Amending Decree no. 299/2003 Coll., On measures for prevention and control of diseases and
diseases transmissible from animals to humans, as amended


Ministry of Agriculture, pursuant to § 78 of Act no. 166/1999 Coll., On
veterinary care and amending certain related laws (Veterinary
Act), as amended by Act no. 131/2003 Coll., Act No. . 316/2004 Coll., Act No.
. 48/2006 Coll., Act no. 182/2008 Coll. and Act no. 227/2009 Coll., (hereinafter
"the Act") to implement § 5 para. 3, § 10 paragraph. 3 and § 51a paragraph. 3 of the Act
:

Art. I

Decree no. 299/2003 Coll., On measures for prevention and eradication
infections and diseases transmissible from animals to humans, as amended by Decree no.
356/2004 Coll., Decree no. 389/2004 Coll., Decree no. 214/2005 Coll.
Decree no. 36/2007 Coll., Decree no. 316/2007 Coll. and Decree no.
288/2008 Coll., is amended as follows:

First § 1, including footnotes Nos. 1 and 1a reads:

"§ 1

This Decree implements the relevant regulations of the European Communities ^ 1)
and further to the directly applicable European Community regulations ^ 1) adjusts


A) general measures for the control and prevention of the spread of animal diseases,

B) the manner and deadlines for reporting diseases

C) the procedure for processing aspects and content of the contingency plans for
cases of certain dangerous diseases

D) for which the disease will establish programs sanitation animals

E) animal health conditions and rules on the vaccination of animals

F) requirements for national reference laboratories

G) measures for the control and prevention of the spread of certain dangerous infections,

H) terms under which proceeds in recognizing herds, holding
region or country free of the disease.

And keep the territory of the simple classical swine fever, as amended
.

Council Directive 2002/99 / EC of 16 December 2002 laying down
animal health rules governing the production, processing, distribution and importation
products of animal origin intended for human consumption.

1) Regulation of the European Parliament and Council Regulation (EC) no. 999/2001 of 22
May 2001 laying down rules for the prevention, control and eradication
certain transmissible spongiform encephalopathies, as amended.

Commission Regulation (EC) no. 1266/2007 of 26 October 2007 laying down
rules for Council Directive 2000/75 / EC as regards the control, monitoring,
surveillance and restrictions on movements of certain animals susceptible species in relation to bluetongue
, as amended.

Regulation of the European Parliament and Council Regulation (EC) no. 1774/2002 of 3 October 2002
health rules concerning animal by-products
origin not intended for human consumption, as amended. ".

Second § 3 reads:

"§ 3

(1) The State Veterinary Administration in accordance with § 48 para. 1 point. c) of the Act
developed and updated in accordance with the criteria set out in Annex no. 3 to
hereto and in accordance with the principles of contingency plans
national contingency plans in case of an outbreak
listed in the Annex. 1 hereto, or even some other
dangerous infections, if required by the disease situation.
These plans contain comprehensive rules to ensure efficient and coordinated
progress in the implementation of emergency veterinary measures for the control
infection and protect against its spread and ensure the availability of all that is
deemed necessary for the rapid eradication infections, including buildings,
facilities, equipment and materials.

(2) The Regional Veterinary Administration developed and updated
regional contingency plans in accordance with national contingency plans and
taking into account local conditions.

(3) The State Veterinary Administration submits a national contingency plans
Commission for approval. ".

Third In § 4 para. 1 the words "relating to" the word "nature".

Fourth In § 4 para. 2, "and the Municipal Veterinary Administration in Prague (

Fifth § 5 and 6, including the title and footnotes. 1b and 1c added:

"Programs sanitation animals

§ 5

(1) The State Veterinary Administration prepares with regard to the status and evolution of the disease situation
draft annual or multi-annual programs sanitation
animals from some dangerous infections, especially since
diseases listed in the decision of the European Communities
expenditure in the veterinary field-1b).

(2) animal sanitation programs are developed as programs
eradication, control and monitoring of certain diseases.

§ 6

(1) To be required financial contribution of the European Union (hereinafter
"Union") to finance a program of animal sanitation, the State Veterinary Administration
follows the decision of the European Community on certain expenditure in the veterinary
field ^ 1c).

European Communities on expenditure in the veterinary field

6th § 7-9 including the title and footnotes. 1d, 1e and 1f added:

"Reports of infections

§ 7

(1) The State Veterinary Administration submitted to the Commission and other Member States
reports of an outbreak of diseases referred to in the regulations of the European Communities on
disease notification ^ 1d).

(2) The State Veterinary Administration reports referred to in paragraph 1

A) the primary outbreak referred to in paragraph 1, discovered in the territory
Czech Republic

B) after the elimination of the last outbreak of the disease and protective end
control measures introduced for its climbing.

(3) Reports submitted pursuant to paragraph 2 of the State Veterinary Administration directly
Commission and the other Member States within 24 hours after

A) finding a primary outbreak, pursuant to paragraph 2. a)

§ 8

(1) The State Veterinary Administration reports directly to the Commission also
each additional (secondary) outbreak mentioned in § 7 para. 1
found on the territory of the Czech Republic.

latest on the first working day of each week and covers the week that
ends at midnight on Sunday, which precedes the report.

§ 9

State Veterinary Administration reported to the International Office for Epizooties (OIE)
incidence of diseases in accordance with the decision of the Office of the Single
list of diseases and the introduction of a new system of reporting ^ 1f).

7th In § 10 paragraph. 1 introductory part of the word "only" shall be inserted
words "in cases and under conditions laid down regulations of the European
community and this decree."

8th In § 10 paragraph. 1, letter b) reads:

"B) The Commission has adopted a decision to add protection and measures to combat these diseases
measures on the vaccination of animals.".

9th In § 10, paragraphs 3 and 4, which including footnote No.
. 1 g added:

"(3) The protective and control measures, which is authorized
vaccination of animals veterinary authorities stipulate the detailed terms

A) the implementation and progress of vaccination

B) procedure in cases where the detection of clinical signs
infection in the vaccinated animal or to his death.

(4) The possible vaccination may be used only registered
vaccines and other substances whose use in veterinary care

10th § 11 and 12, added:

"§ 11

(1) If required by European Community regulations on measures for
prevention of diseases and their control, directs the veterinary
management in the conservation and control measures to all vaccinated animals


A) were identified by a clear and legible mark
manner prescribed by European Community regulations on measures for
prevention of diseases and their control, or
manner provided by the State Veterinary Administration,

B) remain in the vaccination area except for those animals that are
sent to a slaughterhouse designated regional veterinary administration in order

examination of all susceptible animals on the farm
official veterinarian who certifies that none of the animals tested
not suspected of being infected.

(2) If the vaccination of animals is completed, may be allowed

(3) The State Veterinary Administration
inform the Commission regularly through the Standing Committee on the Food Chain and Animal Health
(hereinafter referred to as "Standing Committee") of the results conducted by vaccination.

§ 12

Notwithstanding § 10 par. 1 can decide on emergency vaccination
only after informing the Commission about this measure, and if this is without prejudice
fundamental interests of the Union in the field of animal health protection. In making this decision the

11th In § 13 para. 1 point. b) Sections 1 and 2 read:

16th § 15, including footnote no. 2 reads:

"§ 15

(1) If the holding is confirmed occurrence of any of the diseases listed in Annex
no. 1 hereto, performs regional veterinary authority
epidemiological investigation pursuant to § 13 par. 3 and order in accordance with § 15 and
§ 49 paragraph. 1 point. d) of the Act for the protection and control measures
referred to in § 13 para. 1 point. b) and paragraph. 2 and other protective measures

17th In § 16 paragraph 1 reads:

"(1) The Regional Veterinary Administration may, in accordance with § 15 and § 49 para. 1
point. d) of the infected farm, which consists of two or more
separate production units, to waive the requirements set out in
§ 15 para. 1 point. a) in the case of infection with pristine production
units provided that the official veterinarian confirms that

A) the structure and size of these units and the operations carried out in the framework of their
ensure their departments as regards housing and equipment, feed, feeding, and personnel and


B) their separation prevents the transmission of the disease from one unit to
other. ".

18th In § 16 para. 2 of the introductory part, the words "in accordance with § 13 paragraph
. 1 point. b) and § 49 para. 1 point. f) of the Act "are deleted.

19th In § 17 paragraph 1 reads:

"(1) If a disease is confirmed, the regional veterinary administration defines
around the infected holding a protection zone with a radius of at least 3 km
and a surveillance zone with a radius of at least 10 km, if necessary, additional || | restricted zone. ".

20th In § 17 at the end of the text of paragraph 3, the words "
and the application of these measures."

21st In § 17 para. 5, § 23, § 27 para. 1 point. c) § 41 paragraph. 3, § 42 paragraph

"(3) The State Veterinary Administration informs about the protective and control measures
Commission and other Member States through

24th In § 19 para. 1 point. d) the word "transported" the words
"under the supervision of an official veterinarian" and the word "necessary" is
replaced by the word "immediate".

25th In § 20 para. 1 point. c) after the word "is" the words "registered

(2) National Reference Laboratory


A) is responsible for coordinating standards and diagnostic methods
in the Czech Republic in the diagnosis of the diseases and for testing
vaccines

B) may provide other diagnostic laboratories
diagnostic reagents

C) inspects the quality of the diagnostic reagents used in the Czech Republic
,

D) regularly performs comparative tests
used diagnostic methods

E) keeps isolates of the virus of the relevant disease from cases confirmed in
Czech Republic

F) ensure confirmation of positive results obtained in other
diagnostic laboratories,

G) cooperate with the relevant reference laboratories within the Union.

(3) The State Veterinary Administration maintains and continuously updates a list
national reference laboratories and make it available, including any subsequent amendments
other Member States and to the public. ".

30th In § 26 point. b) the words "in other herds were detected
seropositive pigs. In this case, the regional veterinary administration
complementary examinations, especially new tests with samples taken from
interval of at least 28 days prior sampling

§ 32

(1) If a holding located in an area not

are set out in Annex no. 23 to this Decree
.

(3) Results of the tuberculin test is evaluated in accordance with Annex
no. 20 hereto.

§ 144

(1) The veterinary authorities shall, in accordance with § 10 paragraph. 1, § 48 para. 1
point. a) to c) and § 49 para. 1 point. b) of the Act
all necessary measures to ensure that the cattle population was maintained
status officially free of brucellosis, tuberculosis and enzootic bovine animals and to prevent the reoccurrence
outbreak of one of these diseases.

(2) The State Veterinary Administration informs the Commission of implementation measures
referred to in paragraph 1

§ 145

(1) Unless otherwise stated, the treatment of brucellosis, treatment and desensitization
treat tuberculosis and enzootic bovine and against
tuberculosis and enzootic bovine animals are prohibited.

(2) Vaccination against brucellosis in cattle can be done only with the consent
State Veterinary Administration and under the supervision of an official veterinarian
and stops as soon as the herd could be back as soon as the herds included

The Regional Veterinary Administration in accordance with § 15 and § 49 para. 1 point. d)
Act directs, unless otherwise specified, losers

A) all cattle in the herd, which has been confirmed
enzootic leukosis, within the prescribed period, or

B) only those animals which have been confirmed by the occurrence of enzootic and
considered by the regional veterinary administration to be infected.
These animals are being slaughtered under the supervision of an official veterinarian within 30 days after
acquaint farmers with the results of the examination and the duty to defeat
within a given period, these animals within compliance with the safeguards and measures to combat these diseases
. ".

168th In § 173, paragraph 1 reads:

"(1) If the Czech Republic officially free of swine fever, draw
State Veterinary Administration plan for the eradication of the disease and submit them for approval to the Commission

in the state free from disease areas or units, as
stipulated in the Decree no. 290/2008 Coll., on veterinary requirements for
aquaculture animals and aquaculture products, a
measures for prevention and control of certain diseases in aquatic animals
,

Second other outbreaks than those mentioned in point 1, which will
considered as secondary outbreaks, in accordance with § 8 par. 1 of this Decree,

Third secondary outbreaks of diseases of aquaculture animals,
which are reported on a monthly basis. ".

176th Annex no. 3 including the heading reads:

Minimum criteria for contingency plans

Contingency plans meet at least the following criteria:

First establishment of a national crisis center to coordinate all
disease control measures in the Czech Republic;

Second compiling a list of regional emergency units
sufficiently equipped to coordinate disease control measures at local level;

Third Details of the person charged with implementing control measures
disease, their qualifications and responsibilities;

Fourth you contact a regional crisis units

:

First Procedure for preliminary cleaning and disinfection:

Conditions for transferring eggs from a holding in case of suspicion of Newcastle disease


The Regional Veterinary Administration may authorize the transport of eggs from a holding
which are suspected of Newcastle disease (§ 80 of the Decree)
to the company for the manufacture of egg products in accordance with the provisions
European Communities (hereinafter Durčený company "), subject to the following conditions
:

First eggs are sent directly from the suspect undertaking to the designated
company. Each consignment is sealed before sending an official veterinarian
executing suspected holding

B) the shells of such eggs are disposed of in accordance with regulations of the European Communities
health rules concerning animal by-products

C) the packaging material, vehicles used to transport eggs
referred to in paragraph 1 and all premises with which the eggs come into contact
been cleaned and disinfected in such a way as to destroy the virus
Newcastle disease

D) the official veterinarian referred to in paragraph 2 has been informed of all consignments
eggs referred to in paragraph 1. ".

184th In Annex no. 13 in the title, the words "avian influenza," are deleted.

185th In Annex no. 13 section 1 reads:

"1. Preliminary cleaning and disinfection:

A) As soon as possible after the removal of carcasses of poultry for their destruction
removing a portion of the space where the poultry are kept, and all parts

I.
Tuberculosis


First Bovine herd is officially tuberculosis free if

A) all the animals are free from clinical signs of tuberculosis;

B) all bovine animals over six weeks has been tested with negative results
least 2 intradermal tuberculin test carried out in accordance with Annex.
20 of this Decree, the first was performed 6 months after
exclusion of any infection from the herd and the second 6 months after the first tuberculin test.
However, if you are in the herd only animals that originate from herds
officially tuberculosis, carried out the first tuberculin
least 60 days after assembly and the other animals are no longer required;

C) after the first tuberculin was no bovine animals over six weeks
inserted into the herd, if not responded negatively to an intradermal tuberculin

Second Herd of cattle has continued status of a herd officially tuberculosis free if


A) the continued fulfillment of the conditions referred to in point 1. a) and c);

B) all animals entering the holding come from herds with herd status
officially tuberculosis free;

C) all animals on the holding, with the exception of calves born in
economy and less than 6 weeks are subjected to on a yearly basis
routine tuberculin testing in accordance with Annex no. 20 of this Decree.
The State Veterinary Administration may, however, for the State or part thereof, where all
bovine herd official program to combat tuberculosis, alter the frequency
routine tests as follows:

Aa) unless on 31 December of each year determined by the average annual

Percentage of bovine herds which are confirmed as infected with tuberculosis, 2
during the last annual inspection period greater than 1% of all
herds in the region, the interval between routine testing herds
increased to 2 years. Males for fattening in isolated
epidemiological unit may be exempted from tuberculin if they come from herds officially
tuberculosis and if it is guaranteed that they will not be used to
breeding and will go direct for slaughter;

Bb) if on 31 December of each year determined by the average annual percentage
herds of cattle, which are confirmed as infected with tuberculosis,
during the last two biennial inspection period is higher than 0.2% of
of all herds in the region, the interval between routine testing
increased to three years, or it may be the age at which animals are subjected
those tests may be increased to 24 months;

Cc) failing to December 31 of each year determined by the average annual percentage
herds of cattle, which are confirmed as infected with tuberculosis, 2
during the last three-year control period, higher than 0.1% of
of all herds in the region, the interval between routine testing
increased to four years, or the State veterinary Administration may waive
tuberculin herds if

- Prior to entry into the herd all the cattle subjected to an intradermal tuberculin
with negative results, or

- All bovine animals slaughtered are examined for tuberculosis changes, and each
these changes are subject to a histopathological and bacteriological examination for evidence
tuberculosis.

State Veterinary Administration may also, with respect to the State or its
part, increase the frequency of tuberculin if the increased incidence of tuberculosis
.

Third Suspension or withdrawal of the status of the herd officially tuberculosis

3a. Status herd officially tuberculosis is suspended if

A) the conditions set out in paragraph 2 are not respected, or

B) one or more animals are deemed to be reacting positively to tuberculin
or was suspected tuberculosis when
examination after defeating. When an animal is considered positive
reagent, is excluded from the herd and defeats. For positive reagent or
suspect animal slaughtered to implement appropriate
mortem and laboratory tests and epidemiological investigation.
Status of the herd will remain suspended until the completion of all tests. Unless
presence of tuberculosis is confirmed, the suspension may be the status of the herd

or post-mortem and laboratory examination. However, if
conducted routine tuberculin herds using the comparative tuberculin
described in Annex no. 20 of the Decree and in the case of the herd, which has not been confirmed
no reagent for at least 3 years, the State Veterinary
Administration decide not limited by the movement of other animals in the herd
condition that dubious status of all reagents is illustrated
tuberculin next 42 days and that, until clarification of any animal
economy will not enter trading within the Union. If during the next
tuberculin test any animal either positive or inconclusive reaction
proceed in accordance with subparagraph b). If a disease is subsequently confirmed, all animals leaving
economy since the last clear herd test
searched for and examined.

3b. Status herd officially tuberculosis be withdrawn if the
incidence of tuberculosis confirmed by isolation of M. bovis in laboratory tests
. The State Veterinary Administration may revoke this status if


A) the conditions set out in paragraph 2 are no longer met, or

B) post-mortem examinations are detected classic tuberculous
changes or

C) epidemiological investigation is determined by the likelihood of infection or


D) any other reason for that withdrawal is necessary
status with regard to the control of tuberculosis.

In these cases, the State Veterinary Administration starts monitoring and investigation
each herd, which considers that it has
epidemiological link with the herd, whose status is. Status
herd officially tuberculosis remains until removed until they are completed
cleaning and disinfection of buildings and equipment and all animals older than 6 weeks
react negatively to at least two consecutive tuberculin made from
the first being carried out first after 60 days and the other after 4
months and no later than 12 months after removal of the last positive
reagent.

Fourth Based on the information provided to the Commission annually about outbreaks of disease
may be a state or part thereof declared officially tuberculosis,
if they meet the following conditions:

A) annually in six consecutive years
percentage of bovine herds confirmed as infected with tuberculosis is not more than 0.1% of all
herds and 99,9% of bovine herds achieve the status of a herd officially free || | tuberculosis, the calculation of this latter percentage indicator
carried out on 31 December of each calendar year;

B) all bovine animals identified in accordance with the regulations of the European
community;

C) all bovine animals slaughtered are subjected to an official post-mortem examination;

D) respecting the procedures for suspending or withdrawing the status of the herd
officially tuberculosis.

Fifth State or parts thereof retain the status of officially tuberculosis free
if you continue to apply the conditions set out in paragraph 4. However, if
there is evidence of a significant change in the situation as regards tuberculosis in
State or its parts were recognized officially tuberculosis,
Commission may take a decision to suspend or withdraw the said
status until the requirements set out its
decision.

Note: For the purposes of Part I, the term 'bovine animals' means all bovine animals with the exception of animals
involved in cultural or sporting events
.

II.
Brucellosis


First Bovine herd is officially brucellosis-free if

A) There is no more cattle which have been vaccinated against brucellosis, except
females vaccinated less than 3 years ago;

B) all bovine animals is at least the last six months
free from clinical signs of brucellosis;

C) all bovine animals over 12 months in accordance with Annex C
Directive 64/432 / EEC on health problems affecting trading
cattle and swine, as amended by Directive 97/12 / EC (hereinafter
"Directive 64/432 / EEC") have undergone one of the following modes
tested with negative results:

Aa) two serological tests specified in paragraph 10 at intervals of more than 3
months and less than 12 months, or

Bb) 3 tests the milk samples at intervals of three months, followed
least 6 weeks serological test referred to in paragraph 10;

D) all bovine animals entering the herd comes from a herd which has the status
herd officially brucellosis-free and, in the case of bovine animals aged 12 months, was
count lower than 30 IU of agglutination / ml if the agglutination test
serum is conducted in accordance with Annex C to Directive 64/432 / EEC, or have a negative reaction when testing
another test approved by the Commission and carried out during
30 days before or within 30 days after the date of its entry into the herd. In the latter case, the animal
physically isolate (isolate the animal) from the other animals of the herd
such a way as to avoid any direct or indirect contact with
other animals up until testing is (are
examined) with a negative result.

Second Herd of cattle has continued status of a herd officially brucellosis-free if


A) is carried out annually in accordance with Annex C to Directive 64/432 / EEC
one of the testing regimes with negative results:

Aa) three ring-tests carried out at intervals of milk at least 3
months

Bb) 3 ELISAs milk made at intervals of at least 3 months,

Cc) two ring tests carried out with milk at intervals of at least 3 months
followed for at least 6 weeks serological test referred to in paragraph 10,

Dd) 2 ELISAs milk done at intervals of at least 3 months

Followed for at least six weeks serological test referred to in paragraph 10,

Ee) two serological tests carried out at least 3 months and most
12 months. The State Veterinary Administration may, however, unless
state or part of officially brucellosis-free herds but all
are subjected to an official program to combat brucellosis, alter the frequency
routine tests as follows:

- Unless infected more than 1% of bovine herds, just to carry out each year two ring tests
milk or 2 ELISA tests with milk in the interval
least three months, or one serological test

- If at least 99,8% of bovine herds recognized as officially free of brucellosis
for at least four years, the interval between the control testing
extended to two years if all animals are examined older || | 12 months, or - if provádí- investigation herds every year -
may be restricted to animals over 24 months. Verification testing is performed
using one of the serological tests referred to in paragraph 10;

B) all bovine animals entering the herd come from herds that have the status
herd officially brucellosis-free and, in the case of bovine animals aged 12 months, was
count lower than 30 IU of agglutination / ml if the agglutination test
serum is conducted in accordance with Annex C to Directive 64/432 / EEC, or have a negative reaction when testing
another test approved by the Commission and carried out during
30 days before or within 30 days after the date of its entry into the herd. In the latter case, the animal
physically isolate (isolate the animal) from the other animals of the herd
such a way as to avoid any direct or indirect contact with
other animals up until testing is (are
examined) with a negative result. Performing this test may not be required
in the state or its parts, where the percentage of bovine herds infected with brucellosis has not exceeded
for at least the last 2 years and 0.2% in
where the animal comes from a herd officially brucellosis-free
in the state or its part and did not come during transport into contact with cattle
lower status;

C) Notwithstanding subparagraph b) may be cattle from a herd free from brucellosis
assigned to herd officially brucellosis-free if the old
least 18 months, and if it has been vaccinated against brucellosis, the vaccination has been
made more than a year ago. The condition is that these animals have a
30 days prior to their inclusion in the herd a count lower than 30 IU of agglutination
/ ml and a negative result complement fixation or other
test approved by the Commission.

However, if female cattle from brucellosis-free herds thus included in
herd officially brucellosis, a herd shall be regarded as free of brucellosis
after two years from the date on which it was situated in the herd last
vaccinated animal.

Third Suspension or withdrawal of the status of the herd officially brucellosis

3a. Status herd officially brucellosis be suspended if

A) the conditions set out in paragraphs 1 and 2 are no longer met, or

B) on the basis of the results of laboratory tests or on the basis of clinical symptoms
one or more cattle being considered as suspected
brucellosis and the suspect animals have been slaughtered or isolated
such a way as to avoid any direct or indirect contact with other animals
. If the animal was slaughtered and is no longer a
available for the investigation, the suspension may be revoked if it was
2 serum agglutination tests, carried out according to Annex C
Directive 64/432 / EEC on all cattle in a herd older 12 months found
titre lower than 30 IU of agglutination / ml. The first test was performed at least 30 days after
removal of the animal and the second at least 60 days. If the animal has been
isolated from animals in the herd may again be situated in a herd status

Or where the herd has been subjected to control examination, during which all
animals over 12 months with negative results for 2 consecutive
following tests at an interval of 60 days, the first of which does not
sooner than 30 days after removal of the positive animals (positive
animals). In the case of female animals that were pregnant at the time of disease flare
, performs a final check-up examinations at least 21 days after calving

Fourth Bovine herd is brucellosis free if it fulfills the conditions set out in point 1
. b) c) and vaccinated as follows:

A) female cattle were vaccinated

- Before age six months live vaccine strain 19 or

- Before reaching 15 months of age inactive vaccine adjuvant
45/20, has been registered, or

- Other vaccines registered and approved by the Commission;

B) bovine animals younger than 30 months, which has been vaccination with a live vaccine strain 19
and may be the result of agglutination test with sera of higher than 30 IU,
but less than 80 IU of agglutination / ml, with the proviso that in the case of females
vaccinated less than 12 months ago, a complement fixation reaction
result less than 30 EEC units in all other cases, less than 20
EEC units.

Fifth Herd of cattle has continued to herd brucellosis-free status if

A) is subjected to one of the testing regimes listed in point 2.
A)

B) bovine animals entering the herd meets the requirements mentioned in point 2.
B), or coming

- From herds that have the status of brucellosis-free herd and, in the case
cattle aged 12 months, was in the 30 days prior to entry into the herd
or in isolation after being displaced by the examination agglutination test with serum
, carried out in accordance with Annex C to Directive 64/432 / EEC, less than 30 IU of agglutination
/ ml and a negative result complement fixation, or

- From herds that have the status of a herd brucellosis, less than 30 months and
been vaccinated live vaccine strain of 19. Can be the result
agglutination test serum greater than 30 IU but less than 80 IU | || agglutination / ml, with the proviso that in the case of females vaccinated less than 12 months ago
a complement fixation reaction result less than 30
EEC units in all other cases, less than 20 EEC units.

6th Suspension or withdrawal of the status of the herd brucellosis

6a. Status herd brucellosis be suspended if

A) the conditions set out in paragraphs 4 and 5 are no longer fulfilled, or

B) based on the results of laboratory tests or on the basis of clinical symptoms
one or more cattle over 30 months considered
suspected of having brucellosis and the suspect animals have been slaughtered or isolated
such a way as to avoid any direct or indirect
contact with other animals. If the animal has been isolated, it can be re
situated herd and herd brucellosis-free status may be restored
if it subsequently proves agglutination count lower than 30 IU / ml, and if the result
complement fixation test or another
approved by the Commission is negative. If the animal was slaughtered and is no longer a
available for the investigation, the suspension may be revoked if it was

All unvaccinated animals over 12 months had negative results
two consecutive tests at an interval of 60 days, the first test
is not performed earlier than 30 days after removal of the positive animal

7th State or part thereof may be declared officially brucellosis,
if they meet the following conditions:

A) no case of abortion due to brucella infection and no isolation of B. abortus
been recorded for at least three years and at least 99,8% of cattle herds
had the status of a herd officially brucellosis-free for 5 consecutive || | years, the calculation of the percentage indicator is done

A) the conditions set out in point 7. a) and b) are still fulfilled,
reporting cases of abortion suspected of having brucellosis is mandatory and these cases are investigated
regional veterinary administration;

B) annually for the first 5 years after obtaining the status of all bovine animals over 24 months
of at least 20% of herds tested with negative results
under Annex C of Directive 64/432 / EEC, a serological test if | || dairy herds examination of milk samples;

C) all bovine animals suspected of being infected with brucellosis is reported
regional veterinary administration and is subject to epidemiological investigation
comprising at least two serological blood tests, including the response
complement fixation and a microbiological examination of appropriate samples;

D) during the period of suspicion, which lasts until the negative results
tests referred to in subparagraph c) suspending the status of a herd officially free of brucellosis
as in the case of the herd of origin or transit herds suspected bovine animal
and in case epidemiologically linked herds;

E) in the event of an outbreak of brucellosis that has spread, all bovine animals is
defeated. Animals of the remaining susceptible species will undergo appropriate tests
buildings and equipment are cleaned and disinfected.

9th State or part thereof recognized officially free of brucellosis
reported incidence of all cases of brucellosis to the Commission. But if there is evidence of a significant change
situation as regards brucellosis in the state or its parts that were
recognized officially brucellosis, the Commission may adopt a decision
to suspend or revoke that status until where
requirements set out in its decision.

10th For the purposes of Part II of the serological test means agglutination test
serum test buffered Brucella antigen fixation

Note: For the purposes of Part II, the term 'bovine animals' means all bovine animals with

Exception of males for fattening provided that they come from herds officially free of brucellosis

III.

Enzootic bovine

A. Bovine herd is officially free of enzootic bovine if it
at

A) in the last two years, there has been no case of enzootic bovine leukosis
, and clinical or laboratory examinations, and
no such case has been confirmed, and

B) in the last 12 months, all animals over 24 months
tested with negative results, two tests, carried out in accordance with Annex D
Chapter II of Directive 64/432 / EEC (tests in the investigation of enzootic
leucosis in cattle), or

C) the requirements referred to in subparagraph a), and the herd is in
State or parts thereof which are officially free of enzootic bovine
.

B. Herd still has the status of a herd officially free of enzootic bovine
if

A) are continuously met the conditions set out in Part A. a)

B) any animals into the herd comes from a herd officially free of enzootic bovine
,

C) all animals over 24 months continue to have a negative
examinations carried out in accordance with Annex D of Chapter II of Directive 64/432 / EEC
at intervals of 3 years

D) breeding animals introduced into a herd, originating from a third country,
imported under the conditions set by Decree no. 382/2003 Coll., On
veterinary requirements for trade in animals and animal health conditions for their
imports from third countries.

C. Status herd officially free of enzootic bovine pauses
not fulfilling the conditions set out in Part B, or if
Based on the results of laboratory tests and clinical findings are
one or more cattle suspected of being infected with enzootic bovine
and suspect animals are slaughtered immediately.

D. Status herd officially free of enzootic bovine
remain suspended until such time as the following requirements are met:

First If one animal in a herd officially free of enzootic bovine

for any other reason,

A) move the animal, which reacted positively, and in the case of cows

serological tests (at least 4
months and no more than 12 months), carried out in accordance with Annex D
Chapter II of Directive 64/432 / EEC for at least three months after removal

epidemiologically linked with the infected herd are

The Regional Veterinary Administration may grant an exemption from the obligation

12 months in accordance with Annex D of Chapter II of Directive 64/432

Regional Veterinary Administration may allow animals to be moved
directly for slaughter under official veterinary supervision;

F. State or part thereof retains status officially free of enzootic bovine
if

A) all animals slaughtered within the territory of the State or its parts are subjected to a post mortem examination
at which all tumors which
could be caused by a virus enzootic bovine
are sent for laboratory examination, | ||
B) all cases of enzootic bovine are reported to the Commission

C) all animals which react positively to any examination of
tests listed in Annex D, Chapter II of Directive 64/432 / EEC,
slaughtered and the herds from which they originate, remain subject to restrictions until | || renewal of their status in accordance with part D, and

D) all animals older than two years are one of the first 5 years after
granting the status of the investigation in accordance with Annex D
Chapter II of Directive 64/432 / EEC, or at the same time, by any other method proving
99% reliability that has infected less than 0.2%
herds. Unless during at least five years, no cases of enzootic bovine
in the state or its parts at a ratio of one herd
10000, the Commission may decide that routine serological tests may be limited
provided that all bovine animals over 12 months in at least 1%
herds, selected at random each year, will be subjected to a test carried
in accordance with Annex D Chapter II of Directive 64/432 / EEC.

G. Status of state or part of an officially free of enzootic bovine
may be suspended by the Commission if the inquiry carried out in accordance with point
F reveals significant changes in the situation as regards enzootic bovine
in the state or its parts, which were recognized as officially free of enzootic bovine
. Status State or a part
officially free of enzootic bovine Commission may be restored when
met the criteria laid down by the same procedure. ".

Farm sheep or goats, State or part
officially free or free of brucellosis (B. melitensis)
Chapter 1


I. Ovine and caprine, state, or region officially free of brucellosis
(B. Melitensis)

A. Ovine or caprine officially brucellosis (B. melitensis)
(hereinafter referred to as "free") means

First economy in which

A) all the animals susceptible to brucellosis for at least 12 months
free from clinical or any other signs of brucellosis

B) no sheep or goat, which has been vaccinated against brucellosis, except
vaccinated at least two years before a vaccine Rev.1
or any other vaccine approved and registered by the Commission

C) all sheep and goats from farms that were at the time of examination
older than 6 months, tested with negative results, two tests
carried out every 6 months or more in accordance with Annex C.

Directive 91/68 / EEC on animal health conditions governing
trading sheep and goats within the Community (hereinafter "Directive
91/68 / EEC")

D) after the tests referred to in subparagraph c) are only sheep or goats born
in the economy, or those which come from an officially
brucellosis-free or brucellosis under the conditions set out in Section D
and in which the continued fulfillment of the requirements laid down in point B;

Second economy, which is located in a country or region that were
recognized officially brucellosis-free in accordance with Part II.

B.

First The farms sheep or goats officially brucellosis, which
not located in the territory officially free of brucellosis and where the
for recognition as officially free of brucellosis carried
intake of animals in accordance with the requirements of point D shall be examined
annually representative of sheep and goats over 6 months. The holding may retain status
economy officially brucellosis-free if the test results are negative

more than 99% of sheep or goats officially brucellosis can be

conducted once every three years provided that the economy, which
not officially brucellosis free are placed under official supervision or subject
eradication program.

C.

First If a holding sheep or goats officially free of brucellosis

A) one or more ovine or caprine animals are suspected of having brucellosis, the State Veterinary Administration
withdraw this economy status officially free of brucellosis

animals are immediately killed or isolated pending official confirmation
disease or an official rule out the suspicion of that disease;

B) confirmed brucellosis may be a provisional suspension
State Veterinary Administration lifted only if all the infected animals
or all the animals of species susceptible to infection are slaughtered and
if two tests carried out at intervals of 3 or more months in accordance with
Annex C of Directive 91/68 / EEC on all the animals of the holding over six months
are negative.

Second If the holding referred to in paragraph 1 is situated in an area
which is officially free of brucellosis, inform the State Veterinary Administration
immediately to the Commission and other Member States. The State Veterinary Administration
:

A) is to defeat all the infected animals and all animals of species susceptible to infection
of the economy and permanently
inform the Commission and other Member States of the situation;

B) carry out an epidemiological investigation.
Herds linked epidemiologically to the infected herd are subjected to the tests referred to in paragraph 1.
B).

Third If the outbreak referred to in paragraph 2 is confirmed, the Commission, after having assessed the circumstances
new outbreak of brucellosis be accepted unless it

Bb) have never been vaccinated against brucellosis, or - if they have been vaccinated
- such vaccination performed before more than two years ago.
Females older than 2 years of age who were vaccinated before the age of 7 months, but may be
into the economy also accepted;

C) they were isolated in the holding of origin under the supervision of an official

Veterinarian and, during such isolation underwent, with negative results 2
tests carried out at intervals of at least six weeks in accordance with
Annex C of Directive 91/68 / EEC.

II. State or region officially free of brucellosis

E. State or region may be recognized officially brucellosis, if


A) at least 99,8% of sheep or goats in the country or region is
officially brucellosis, or state or region meets the following conditions
:

Aa) ovine or caprine brucellosis is a disease whose incidence is compulsorily reported
for at least 5 years

Bb) for at least 5 years has been confirmed officially no case of brucellosis
sheep or goats

Cc) for at least 3 years of age is prohibited vaccination against brucellosis;

B) in the state or region to meet the conditions laid down in paragraph a) and

Aa) in the first year after recognition of a state or region brucellosis
proved spot-checks carried out on the farm or at the slaughterhouse
with 99% confidence that had been contaminated with less than 0.2% of the economy, or || | at least 10% of sheep and goats over six months underwent, with negative results
test conducted in accordance with Annex C of Directive 91/68 / EEC;

Bb) annually from the second year following recognition of a state or region free from brucellosis
proved spot-checks carried out on the farm or at the slaughterhouse
with 95% confidence that had been contaminated with less than 0.2%
economy or at least 5% of sheep and goats over six months
undergone with negative results a test conducted in accordance with Annex C
Directive 91/68 / EEC;

C) the continued fulfillment of the conditions required for recognition as officially free of brucellosis
.
Chapter 2


Ovine or caprine brucellosis

A. Ovine or caprine holding is considered to be brucellosis-free if


First It

A) all the animals susceptible to brucellosis for at least 12 months
no clinical or other signs of brucellosis; b) all or some
sheep or goats vaccinated with Rev. 1 vaccine or any other vaccine
registered and approved by the Commission.
Vaccinated animals are vaccinated before the age of seven months;

C) all vaccinated sheep and goats from the farm at the time of examination
over 18 months tested with negative results, two tests carried
every 6 months or more in accordance with Annex C
Directive 91 / 68 / EEC;

D) all unvaccinated sheep and goats from the farm at the time of examination
older than 6 months tested with negative results, two tests carried out in
interval of 6 months or more in accordance with Annex C of Directive 91/68 / EEC ;

E) after the tests referred to in points c) or d)
only sheep and goats born on the farm or those that come from farms
brucellosis under the terms of point D;

Second the continued fulfillment of the requirements set out in Section B.

B. In any economy annually investigates
representative number of the ovine and caprine holding may retain its status of economy
brucellosis-free only if the test results are negative.
Representative number of animals to be examined for each
economy consists of:

A) of all non-castrated males over 6 months who were vaccinated
,

B) of all non-castrated male animals over 18 months old who were vaccinated
,

C) all animals which have been introduced into the holding since the previous
testing

D) 25% of females that have reached reproductive age (ie. Sexually
adult) or which are in lactation, and in the number of at least 50 per

C.

First Ovine and caprine withdraw the status of the economy
brucellosis-free if there is one or more sheep or goats

when animals are killed without delay or isolated pending
official confirmation of the disease or an official exclusion

Second If brucellosis is confirmed, the provisional suspension may be

vaccinated animals over 18 months of age and all non-vaccinated animals over six months
in both cases with negative results.

D. Sheep or goats may be accepted into an ovine or caprine brucellosis
if

First They come from farms free or officially brucellosis-free, or


Second they come from a different economy than specified in subparagraph a) and

A) they are individually marked in accordance with regulations of the European
Community

B) come from a holding in which for at least 12 months
all the animals of species susceptible to brucellosis show
clinical or other signs of infection,

C) were observed during the past 2 years vaccinated, were kept in isolation in
holding of origin under official veterinary supervision and
during this period, with negative results underwent two tests carried out in
interval of at least 6 weeks in accordance with Annex C of Directive 91/68 / EEC, or were
before the age of seven months and not less than 15 days before entering the holding
determine vaccinated with Rev. 1
or any other vaccine registered and approved by the Commission.

E. Ovine or caprine brucellosis can be recognized as
economy officially free of brucellosis for at least a two-year period, if


A) it held no animal which has been vaccinated against brucellosis in
during the previous two years at least,

B) the conditions set out in Section D, paragraph 2 are met throughout that
period

C) at the end of the second year was a test carried out on all animals aged 6
months in accordance with Annex C of Directive 91/68 / EEC, in all cases
negative. ".

Art. II

This Decree shall take effect on the first day of the second month following
after the date of publication.
