164/2005 Coll. DECREE of 18 April 2005 amending Decree No. 361/2003 Coll., On veterinary checks in trade in animals, and Decree No. 373/2003 Coll., On veterinary checks in trade in animal products, the Ministry of Agriculture determined by section 78 of the Act No. 167/1999 Coll., on the veterinary care and amending certain related laws (the Veterinary Act), as amended by Act No. 131/2003 Coll. and Act No. 316/2004 Coll. (hereinafter the "Act") to implement section 28 para. 5 and § 31 para. 3 of a point. (b)), and (c)) of the Act: PART ONE Amendments to the Decree on veterinary checks when dealing with animals Article and Decree No. 372/2003 Coll., on veterinary checks in trade in animals, is amended as follows: 1. In section 1 para. 1 point. and after the word) "trade" after the words "with the Member States of the European Union (hereinafter referred to it as" trafficking ")" is deleted. 2. In section 1 para. 1 point. (d)), the words "animals" are replaced by "live animals, the germinal products and pathogens (hereinafter referred to as" that animals and products ") intended." 3. Decree no 382/2003 Coll., On veterinary requirements for trade in animals and on the veterinary conditions for their import from third countries which are transposed, in particular: Council Directive 64/432/EEC of 26 June 1964 on health problems affecting trade in bovine animals and swine, Council Directive 91/68/EEC of 28 January 1991 on animal health conditions for trade in the prey and caprine animals Council Directive 90/426/EEC of 26 June 1990 on animal health conditions governing the the movement and imports from third countries, Council Directive 90/539/EEC of 15 October 1990 on animal health conditions for trade in poultry and hatching eggs from third countries and imports, and Council Directive 92/65/EEC of 13 July 1992 on the health rules for trade in animals, seeds, ova and embryos inside and imports into the Community if they are not subject to Community veterinary legislation listed in Annex and this Directive 90/425/EEC. 2. Decree No. 380/2003 Coll., On veterinary requirements for trade in seeds, egg cells and embryos and on the veterinary conditions for their import from third countries which are transposed, in particular: Council Directive 88/407/EEC of 14 June 1988 on animal health requirements for trade in bovine seed within the Community and imports of Council Directive 90/429/EEC of 26 June 1990 laying down the animal health requirements for trade in porcine seeds within the Community and imports of Council Directive 89/556/EEC of 25 September 1989 on health problems affecting trade in bovine embryos and imports of such embryos from third countries, and Council Directive 92/65/EEC of 13 July 1992 on the health rules for trade in animals, seeds, ova and embryos and the imports into the Community if they are not subject to Community veterinary legislation listed in Annex and this Directive 90/425/EEC. 3. Decree No. 381/2003 Coll., On animal health requirements for aquaculture animals and aquatic products, fishery products and live bivalve molluscs and on the veterinary conditions for their import from third countries, as amended by Decree No. 197/2004 Coll., Which is transposed in particular: Council Directive 91/67/EEC of 28 January 1991 governing the placing of aquaculture animals and products thereof on the market. 4. Regulation of the European Parliament and Council Regulation (EC) no 1774/2002 of 3 October 2002 on the health rules concerning animal by-products not intended for human consumption, as amended. 5. As regards Decree No. 379 pathogens/2003 Coll., On veterinary requirements for trade in animal products, which are not covered by specific legislation on the veterinary conditions for their import from third countries which are transposed, in particular: Directive 92/118/EEC of 17 December 1992 concerning the animal health and public health requirements governing trade in products of animal origin and imports into the Community if they are not covered by specific provisions referred to in this Annex and this Directive 89/662/EEC and, as regards pathogens, that Directive 90/425/EEC. PART B animals and products not covered by specific legislation specified in Part A, BUT trafficking subject to veterinary checks under this Decree 1. Other live animals not included in special legislation listed in Section 2. seeds, embryos, ova and not included in special legislation listed in Section A. '. PART TWO Amendment Decree on veterinary checks in trade in animal products, Article II of Decree No. 373/2003 Coll., on veterinary checks in trade in animal products, is amended as follows: 1. In section 1 point. and the words ') of the European Union and the Member States (hereinafter referred to it as "trafficking") "are deleted. 2. Decree No. 202/2003 Coll., on veterinary requirements for fresh meat, minced meat, meat preparations and meat products, as amended by Decree No. 375/2003 Coll., Decree No. 201/2004 Coll., and Decree No.. 652/2004 Coll., which are transposed, in particular: Council Directive 64/433/EEC of 26 June 1964 on health problems affecting trade in fresh meat, Council Directive 94/65/EC of 14 December 1994 laying down the requirements for the production and marketing of minced meat and meat preparations, Directive 77/99/EEC of 21 December 1976 on health problems affecting trade in meat products in the Community and amending Council Directive 72/461/EEC of 12. December 1972 on health problems affecting trade in fresh meat, Council Directive 80/215/EEC of 22 January 1980 on health problems affecting trade in meat products within the Community. 2. Decree No. 201/2003 Coll., On veterinary requirements for fresh poultry meat, rabbit meat, farmed and wild game meat, as amended by Decree no 651/2004 Coll., Which are transposed, in particular: Council Directive 71/118/EEC of 15 February 1971 on health problems affecting trade in fresh poultry meat, Council Directive 91/495/EEC of 27 November 1990 concerning public health and animal health problems affecting the production of rabbit meat and farmed game and the placing of the meat on the market, Directive 92/45/EEC of 16 June 1992 on public health and animal health problems killing of wild game and wild game meat, the placing on the market, and Council Directive 91/494/EEC of 26 June 1991, the animal health conditions for trade in fresh poultry meat from third countries and imports from third countries. 3. Decree No. 381/2003 Coll., On animal health requirements for aquaculture animals and aquatic products, fishery products and live bivalve molluscs and on the veterinary conditions for their import from third countries, as amended by Decree No. 197/2004 Coll., Which are transposed, in particular: Council Directive 91/67/EEC of 28 January 1991 governing the placing of aquaculture animals and products thereof on the market , Council Directive 91/493/EEC of 22 July 1991 on the health conditions for the production and marketing of fisheries products, and Council Directive 91/492/EEC of 15 July 1991 on the health conditions for the production and placing on the market of live bivalve molluscs. 6. Decree No. 379/2003 Coll., On veterinary requirements for trade in animal products, which are not covered by specific legislation on the veterinary conditions for their import from third countries which are transposed, in particular: Council Directive 92/118/EEC of 17 December 1992 concerning the animal health and public health requirements governing trade in products of animal origin and imports into the Community if they are not covered by specific provisions referred to in this Annex and this Directive 89/662/ EEC, and in terms of pathogens, that Directive 90/425/EEC. PART (B) of ANIMAL PRODUCTS, not covered by specific legislation specified in Part A, BUT trafficking subject to veterinary checks under this decree other animal products, which are not covered by specific legislation specified in Part A of this Annex or Annex No. 3 to Decree No. 361/2003 Coll., on veterinary checks in trade in animals and which have been determined in accordance with the procedure laid down by the European Commission. PART THREE PROVISIONS REPEALING Article III shall be repealed: 1. the Decree of the Ministry of Agriculture No. 286/1999 Coll., which implements the provisions of Law no 166/1999 Coll., on the veterinary care and amending certain related laws (the Veterinary Act), animal health and the protection of animal health conditions for the import, export and transit of goods, veterinary veterinary sanitation, and attestation of studies. 2. The Order of the Ministry of Agriculture No. 399/2001 Coll., amending Decree of the Ministry of Agriculture No. 286/1999 Coll., which implements the provisions of Law no 166/1999 Coll., on the veterinary care and amending certain related laws (the Veterinary Act), animal health and the protection of animal health conditions for the import, export and transit of animal health products , veterinary sanitation, and attestation studio.
