DECREE
of 26 March. in May 2004,
laying down the detailed conditions of the certificate of professional competence for
the area of the assessment of the effects on public health, to their verification
and the procedure for granting and withdrawing certificates
The Ministry of health, in agreement with the Ministry of the environment
determined in accordance with § 19 para. 13 of the Act No 100/2001 Coll. on environmental impact assessment
to the environment and amending certain related laws (the law on the
assessment of the effects on the environment), as amended by Act No. 93/2004 Coll.
(hereinafter referred to as the "Act"):
§ 1
The condition of professional competence for the area of the assessment of the effects on public
health
(1) a certificate of professional competence for the area of environmental impact assessment
public health (hereinafter referred to as "certificates") grants the Ministry of health
(hereinafter referred to as "the Ministry") a natural person who holds a certificate of
authorization to assess health risks, according to a special legal
Regulation ^ 1) or meets these requirements
and higher education) has in the field of medicine or science,
or has a college education, another direction and postgraduate
education in health care or Toxicology,
(b)) has at least 3 years of experience in assessment of the effects on public health
(hereinafter referred to as "the practice") and
c) graduated from the examination of professional competence or differential test
pursuant to section 3 of this order.
(2) For the purposes of this Ordinance, be deemed for at least three years work experience
working activity whose scope was the assessment of the individual components
and an assessment of their effects on the environment and public
health. This practice is evidenced by the confirmation of employers about the work
contents of the applicant, or by affidavit of the employee on top of
practice. The person doing business presents an overview of its activities in the
the evaluation of the effects on public health and a list of logs on the
Reviews for the previous calendar year. By the time the practice referred to in paragraph 1 shall
time does not count basic (alternative) military service and civilian service
held in its place, the period of maternity and parental leave.

Verification of professional competence for the area of the assessment of the effects on public
health
§ 2
(1) the competence for the area of the assessment of the effects on public health
(hereinafter referred to as "competence") shall be checked by the test of professional
competence (hereinafter referred to as "test"), and on the basis of a written application
submitted to the Ministry in which the applicant shall indicate the name or names and
last name, title, date of birth, home address, education level
including the scope of study and specialization, formal academic titles, length, and
the contents of the professional practice.
(2) on the application by the applicant attaches
extract from the register) the criminal record, or similar document referred to in
paragraph 3, not older than 3 months,
(b)) a certified copy of evidence of higher education pursuant to § 1
paragraph. 1 (b). and)
(c) the proof of execution) of professional experience according to section 1 (1). 2,

environment,
e) an affidavit by the applicant that in specific cases, an assessment of the
the impact on public health, when he could have securities or personal interest to
the present case, it rejects the case and shall notify the authorized

(3) a natural person of integrity is illustrated by the excerpt from the criminal record
where appropriate, the documents issued by the States, which, for the last 3 years
resided continuously for more than 3 months.
§ 3
(1) the competence of the Ministry verifies. Register of holders of
certificate of professional competence (hereinafter referred to as "certificate holder") and
Register of revoked certificates leading Ministry and exposes them in

(2) the range and scope of tests, exams, examination rules and other

the certificate.
(5) an applicant who is the test or to repeat the tests could not

rehearsed only on the basis of a new application for a certificate.
(6) the recognition of professional qualifications or similar competence, which
nationals of the Member States have obtained in another Member State

§ 4
The procedure for granting a certificate of professional competence for the area
assessment of the effects on public health
(1) the holder of a certificate of authorization to the evaluation of health risks by

(5) a certificate is non-transferable to another person, is granted for a period of 5 years
from the date of grant. The certificate shall, in the event that the conditions for
which has been granted, extended for another 5 years. The request for extension

§ 5
How to remove the certificate of professional competence for the area
assessment of the effects on public health
In cases where the Ministry determines that
and) the holder has been deprived of legal capacity or his
the eligibility of legal capacity has been restricted,
(b)) the holder was finally convicted for an intentional criminal act committed in
connection with the performance of professional activities,
(c) the holder of the certificate has been granted) on the basis of intentionally given
incorrect or incomplete information contained in the application or its
the annexes, or
(d)) the holder of a seriously or repeatedly violates the obligations in the performance of professional
activities, especially in the detection of defects or distortion of the environmental impact assessment
on public health,
the certificate shall be withdrawn.
§ 6
The effectiveness of the
This Decree shall take effect on the date of its publication.
