GOVERNMENT REGULATION



of 7 November. December 2010,



amending Government Decree No. 564/2006 Coll., on salaries

of employees in public services and administration, as amended

provisions and repealing Decree-Law No. 445/2000 Coll., on the way

streamlining the amount of money spent on salaries and remuneration for

on-call employees paid according to the salary and

remuneration for work stand-by in budgetary and certain other

organisations and bodies



The Government ordered pursuant to section 123 of paragraph 1. 6 (a). a), d), (f) and (g))) and for the implementation of

Act No. 262/2006 SB., labour code, as amended by Act No. 347/2010 Coll.:



Article. (I)



Government Regulation No. 561/2006 Coll., on salaries of employees in the

public service and administration, as amended by Decree-Law No 74/2009 Coll.,

Government Regulation No. 130/2009 Coll. and regulation of the Government No. 201/2009 Coll.,

be amended as follows:



1. In paragraph 1 (d)):



"d) circuit referred to the employees for which the employer may specify

pay plan in a special way ".



2. In paragraph 1, the following point (d)) the following point (e)) which reads as follows:



"e) circuit referred to the employees that the employer may arrange

contractual salary, and the conditions for the conclusion of the contractual salary ".



Subparagraph e) to (g)) are known as the letters f) to (h)).



3. in article 3 paragraph 3 is added:



"(3) If an employer is unable to occupy the post employee, that

has reached the required education, and unless otherwise provided by special law

otherwise, the employee, the employer may exceptionally fit into the salary

the class for which does not meet the necessary education



a) to for 4 years,



(b)) for a longer period, if previous practice or for special

classification according to subparagraph (a)) has demonstrated the ability to perform the required

work. ".



4. Footnote 3 to 9 are deleted.



5. In article 3, paragraph 4 shall be deleted.



6. In section 4, paragraph 4. 8, the number "3" is replaced by "5".



7. in section 4, paragraph 4. 10 is the number "3" is replaced by "5".



8. in § 5 para. 2 the following point (e)), which read as follows:



"(e) an employee of the State of technology) Agency of the United States,".



9. In paragraph 5, the following paragraphs 4 and 5, including the footnotes No.

18B and 18 c are added:



"(4) an employee who is a pedagogical worker ^ 18b)

professional qualifications under special legislation ^ 18 c), and that

reaching higher education in an accredited undergraduate or

Master's degree programme, for the salary tariff established in accordance with

pay scale set out in annex 4 to this regulation.



(5) an employee who is a pedagogical worker ^ 18b), that it could not

professional qualifications under special legislation ^ 18 c), or

that this qualification is gained, however, has not reached the higher education

accredited bachelor's or master's degree program,

It is for the incremental fare according to pay scale

listed in annex 5 to this regulation.

10. section 6 including the title reads as follows:



"section 6



The special way of determining of salary



The employer may determine the employees salary rate within the range

pay scales laid down for the lowest to the highest salary grade

the appropriate grade. It does not apply to an employee who is

the pedagogical worker ^ 18b), with the exception of the pedagogical worker

who performs the work or activity uměleckopedagogické trainer and

pedagogical worker is an employee referred to in Section 303 paragraph.

11. footnote No 25 is deleted.



12. in paragraph 6, the following new section 6a, which including the title reads as follows:



"§ 6a



Contractual salary



The employee in the thirteenth and higher grade can

the employer negotiate contractual salary. Contractual salary includes all

salary according to the law and the folder of this regulation, which would otherwise be employees

were his, or that the employer could provide.

In addition to the contractual salary employees provide any folders you cannot pay with

the exception of rewards. For the content of the contract of the contractual salary shall apply mutatis mutandis

section 136 of the labour code ".



13. in § 8 para. 1, the number "4" is replaced by the number "6".



14. in annex 3, the following new annex No 4 and 5 are added:

Annex No. 4 is renumbered as annex 6.



15. in annex No 6 in II. the group-work with a considerable degree of

"9. the work in which the employee comes into contact with strangers that are located

in facilities for the detention centre or the applicant for the grant of

international protection accommodated in asylum establishments.

Article. (II)



Transitional provision



If the employee was, exceptionally, classified in grade, for which


does not meet the necessary education, on the basis of § 3 para. 3 or 4 of regulation

Government no 564/2006 Coll., in the version in force before the date of entry into force of

of this regulation, shall be assessed the time and the conditions for the exceptional inclusion of

Article. (III)



Final provision



Regulation of the Government No. 452/2000 Coll., on how to regulate the amount of

money spent on salaries and remuneration for stand-by duty

employees paid under the Act on salaries and remuneration for work

stand-by in budgetary and certain other organizations and

bodies.



Article. (IV)
