of 18 May. in July 2006,



amending certain decrees in the field of veterinary care

The Ministry of agriculture lays down pursuant to § 78 of Act No. 167/1999 Coll., on the

veterinary care and amending certain related laws (health

Act), as amended by Act No. 131/2003 Coll., Act No. 316/2004 Coll. and

Act No. 48/2006 Coll. (hereinafter the "Act"), for the implementation of § 31 para. 3

(a). a) and b), § 33 para. 6 (a). (b)), and (c)) and § 37 para. 5 (b). and)

the law:



PART THE FIRST



Amendment of the Decree on the prohibition of certain substances administered to animals, the

products are intended for human consumption, and about monitoring (monitoring)

the presence of illicit substances, residues and contaminants, substances, for

which animal products could be harmful to the health of humans, animals

and in their products



Article. (I)



Decree No 291/2003 Coll., on the prohibition of the feeding to animals of certain substances,

whose products are intended for human consumption, and about monitoring (monitoring)

the presence of illicit substances, residues and contaminants, substances, for

which animal products could be harmful to the health of humans, animals

and in their products, as amended by Decree No. 232/2005 Coll., is amended

as follows:



1. in section 17(2). 2 (a). a), the words "and the group" shall be replaced by

"groups A and B 2 (b). (d)) ".



2. in section 17(2). 2 (a). (b)), the words "B 2" is replaced by "B 2 (a).

a), b), c), (e) and (f))) ".



3. in section 24 para. 1, the third sentence is replaced by the phrase "If the checks

demonstrate the presence of unauthorised substances or products or the

the prescribed limits shall act authorities in charge of border veterinary

inspection provided for in articles 19 to 22 of regulation of the European Parliament and of the Council

(EC) No 882/2004 of 29 April 2004. April 2004 on official controls performed to ensure

PART TWO



Amendment of the Decree concerning veterinary checks applicable in trade with

animal products



Article II



Decree No 373/2003 Coll., concerning veterinary checks applicable in trade with

animal products, as amended by Decree No 164/2005 is amended as follows:



1. in footnote 1 at the end of the following sentence "Directive

European Parliament and Council Directive 2004/41/EC of 21 June 1999. April 2004, which

shall be repealed certain directives concerning food hygiene and health

the conditions of production of certain products of animal origin intended for

human consumption and their placing on the market and repealing Directive

89/662/EEC and 92/118/EEC and Council decision 95/408/EC ".



2. In annex 3, part A is inserted:

1. Act No. 167/1999 Coll., on health care and on amendments to certain

poultry meat, rabbit meat, farmed game meat and meat of

wild game, as amended, Decree No. 202/2003 Coll.

animal health requirements for fresh meat, minced meat, meat preparations

PART THREE



Change the decree implementing certain provisions of Act No.

166/1999 Coll. on veterinary care and amending certain related

laws (health law), as amended, and the

animal health requirements for animal products



Article. (III)



In § 13 para. 1 of Decree No 375/2003 Coll., which implements certain

the provisions of the Act No. 168/1999 Coll. on veterinary care and amending

certain related laws (health law), as amended

regulations, and on animal health requirements for animal products, the word

"control" is deleted.



PART FOUR



Amendment of the Decree on veterinary checks of imports and transit of products from

third countries



Article IV



Decree No. 377/2003 Coll. on veterinary checks of imports and transit

products from third countries, as amended by Decree No. 259/2005 Coll., is amended

as follows:



1. in footnote 1, the words "Directive 95/53/EC of 25 March 2002.

2. in article 2 letter a) including the footnotes # 1 c and 1 d:

3. In article 5, paragraph 4 shall be deleted.



4. In article 24, paragraph 4 shall be deleted.



5. § 25 para. 1 (b). (b)), the words "§ 36 odst. 2 "shall be replaced by the words" §

paragraph 36. 2 to 6 ".



6. in annex No 4, part A, point (a). f), the words "can be" shall be replaced by

the words "may be", and the words "can be" shall be replaced by the words "cannot be".



7. in annex No. 8, part B, point 4, subparagraph 2 shall be replaced by the number "374"

"394".



8. in annex No. 8, part B, point 4, subparagraph 3, "according to an official"

replaced by the words "for the official".



PART FIVE



Amendment of the Decree on animal health requirements for trade in

animal products, not covered by specific legislation,

and the animal health conditions of their importation from third countries



Article. In



Decree No. 379/2003 Coll., on animal health requirements for trade in

animal products, not covered by specific legislation,

and the animal health conditions of their imports from third countries, is amended

as follows:



1. in footnote 1 at the end of the following sentence "Directive

European Parliament and Council Directive 2004/41/EC of 21 June 1999. April 2004, which

shall be repealed certain directives concerning food hygiene and health

the conditions of production of certain products of animal origin intended for

human consumption and their placing on the market and repealing Directive

2. in paragraph 4 of the introductory part of the provision, the words "in annexes 1 and 2"

replaced by the words "annex 1".



3. In paragraph 4 (b). and) the words "in annexes 1 and 2" shall be replaced by the words "in

Annex No 1 ".



4. in § 5 para. 1, the words "or 2" shall be deleted.



5. in the introductory part of the provisions of paragraph 10, the words "in annexes 1 and 2"

replaced by the words "annex 1".



6. in paragraph 10 (a). and) the words "in annexes 1 and 2" shall be replaced by the words "in

Annex No 1 ".



7. in paragraph 10 (a). (b)), the words "unless it is in annex 2 to this Decree

otherwise stated, "shall be deleted.



8. In § 13 para. 1, the words "in annexes 1 and 2" shall be replaced by the words "in

Annex No 1 ".



9. Annex 2 shall be deleted.
