GOVERNMENT REGULATION



of 5 April 2004. February 2007,



amending Government Decree No. 245/2004 Coll., on the establishment of closer

the conditions for implementation of the measures of the common organisation of the market in wine, in

amended by Decree-Law No 83/2006 Sb.



The Government ordered pursuant to section 2b, paragraph 1. 2 of law No 249/1997 Coll., on

Agriculture, as amended by Act No. 128/2003 Coll. and Act No. 441/2005 Coll.:



Article. (I)



Government Regulation No. 245/2004 Coll., on the establishment of detailed conditions when the

implementation of the measures of the common organisation of the market in wine, as amended by regulation

No 83/2006, is amended as follows:



1. In section 8 paragraph 1. 1 the word "March" is replaced by the word "April".



2. In section 8 paragraph 1. 5, the words "plan and the first" shall be replaced by "plan

or first "and the words" the request referred to in paragraph 1 included in the plan "

are replaced by the words "the grower requested for inclusion in the plan".



3. In paragraph 8, the following paragraph 6 is added:



"(6) where a grower summary request to Fund several of the measures referred to in

paragraph 2, the Fund shall be included and assessed each measure separately.

The provisions of § 8a of the paragraph. 1 (b). (b)) shall remain unaffected. The Fund shall be included in the plan

7. In article 8 c of paragraph 1. 1, after the words "of not less than 3 000/ha" the words ";

dosadba must be at least 1 000/ha.



8. In section 8 c paragraph 2. 2 letter d) is added:



"(d)) end date of the measure referred to in paragraph 4.".



9. in section 8 c paragraph 4 is added:



"(4) a grower shall submit an aid application within 2 months after the increase in the number of shrubs

in the vineyard mounted with back-up posts. ".



10. In section 8, paragraph 5 shall be deleted.



11. in section 8 d of paragraph 1. 3 (f)):



"(f)) end date of the measure referred to in paragraph 4.".



12. in section 8 d paragraph 4 is added:



"(4) an application for support measures to move into the hillside vineyard grower shall submit

13. In article 8e, paragraph 1 shall be added at the end of the sentence "Protection Measures

18. in § 8f paragraph 1 reads:



"(1) the measures of protection against damage caused by mechanical birds vineyards with

the marketing year for the farmer. ".



19. in § 8f para. 3 (b)):

20. In § 8f para. 4 sentences first and second, the word "growers" is replaced by

21. in § 8f para. 5 (b). and the number "6)" is replaced by "2" and the words

22. in § 8f para. 5 (b). (b)), the words "in the term provided for in § 8i para.

1 "shall be replaced by" within 2 months from the date of termination of active protection

the vineyards ".



23. § 8f para. 6, the words "this provision" shall be replaced by the words "measures

passive protection measures carried out or made active protection ".



24. in section 8 g para. 3 (b). e), the words "construction of retaining structure"

replaced by the words "the planting of the vineyard".



25. In section 8 h of paragraph 1. 4 is the number "6" is replaced by "2" and the words ",

calendar year to 27. February immediately following calendar

the year of the funds allocated in the relevant marketing year. Support

the restructuring and conversion of vineyards by growers, whose request was

the Fund is made from 28. February to 30. April of the calendar year, shall be paid by the Fund

of the funds allocated for the following marketing year. The provisions of §

30. In section 8j of the introductory part of paragraph 1, the words "within"

shall be replaced by the word "to".



31. in paragraph 2 of section 8j. 1 letter c) is added:



"c) increase the number of shrubs in the vineyard is 75 000 CZK per 1 ha of the vineyard,".



32. In paragraph 2 of section 8j. 1 letters e) and (f)):



"e) protection against damage caused by mechanical beasts vineyards makes



1.50 000 CZK per 1 ha of vineyards, with regard to the measures made by the individual

protection,



2. the 90 000 CZK per 1 ha of vineyards, with regard to the measures made public

protection,



f) protection against damage caused by mechanical birds vineyards makes



1.30 000 CZK per 1 ha of vineyards, in the case of measures carried out in passive

protection,



2.20 000 CZK per 1 ha of vineyards, in the case of measures carried out active

protection ".



33. In paragraph 2 of section 8j. 1 at the end of the text of subparagraph (g)) the following Word

"the vineyard".



Article II



Transitional provisions



1. applications for support for restructuring and conversion of vineyards, which have not yet

the grower did not Fund and for which, according to the existing legislation

has not yet expired period for its submission, however, pursuant to Decree-Law No.

245/2004 Coll., in the version in force from the date of entry into force of this

legislation, where appropriate, in accordance with these regulations, shall be assessed from the
