ 3) confirms in honor
statement that the conditions for granting the aid or assistance given in Annexes
no. 19 and 20 thereto, the relevant territorial
Department of the Ministry of agriculture (hereinafter the "Ministry") in military
Újezdech delegated authority of the Ministry of Defence.
(3) Aid or assistance can not be provided to state enterprises, and budgetary
subsidized organizations, with the exception of state-owned enterprises and budgetary and
governmental organizations under the Ministry of Defence.
§ 2
(1) support or assistance, the Ministry or the Ministry of Defence
at the request of the persons mentioned in § 1 (hereinafter "the applicant"), subject to further
criteria.
(2) support or assistance belongs in fulfilling the criteria for the whole year 1999.
support or assistance in accordance with § 1 para. 1 point. a) can release
advance.
(3) support and assistance and meeting the established criteria and
provide more support programs or aid programs under this Regulation.
§ 3
(1) An application for support or assistance (hereinafter referred to as "application")
applicant submitted to the competent territorial department of the ministry, or
Ministry of Defence, in the case of a legal person under its jurisdiction.
Application is submitted
A) to 26 February 1999 for aid or assistance referred to in § 1 para. 1 point.
A)
B) until 30 June 1999 with the support or assistance referred to in § 1 para. 1 point.
B).
If no request to the territorial department of the Ministry or the Ministry of Defence
these deadlines delivery, support or help with
granted.
(2) The application must be accompanied by the relevant documents pursuant to Annex no. 1
20 thereto. Affidavit that the conditions for granting the aid
or assistance specified in Annexes no. 19 and 20 to this
regulation, submitted by the applicant no later than 29 October 1999;
confirmation professional forest manager listed in Annex no. 11 hereto
filed by the applicant no later than 15 November 1999.
(3) If the application is incomplete or contains a clearly incorrect data,
respective territorial department of the Ministry or the Ministry of Defence
be returned to the applicant within 30 days of its receipt, together with an indication of defects
and invitation for their removal. Failing to remove defects
request within 7 calendar days of receipt of the invitation, considered the request
been filed out of time and encouragement or assistance to be granted.
(4) The applicant for assistance under § 10 paragraph. 1 point. a) or b), or for help
according to § 16 point. a), b) or d), when applying the relevant
territorial department of the Ministry or the Ministry of Defence information
Necessary to assess the need for aid or assistance given in the Annex.
18 of this Regulation.
(5) Information provided support or assistance may be published.
§ 4
(1) Support and assistance will be given if
A) the application meets the criteria laid down in this Regulation is documented
relevant documents and submitted within the deadlines,
B) the applicant has settled the application date due to commitments
State fund market regulation, Support and Guarantee
peasant and Forestry Fund, as the Land Fund of the Czech Republic, the National Property Fund
Czech Republic due liabilities arising from
already signed contracts for the provision of funds from the state budget
C) the applicant has fulfilled the obligation whose fulfillment within a specified period
was imposed by an administrative decision issued in violation
protection legislation environmental components ^ 7) the
which occurred in relation to farming agricultural land, and
provided that
First final administrative decision was issued in the last 2 years
before the effective date of this regulation, or
Second final administrative decision was issued October 29, 1999.
(2) Support and assistance shall be provided even if it is not met
condition set out in paragraph 1. c) if the deadline for fulfillment of the obligations laid down
final administrative decision expired before 29 October 1999.
§ 5
(1) The amount of aid or assistance shall be determined
A) for support or assistance in accordance with § 1 para. 1 point. a) the financial
awards 1 point
B) for support or assistance in accordance with § 1 para. 1 point. b) at the rates in CZK
technical unit of the procedure, for which the aid or assistance
applies.
(2) Financial aid awards or aid amounts are expressed in
rounded to the nearest CZK downward.
(3) The amount attributable to one share point down
amount specified in the state budget for 1999 in the budget chapter of the Ministry and
number of points determined on the basis of eligible applications submitted within the deadline.
(4) The rate for the technical unit of the performed act is given in Annex
no. 12 hereto.
§ 6
(1) does not satisfy the criteria for granting aid or assistance
support or assistance to be granted.
(2) Ministry or the Ministry of Defence in writing that they
facts stated in paragraph 1 of the applicant and the notice shall state the reasons for that
not support or assistance.
§ 7
(1) Ministry or the Ministry of Defence carried out by special legislation
^ 8) control the use of funds
granted under this regulation. Identified shortcomings have resulted
requirement for the applicant to return the support or assistance
notify the tax office.
(2) If the applicant amounted to granting aid or assistance under
false information given by him, will return in accordance with specific legislation
^ 9) granted aid, or aid in full.
(3) If the applicant
A) during 1999 failed to meet any of the criteria, which were
grant aid or assistance tied or
B) has not fulfilled within the deadline obligations that were imposed
final administrative decision [§ 4 para. 1 point. c) and paragraph. 2]
in connection with the management of agricultural land, he is obliged
accordance with special legislation ^ 9)
return provided financial resources due to the facts mentioned in this paragraph to the entire
program support or assistance to which those facts relate.
(4) The provisions of paragraph 3 letter. b) does not apply to measures to remedy environmental
faults incurred before privatization and stored
final administrative decision.
(5) If the applicant has not met during 1999
only some of the criteria on which had been fixed for support, or assistance for maintenance

extraordinary and special zřetelehodných reasons, the Ministry or the Ministry of Defence
, if requested by the applicant, to limit the refund
only to agricultural land.
§ 8
(1) The funds are remitted to the bank account of the beneficiary
aid or assistance. Recipient of aid or assistance is accounted for under special regulations
. ^ 10)
(2) Payments of aid or aid from past years and penalties for the illegal use or retention
state funds are transferred directly to the state budget through
relevant tax authority, levies
aid or assistance in the current year They are transferred to the account from which they were
support or assistance provided penalties is transferred to the account of the financial
office.
PART TWO
Programs of support activities contributing to LANDSCAPE MAINTENANCE
§ 9
The financial statements of support
Support from the state budget (hereinafter the "Support") are provided in
financial amounts derived from the score, the amount of which is
listed in § 12 para. 1-4, and the rates set forth in § 12 paragraph. 5th
§ 10
Types of support programs
(1) Support programs shall be determined on
A) maintenance of agricultural land, contributing to the maintenance of the landscape, if
of agricultural land in the cadastral assigned
average price of agricultural land under special legislation ^ 11) (hereinafter
"agricultural land average price ") 4.01 CZK per 1 m2 and higher
unless the agricultural land in specially protected areas, ^ 4)
proper condition under special legislation, ^ 7)
B) raising of cattle meat breeds on agricultural land with an average
price ranging from 4.01 to 5.00 CZK per 1 m2, unless the
agricultural land in specially protected areas, ^ 4)
C) compensation for losses due to farming organically
applicant on agricultural land with an average price of CZK 4.01 per 1 m2 and higher
unless the agricultural land in specially protected areas, ^ 4) | ||
D) liming of agricultural land arable land with an average price of 4.01 CZK
per 1 m2 and higher soil reaction pH to 5.5, unless the
agricultural land in specially protected areas, ^ 4)
E) change in the structure of agricultural production afforestation of agricultural land with
average price of CZK 4.01 per 1 m2 and higher, including the protection of forests
thus resulting in their collateral ^ 12) unless the agricultural land | || in specially protected areas. ^ 4)
(2) Support for the support programs referred to in paragraph 1 shall be granted for
agricultural land in specially protected areas. ^ 4)
§ 11
The criteria for eligibility
(1) The criteria for eligibility for support programs according to § 10 is
:
A) keeping the whole area of agricultural land of the applicant specified in § 1
paragraph. 1 in proper condition under special laws; ^ 7)
to the total area of cultivated agricultural land is counted
acreage of agricultural land with the presence of trees or agricultural raids
uncultivated wetlands if it is in accordance with the non-farm || | land use plans documented confirmation ministries or
Ministry of Defence under Annex no. 9 hereto;
these agricultural lands which aid is granted,
B) the fact that the applicant is not included in the list drawn
respective district office in which they are registered, applicants having
unfulfilled obligations in the field of environmental management at
agricultural land [§ 4 para. 1 point . c) and paragraph. 2] to them
imposed by an administrative decision;
lists are forwarded to the Ministry and the Ministry of Defence in terms of the February 26, 1999 and as at 29 October 1999
,
C) the fact that the applicant requests in 1999, also by granting another
aid or assistance to the same agricultural plot or purpose within
support and help provided by the Ministry for the renewal of vineyards,
plantations or orchards or within the support or through the use
agricultural land for non-food purposes, nor has it been
granted aid or aid for the same purpose other state
administration.
(2) The criteria for eligibility under § 10 paragraph. 1 point. b)
addition to the criteria set out in paragraph 1 the following additional criteria:
A) bred at least 5 calves that were born in the period from September 1
1998 to 31 August 1999, and was reared by their mothers in
breeding without market milk production during the growing season grazing manner on
agricultural land at an average price of CZK 4.01 to 5.00 per 1 m2
B) a minimum proportion of blood calf beef cattle is 50%
C) calf's father is a breeding bull. ^ 13)
(3) The criteria for eligibility under § 10 paragraph. 1 point. c)
addition to the criteria set out in paragraph 1 the following additional criteria:
A) the applicant in the list in which those farmers who
agricultural farms especially friendly manner and shall ensure the protection of all
environmental components (hereinafter referred to as "organic farmers");
this list for 1999 published by the Ministry in the Bulletin of the Ministry
Agriculture
B) in the case of agricultural land according to § 10 paragraph. 1 point. c)
permanent grassland farmed by organic farmers, also ecological
livestock owned by the applicant or his
raised on the basis of a rearing; intensity of organic husbandry
zvířat14) listed in Annex no. 4 of this regulation in the table and
reared on agricultural land according to § 10 paragraph. 1 point. c)
provided under this Annex and achieved averaged for the entire
year must be at least 0.1 livestock units per 1 ha related
such permanent grassland; for calculating the stocking density
livestock applicant may also include permanent grassland acreage
crops and animals raised on agricultural land according to § 14
adjacent to agricultural land referred to in § 10 paragraph. 1 point. c)
if you are farmed organic farmers, taking into account the
relation to the use of production for feed use at the steps counted
animals and agricultural land; These farms and animals can not be
counted multiple times.
(4) The criteria for eligibility under § 10 paragraph. 1 point. d)
addition to the criteria set out in paragraph 1 and Annex no. 10 hereto
submit the invoice for the purchase of ground limestone, dolomitic limestone
^ 15) or quicklime or tax document on the implementation
liming on order, at a dose of at least 1.5 to 2.0 tons of dolomitic limestone
, ground limestone, or at least 0.75 to 1.0 tons of quicklime per 1
ha of agricultural land arable land, no later than 29 . October 1999;
Aid shall be granted for a maximum of 20% of the total area of agricultural land
applicant arable land with soil reaction pH to 5.5, documented proof of
agrochemical testing of agricultural land.
(5) The criteria for eligibility under § 10 paragraph. 1 point. e)
addition to the criteria set out in paragraph 1 the following additional criteria:
A) the use of a genetically suitable habitat and planting and capable
planting materials, ^ 16) compliance with the interests of the protection of agricultural land fund
^ 17) and carrying out all the work specified in the project afforestation
B) 30% or higher representation of amelioration trees ^ 18)
fenced areas and fence height at least 160 cm, if they are established
fences on land forested in 1998 and 1999.
(6) In case of repeated afforestation will provide aid of up to 30% of
seedlings used for reforestation in 1997 and 1998 when
meet the criteria under paragraph 5. and).
§ 12
Point value performance criteria
(1) For support program according to § 10 paragraph. 1 point. a) management on 1 ha
A) of agricultural land to permanent grassland with an average price
First ranging from 4.01 to 5.00 CZK per 1 m2 Rated 3 points
Second CZK 5.01 or higher per 1 m2 rated 2.5 points
B) of agricultural land not covered under point a) the average price
First in the range from 4.01 to 6.00 per 1 m2 CZK rated 3.5 points
Second ranging from 6.01 to 8.00 CZK per 1 m2 Rated 3 points
Third CZK 8.01 or higher per 1 m2 evaluated by 2 points.
(2) For the support program according to § 10 paragraph. 1 point. b) is breeding 1 piece
calf on agricultural land with an average price ranging from 4.01 to 5.00
CZK per 1m2 evaluated with 5 points.
(3) The support program according to § 10 paragraph. 1 point. c) loss on
1 ha of agricultural land in addition to evaluation in accordance with paragraph 1 ranked
A) by orchards, vineyards and hop fields other 15 points
B) of arable land with an additional 10 points
C) in the case of grassland other 5 points.
(4) For support program according to § 10 paragraph. 1 point. d)
liming on 1 ha of agricultural land arable land rated 1.5 points.
(5) For support program according to § 10 paragraph. 1 point. e) are carried
performance valued at CZK rate for the technical unit of output, on which
the individual aid relates.
§ 13
Calculation of the aid
Amount of aid is calculated
A) support according to § 10 paragraph. 1 point. a) to d) as a multiple point
evaluate the performance criteria support programs according to § 12 and above

B) for aid according to § 10 paragraph. 1 point. e) as a multiple of the number of technical

Assistance programs to less favored areas
§ 14
Definition UAA

A) cadastral average price of agricultural land in
CZK 4.00 per 1 m2

§ 15
The financial statements of support
Assistance to less favored areas (hereinafter referred to as "assistance") from the state budget
is provided in the financial amounts derived from scoring,
whose amount is specified in § 18 par. 1-6, and at the rates specified in paragraph 18 §

§ 16
Types of assistance programs
Assistance programs down to
A) maintenance of agricultural land in the less favored areas contributing to
landscape maintenance in proper condition under special legal regulations
; ^ 7) on agricultural land in specially protected areas; 4)
to cover other costs associated with the maintenance of the land in each zone
conservation; Assistance will be given to
agricultural land used as arable land in contradiction with special
law, 3) with the exception of agricultural lands permanent grassland,
on which the first year of implementation of their recovery plowing and sowing
seeds with a predominance of grasses; Assistance will be provided to agricultural land
recorded as arable land and other areas, 3) under permanent
grasslands
B) cattle breeding beef cattle breeds in less-favored areas,
C) compensation for losses due to farming organically
applicants in less-favored areas,
D) sheep farming in less favored areas on agricultural land with
average price to CZK 3.10 per 1 m2
E) liming of agricultural land arable land with soil reaction pH to 5.5
in less-favored areas,
F) changing structure of agricultural production afforestation of agricultural land in
less-favored areas, including the protection of forests so incurred to ensure their
. ^ 12)
§ 17
The criteria for granting assistance
(1) The eligibility criteria for assistance programs according to § 16
A) keeping the whole area of agricultural land of the applicant specified in § 1
paragraph. 1 in proper condition under special laws; ^ 7)
to the total area of cultivated agricultural land is counted
acreage of agricultural land with the presence of trees or agricultural raids
uncultivated wetlands if it is in accordance with the non-farm || | intentions exploitation of agricultural land documented confirmation
Ministry or the Ministry of Defence under Annex no. 9
to this Regulation; these agricultural lands to aid granted in
B) in the case of farms on agricultural lands in specially protected areas
^ 4) or on farms on agricultural lands in protective

D) the fact that the applicant requests in 1999, also by granting another
aid or assistance to the same agricultural plot or purpose within
support and help provided by the Ministry for the renewal of vineyards,
plantations or orchards or within the support or through the use
agricultural land for non-food purposes, nor had

(2) The criteria for assistance under § 16 point. a), b) and d) are
addition to the criteria set out in paragraph 1 the following additional criteria:
A) in the case of farms on agricultural lands under § 14 point. a)
intensity of livestock ^ 14) in Annex no. 5
point 2 of Part B of the table to this regulation owned by the applicant or his
livestock under contract for rearing provided
under this Annex and achieved averaged for the entire year is
range of 0.25 to 1.5 livestock units per 1 ha of agricultural land
mentioned in § 14 point. a) within the district; the proportion of pigs and poultry
determined in accordance with Annex no. 5 point 2 of Part A of the table this
regulation can not exceed 50% of the total state
large livestock units; when calculating the density of livestock is
reflect the agricultural parcels referred to in § 14 point. a)
and farm animals reared on them within the district; to calculate the applicant
into account all adjacent agricultural lands, unless However
agricultural land according to § 14 point. b) and all livestock
kept on adjacent agricultural lands, even in the adjacent
district, and taking into account the relation to the use of production for feeding purposes

share of pigs and poultry determined in accordance with Annex no. 6 of Table A
part of this regulation can not exceed 30% of the total state
livestock units; the calculation of the stocking density
farm animals are taken into account agricultural lands mentioned in § 14 point. b)
and livestock reared on them within the district; calculation may take into account the applicant
agricultural lands mentioned in § 14 point. b)
adjacent districts and farm animals are kept on all
adjacent agricultural lands, even in a nearby district, with regard to
relation to the use of production as feed for animals counted thus
; the livestock can not be counted more than once
; conversion types and categories for these purposes
eligible livestock on livestock units is given in Annex no. 6
this regulation in the table.
(3) The criteria for assistance under § 16 point. b) addition
criteria set out in paragraphs 1 and 2, these additional criteria:
A) bred at least 5 calves that were born in the period from September 1
1998 to 31 August 1999, and was reared by their mothers in
breeding without market milk production during the growing season grazing manner | ||
B) a minimum proportion of blood calf beef cattle is 50%
C) calf's father is a breeding býk.13)
(4) The criteria for assistance under § 16 point. c)
addition to the criteria set out in paragraph 1 the following additional criteria:
A) the applicant in the list referred to in § 11 par. 3 point. a)
B) in the case of agricultural land under permanent grassland in less-favored areas
farmed by organic farmers, also ecological
livestock owned by the applicant or his
raised on the basis of a rearing; intensity of organic breeding farm animals
^ 14) in Annex no. 7 to this Regulation in the table and
reared on agricultural land according to § 14 point. a)
determined in accordance with this Annex and achieved averaged for the entire year must be
least 0.1 livestock units per 1 ha relative such
permanent grassland; to calculate the density of livestock can

B) the minimum number of animals reared are 5 pieces.
(6) The criteria for assistance under § 16 point. e)
addition to the criteria set out in paragraph 1 and Annex no. 10 hereto
submit the invoice for the purchase of ground limestone, dolomitic limestone
^ 15) or quicklime or tax document on the implementation
liming on order at a dose of at least 1.5 to 2.0 tons of dolomitic limestone
, ground limestone, or at least from 0.75 to 1.0 tons of quicklime per 1
ha of agricultural land arable land, no later than October 29 1999;
Assistance shall be extended to a maximum of 20% of the total area of agricultural land
applicant arable land with soil reaction pH to 5.5, documented proof of
agrochemical testing of agricultural land.
(7) To provide assistance pursuant to § 16 point. f)
addition to the criteria set out in paragraph 1 the following additional criteria:
A) the use of a genetically suitable habitat and planting and capable
planting materials, ^ 16) compliance with the interests of the protection of agricultural land fund
^ 17) and carrying out all the work specified in the project afforestation
B) 30% or higher representation of ameliorating dřevin18) at
fenced areas and fence height at least 160 cm, if they are established
fences on land forested in 1998 and 1999.
(8) After repeated afforestation will provide aid of up to 30% of
seedlings used for reforestation in 1997 and 1998 when
meet the criteria under paragraph 7 letter. and).
§ 18
Point value performance criteria

valued at CZK rate technical unit of output, on which

The amount of aid is calculated
A) for assistance under § 16 point. a) to e) as a multiple scoring
fulfilling the criteria of assistance programs according to § 18 and the financial awards 1

B) for assistance under § 16 point. f) as a multiple of the number of technical units
performed exercise and rates per technical unit pursuant to § 5. 4th

§ 20
Transitional provisions
For legal relations in matters of support and assistance arising before the entry into force of this Regulation
apply existing legislation.
§ 21
Repealing provisions
Repealed Government Regulation no. 341/1997 Coll., Laying down
supporting programs to support non-production functions of agriculture, to promote
activities involved in landscape maintenance and assistance programs for less-favored
areas.
§ 22
Efficiency
This regulation comes into force on publication.
