DECREE
of 13 October. January 2010,
amending Decree No. 197/2004 Coll., for the implementation of Act No 99/2004
Coll., on fish farming, the performance of the fishing rights, Fisheries Guard, protection
marine fishery resources and on amendments to certain acts (the Act on
the fishing industry), as amended by Decree No 239/2006 Sb.
The Ministry of agriculture lays down, pursuant to section 32 of Act No 99/2004 Coll., on
fish farming, the performance of the fishing rights, Fisheries Guard, protection
marine fishery resources and on amendments to certain acts (the Act on
the fishing industry):
Article. (I)
Decree No. 197/2004 Coll., for the implementation of Act No 99/2004 Coll., on
fish farming, the performance of the fishing rights, Fisheries Guard, protection
marine fishery resources and on amendments to certain acts (the Act on
the fishing industry), as amended by Decree No 239/2006, is amended as follows:
1. section 2 including title and footnotes # 1a, 1b and 1 c is inserted:
"§ 2
Keeping of the record on the management in the fishing industry
[To section 3, paragraph 5 (b)) law]
(1) Evidence of farming and an indication of the economic result for the
farming and fishing or for the production of aquatic organisms in the pond and in the

electronic form certified advanced electronic signature, or
through a data box to the appropriate fishing authority.

2. in article 3, paragraph 2 shall be deleted.
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
3. section 8 including the title reads as follows:
"section 8
Record keeping and management of profit or loss in
the fishing-grounds
[To section 11 para. 10 (b), (d)) of the Act]
Evidence of farming and an indication of the economic result in the fisheries
district lies in the leadership of the entries listed in annex 5. These data are
be submitted in written or electronic form certified guaranteed
electronic signature, or through a data box
to the competent authority accompanied by the fishing on the identification of the user
the fishing-grounds, according to annex No 1 and table. ".
4. In article 9, paragraph 2, the following paragraph 3 is added:
"(3) exceptions to the prohibitions referred to in section 13 of the hunting of the paragraph. 2 (a). (c)) of the Act
may be granted for a maximum of 2 years from the date of the decision of the

Paragraphs 3 and 4 shall become paragraphs 4 and 5.
5. In article 11 (1) 2 (a). r) the number "45" is replaced by "50".
6. In article 11, the dot at the end of paragraph 3 is replaced by a comma and the following
the letter o) is added:
"o) eel (Anguilla anguilla) 50 cm.".

The effectiveness of the
This Decree shall take effect on the date of its publication, with the exception of
the provisions of article. I, points 6 and 7, which will become effective on 1 January 2004. January
2011.
