The DECREE



of 12 June. in May 2005,



amending the Decree of the Ministry of transport no. 101/1995 Coll., which

issued regulations for the health and the competence of persons in operation

railways and rail transport, as amended by Decree No. 455/2000 Sb.



The Ministry of transport, in agreement with the Ministry of health and

The Ministry of the Interior shall establish under section 66 paragraph. 1, 2 and 3 of the law No.

266/1994 Coll., on rail, as amended:



Article. (I)



Decree No. 101/1995 Coll., issuing regulations for health and professional

eligibility in the operation of railways and railway transport, as amended by

Decree No. 455/2000 is amended as follows:



1. section 9, including footnotes, no. 10, 11, 12 and 13 is:



"section 9



(1) the conditions for the education and competence of persons to control electric

the propulsion of the vehicle on the national, regional and on the track to a siding

are



and secondary education), with GCSE ^ 10),



(b)) the competence in electrical engineering with an "educated person",



(c) completion of the teaching of professional theoretical) knowledge according to the content

e) driving training in the management and use of motor vehicle driving under the

supervision for at least 24 weeks



(f) professional examination) of the theoretical and practical knowledge from

the trial by the Commission.



(4) the conditions for the education and competence of persons to control a motor

the propulsion of the vehicle only on siding are

(f) professional practice) repair and maintenance of steam locomotives, training

in the repair shop for steam locomotives, focused on knowledge of the design and

maintenance and training for the implementation of the technical inspection of towed

rail vehicles of at least 20 weeks,



(g)) driving training in the management and servicing of the steam traction unit under the supervision of the

at least 24 weeks



h) test of professional theoretical and practical knowledge from

the trial by the Commission.



(6) the conditions for the education and competence of persons to control special

the propulsion of the vehicle on the national, regional and on the track to a siding

2. In section 10, paragraph 1. 1, letter a) is added:

the words "test by the Commission".

6. In section 10, the following paragraph 3 is added:



"(3) the conditions for the education and competence of persons to control

electric vehicle on special track only for handling

drive in the depot are



and secondary education) with re-training ^ 11) machinery, electrical,

the construction or transportation or secondary education with graduation

test ^ 10),



(b)) the competence in electrical engineering with an "educated person",



(c) completion of the teaching of professional theoretical) knowledge according to the content

19. In article 15, paragraph 1, the following paragraph 2 is added:



"(2) the competence to conduct the cableway is according to § 13 shows

Paragraphs 2 and 3 shall become paragraphs 3 and 4.



20. section 16:

(management) cableway installations under the supervision of at least one week. ".



21. under section 16 shall be inserted a new section 16a is inserted:



"§ 16a



(1) for the management of the same type traction unit in addition to sidings on the runway

regional and national competence is demonstrated differential

examination before the examining Board, and of the knowledge of the rules for the

the operation of railways, and the operation of rail transport and the conditions for the construction

and operability.



(2) the execution of the test condition for the differential is

22. § 17, including footnotes, no 16, 16a and 16b:



"§ 17



(1) the achievement of the professional competence of persons to carry out the revision or

inspections and tests of the relevant designated technical devices ^ 16)

the operation requires:



and secondary education), with GCSE ^ 10) or higher

Education ^ 16a), electrical machinery, construction or transport

focus,



(b)) professional experience in design, construction, manufacture, installation, operation,

or repairs of technical equipment intended

e) competence in electrical engineering with qualifications



1. "person educated" person professionally qualified to carry out the revision or

inspections and tests of pressure equipment, gas equipment, lifting

equipment, transport equipment, containers and swap bodies,

welding and non-destructive testing,



2. "persons" to a person professionally qualified to carry out the revision or

inspection and testing of electrical equipment.



(2) the competence of a person professionally qualified to carry out the revision or

inspections and tests of the respective specified equipment,

proven test referred to in paragraph 1 (b). (d)), it must be every five years

verified the content of the examination before the Commission appointed from the railway administration

by the authority. The content of the test, verify, in particular, knowledge of the changes

related legislation and technical standards.



(3) for the extension of the scope of the permission of the person professionally qualified to carry out

revision or inspection and testing of the relevant designated technical

device to another designated technical devices or other activity is carried out

additional test before the Commission appointed railway administrative authority.

An additional test shall be verified in particular knowledge of related laws

regulations and technical standards relating to the extension of the scope of the permission.



(4) the attainment of professional competence for the activities specified in the testing

23. § 18 paragraph 1 reads:



"(1) the examination shall consist of at least a trial before the Commission with

that at least one member of the Commission must be a holder of a certificate of eligibility to the
the management of the species concerned or the type of overhead of the vehicle, if it is a test of

the management overhead of the vehicle, or be the holder of a certificate of professional

competence to carry out inspections, inspections and tests of the competent

the specified technical equipment, if it is a test of the person competent

to carry out the revision or inspection and testing of the relevant specified

technical equipment. The railway administrative office shall be appointed by the Commission and the trial

24. In section 18, paragraph. 2 letter b) including footnote No. 16 c:



"(b)) that has not been sentenced for the crime of

37. in annex 5, part A, the words "Review of techniques" shall be replaced by the words

"Person professionally qualified to carry out the revision or inspection and tests

the relevant designated technical devices. "



38. in annex 5, part A, section I.:

39. in annex 5, part B shall be deleted.



Article II



Transitional provisions



(1) a person with a valid certificate for the management of the relevant type

overhead vehicle issued before the effect of this order is a person professionally

eligible for the management of the species concerned in the overhead traction unit,

which belongs to the type of overhead vehicle.



(2) the certificate of professional competence for audit techniques, applicable to

the effective date of this Ordinance, shall continue to be valid for 5 years from the date of

the implementation of the last test. Revision technicians with a valid certificate

professional competence are professionally qualified to carry out the revision of the intended

technical equipment in the range specified in the certificate.



(3) a person with a valid certificate of professional competence to activities

the inspector issued before the effect of this order is a person professionally

eligible for revisions, inspections and tests specified in the technical

equipment referred to in this order to the extent provided for in the relevant

the certificate.



(4) a person with a valid certificate of professional competence to the activities of the expert

issued before the effect of this order is a person professionally qualified for

activities for the testing of specified technical equipment of pressure according to the

international treaties in the range specified in the certificate.



(5) the Railway administrative office within 5 years of the effectiveness of this Ordinance will replace the

cooperation with holders of existing certificates, if they do not contain

all of the information referred to in section 20 (2). 2 Decree, for new licences

eligibility.



Article. (III)



This Decree shall take effect on 1 January 2005. July 2005.
