DECREE



The Ministry of industry and trade



of 26 March. July 2002,



laying down the procedure for the Czech Office for the testing of weapons and ammunition

for the classification of the type of weapon or ammunition in categories



The Ministry of industry and trade shall be determined according to § 79 paragraph 2. 4 to perform

§ 3 para. 3 of the Act No 119/2002 Coll., on firearms and ammunition, and about

Amendment of the Act No 156/2000, on the validation of firearms, ammunition and

pyrotechnical items and on the amendment of Act No 288/1995 Coll., on fire

weapons and ammunition (the Firearms Act), as amended by Act No.

13/1998 Coll. and Act No 368/1992 Coll., on administrative fees, as amended by

amended, and Act No. 455/1991 Coll., on trades

business (Trade Act), as amended, (the Act on

weapons), (hereinafter referred to as the "Act"):



§ 1



The subject of the edit



This Decree lays down the procedure for the Czech Office for the testing of weapons and

ammunition (hereinafter referred to as "the authority"), which should decide on the

spool type firearms (hereinafter referred to as "gun") or ammunition to

the appropriate category.



Procedure for the classification of the type of weapon or ammunition in categories



§ 2



(1) the authority shall, on request of the person who requested the inclusion in doubt

the type of weapon or ammunition into the appropriate category, (hereinafter referred to as "the applicant")

It shall initiate the procedure in which decides on the classification of the type of weapon or ammunition to

the appropriate category under section 3-7 of the Act. The request contains



and) identification of the applicant (the name and surname, residence u

the natural person or the name or business name, registered office and

the identification number for legal persons),



(b) information about the weapon) (type, make, model, caliber, serial number,

If the applicant is known) and its description,



c) data on the ammunition (type, make, caliber) and its description,



(d) the reason for the submission of the application.)



(2) the applicant shall attach to the request



a) a gun or ammunition, to be included in the category, if

the dimensions or the weight of their applications, allow otherwise communicate to the site

(b)), the drafting of technical, promotional, advertising or other documentation

to the weapons or ammunition referred to in subparagraph (a)), if available.



§ 3



(1) the classification of the type of weapon or ammunition into categories based on the authority

of the technical criteria set out in sections 3 to 7 of the Act and in the annex to the Act

and, in particular, of the



and the permissible production design) weapons or ammunition,



(b)) the functional and the firing characteristics of weapons,



(c)) the appearance of weapons,



(d)) of development or production of the weapon,



(e) the overall length of the weapon)



(f) the number of rounds of ammunition in) deck guns,



g) formal kinetic energy projectiles on the muzzle,



h) traction with mechanical weapons



I) functional principle for weapons,



(j)) kind of heat ammunition,



the ammunition in the gun) used,



l) type of missiles in the hub.



(2) the authority shall assess the type of weapon or ammunition in accordance with presented aspects

referred to in paragraph 1 and shall issue a decision on the classification of the type of weapon or

ammunition into the category.



(3) the decision on the classification of the type of weapon or ammunition to be sent to the category

The Office of the Ministry of Interior and also Police Presidium of the Czech Republic.

The Office decision exposes at the address in a publicly accessible

information system (Internet).



§ 4



The effectiveness of the



This Decree shall enter into force on 1 January 2000. January 1, 2003.
