REGULATION OF THE GOVERNMENT
of 13 June. July 2005,
amending Government Decree No. 163/2002 Coll., laying down
technical requirements for construction products selected
The Government ordered pursuant to section 22 of Act No. 22/1997 Coll., on technical
requirements for products and amending and supplementing certain acts, as amended by
Law No 71/2000 Coll. and Act No. 205/2002 Coll. (hereinafter the "Act") to
the implementation of § 11a paragraph. 2, section 12 and 13 of the Act:
Article. (I)
Government Decree No. 163/2002 Coll., laying down technical requirements
the selected building products, is hereby amended as follows:
1. In article 1 (1). 1 (a). and the words ") are the building or installation
activities "shall be replaced by" building works ".
2. In article 1 (1). 1 (a). (c)), the words "the activities of a construction or installation

5. In section 1, at the end of the text of paragraph 2, the words "with the exception of

6. In section 1 (1). 3, the word "otherwise" adds a link to the note under
footnote No. 1a.

7. In section 1, the following paragraphs 4 and 5 shall be added:
"(4) the requirements for factory production control system are listed in annex No. 3 to

9. In section 3, paragraph 3. 2 (a). and), the words "his property" shall be replaced by the words

14. In section 4, paragraph 4. 2 the word "taken" is replaced by "processed" and

15. In section 4, paragraph 4. 3 (b). g), the words "referred to in section 5 to 9 before assessing the
conformity issued "shall be replaced by the words" issued before assessing the conformity according to § 5

16. In section 5 (3). 1 (a). (d)) for the word "description" is the word

17. In section 5 (3). 2 (b)):

19. In section 5, paragraphs 3 and 4 are added:
"(3) if the pattern matches the requirements laid down by the designated standards,
the technical regulations or building technical certificate

production control system, where appropriate, the importer ensures proper control of
products, the authorized person of the product certificate and forward it to the
manufacturers or importers. This certificate, or, if the Protocol is
an integral part of the certificate shall contain the conclusions of the survey, verification,
the results of the tests, the basic description and, where appropriate, certified display
the product necessary for its identification.

20. In section 5, the following paragraph 5 is added:
"(5) the importer performs the authorized person at least once every 12
months of supervision over proper functioning of controls of the products, the tests

21. in section 5, the following new section 5a is inserted:
"§ 5a
Certification without tests at sight
(1) an authorised person may issue a certificate in the product and

22. In section 6 (1). 1, letter a) is added:

27. In section 6 (1). 2 (a). (b)), the words "the technical documentation referred to in § 4
paragraph. 3 "shall be replaced by the words" the requirements referred to in point (a)) ".
28. In section 6 (1). 2 (c)):

(1) the product manufactured in another Member State of the European Union or another
representing the State of the European economic area is considered, in each
cases for the corresponding requirements of this regulation if it complies with
tests and findings, which according to the methods in force in the Czech Republic, or
recognised as equivalent to an approved body has carried out in the State

Article II
Transitional provisions
