Ministry of Foreign Affairs says that the 17 November. January 1995 was in
Prague signed an agreement between the Czech Republic and the Republic of Poland on
the small border traffic.
With the Treaty, its assent, Parliament of the Czech Republic and the President of the
the Republic has ratified it. The instruments of ratification were exchanged in Warsaw
on 19 December. February 1996.
The contract on the basis of article 12, paragraph 1. 1 entered into force on
February 19, 1996. That date longer valid in relations between the Czech
Republic and the Republic of Poland:
-The Convention between the Czechoslovak Republic and the Polish people's Republic on the
border traffic of 4 February. July 1959, under the famous No. 99/1960
Coll., and
-Protocol for the implementation of the Convention between the Czechoslovak Republic and Polish
Republic of Algeria on the border traffic of 4 February. July 1959
signed on 24. May 1985. The Czech version of the Treaty shall be designated
at the same time.
CONTRACT
between the Czech Republic and the Republic of Poland on small border traffic
Czech Republic and the Republic of Poland (hereinafter referred to as "the Contracting Parties"),
-Desiring to facilitate mutual contacts between the inhabitants of the border
areas,
-aiming for a further deepening of the friendship between the peoples of both States,
-having regard to the development of mutual cooperation in the border
areas,
have agreed as follows:
Article 1
(1) the Contracting Parties agree, facilitating the crossing of the Czech-Polish
national borders to citizens of both Contracting States residing in the
bands 0006 on the principles laid down in this
the Treaty.
(2) citizens residing within the meaning of paragraph 1 shall be treated as
people logged on in the municipalities of bandwidth permanent 0006
or temporary residence permit.
Article 2
(1) in zone 0006 under this contract shall be deemed to
the territory lying on both sides of the common border, each with a width
15 kilometers. It crosses a small border zone thus established

(4) the inclusion of communities that are located in the zone of a small border

through the exchange of notes between the Governments of the Contracting Parties.
Article 3
(1) Crossing the common border within the framework of the small border
contact takes place at border crossing points intended for passenger transport and the
the crossing points are open exclusively for small border traffic.
(2) a list of the transitions are exclusively intended for small border traffic, as well as
the scope of their operation contains the Appendix No. 2.

Article 4
(1) to the crossing of State borders within 0006,

1. identity cards or passports of citizens of both Contracting Parties,
2. travel of the annex issued with a validity of up to five years by the competent authorities

3. school certificates issued in accordance with national legislation,
The Republic of Poland, together with lists of participants organized namespaces
school groups certified by the competent authority of the municipalities belonging to the zone
0006.
(2) children who are not in possession of any of the documents referred to in
paragraph 1, points 1 and 2, may exceed the State boundaries and stay in the
0006 zone of the other party in the company of
one of the parents or other legal representative, if they are written to the
their identity card or passport, in accordance with the
national legislation.
(3) children involved in organized school groups can
cross national boundaries and stay in the zone 0006
the other Contracting Party on the basis of the documents referred to in paragraph 1, point 3
exclusively under the supervision of a teacher or an adult educator, which is
the holder of the document referred to in paragraph 1, point 1.
(4) if the documents referred to in paragraph 1, does not imply that their holder
is logged on to stay in the band 0006,

(5) the competent authorities of the two Contracting Parties shall exchange documents patterns

(6) the provisions of paragraph 1 may be amended by mutual agreement
through the exchange of notes between the Governments of the Contracting Parties.
Article 5

Article 6
This agreement shall not affect the right of Contracting Parties to prohibit entry into its
territory or shorten the stay there to citizens of the other party.
Article 7
(1) import and export of goods by persons who cross national borders in
the small frontier traffic, are governed by the provisions of this Treaty and the
the national legislation of each Contracting Party.
(2) the import and export of goods to trade, is not within the
0006 allowed.
(3) the persons crossing the State border within 0006
may, without authorization, customs duties, taxes and other charges, import and export:
1. stuff to personal use and consumption on the trip and stay
2. means of transport for private use, registered on the territory of the other
the Contracting Parties shall, in accordance with national legislation, with the condition
their re-exportation.

Article 8

the Contracting Parties may, without authorization, customs duties, taxes and other fees through
the State border on the basis of proof of ownership and an area of
the following holdings:
1. agricultural, stock-farming, bee-keeping, horticultural and forestry products
coming from such a holding, with exemption from customs duties, taxes and
other charges only applies to unprocessed products or products,
which have undergone initial processing after harvest and shall continue to be
raw,
2. the seeds, fertilizers, and goods intended for tillage, growing plants
and treatment of the animals,
3. draught animals with the necessary supply of animal feed, utensils, agricultural and
forestry techniques, as well as means of transport intended for the cultivation of these
economy with the condition of their re-exportation.
(2) reverse the return can be provided in the context of a small border
contact without permission, duties, taxes and other charges, transfer across the State
the boundaries of the farm animals to pasture, power, or swimming. This

Article 9
(1) in urgent cases, with regard to the immediate threat to life,
health or property, shall be allowed to rescue sections or persons
providing assistance, as well as persons with disabilities exceed State
the border on the way there and back, at any point in order to provide
or receive assistance.
(2) persons who have crossed the State border referred to in paragraph 1, they shall
prove their identity, on request, to the competent authorities of the other Contracting
party.
(3) the means of transport and rescue equipment, including spare parts,
transported across state lines for the purpose specified in paragraph 1, are
exempt from customs duties, taxes and other charges for their conditions of reverse
export.
Article 10
(1) each Contracting Party may temporarily suspend or restrict the
implementation of the provisions of this Treaty to all or some of the sections of the
common border due to a safety hazard or
public policy or because of natural disaster or
sanitary-epidemiological risk.
(2) a Contracting Party which intends to suspend or resume the implementation of the
the provisions of this Treaty for the reasons referred to in paragraph 1 shall inform the
the other Contracting Party through diplomatic channels, no later than 24 hours prior to
the scheduled suspension or renewal.
Article 11
The provisions of this Treaty shall not apply to the persons referred to in article 1 (1).

Article 12
(1) this Treaty is subject to ratification and shall enter into force on the date of the exchange of
instruments of ratification, which will take place in Warsaw.
(2) the date of entry into force of this Treaty shall cease to be in relations between
the Contracting Parties of the validity of the Convention between the Czechoslovak Republic and

Article 13
This agreement is concluded for an indefinite period. Each of the Contracting Parties, it
may terminate. In this case, ceases to be valid after the expiration of six
months from the date of receipt of the diplomatic notes informing about her testimony.
