DECREE



of 15 November 2004. June 2006



about reproducing and propagating and planting material of the hops, vines,

of fruit genera and species and ornamental species and its putting into circulation



The Ministry of agriculture shall be determined according to § 3 (2). 8, § 4, paragraph 4. 7, § 5

paragraph. 9, § 7 (2). 6 (a). a) to (j)), n), p), r), s) and u), section 10 (1).

11, § 14 para. 6, § 16 para. 11, § 17 para. 13 (a). (d)), § 18 para. 12,

§ 19 para. 15 (b). a), b), c), (f)), and (h)), § 23 para. 8, § 24 para. 8, §

paragraph 24A. 7 and § 25 para. 8 of Act No. 218/2003 Coll., on the placing on the market

seeds and plants of cultivated plants and on amendments to certain acts (the Act on

circulation of seeds and plants), as amended by Act No 444/2005 Coll. and Act No.

178/2006 Coll. (hereinafter the "Act"):



§ 1



This Decree ^ 1) incorporates the relevant provisions of the European

Community ^ 2) and regulates the recognition of scientific details

and planting material of hops and fruit genera and species, and its

putting into circulation.



§ 2



For the purposes of this Ordinance, means the



and propagation of the hop planting trees) of the same planting

the material of the same variety, where applicable, the clone, the category, generation, health

class and age,



(b)) matečnými plants, plants for the production of hops

propagating material,



c) vines plant genus Vitis (l.) intended for the production of grapes

or to be used as propagating material for such a plant,

h) podnožovým schnitzel vine cuttings or letorostu part that is in

the production of seedlings, whether intended to form the underground part,



I) graft of vine cuttings or section letorostu, which is designed to create

the above-ground parts of plants, whether in the production of young plants or grafting on

post,



j) disease of the vine part of cuttings or rooted cuttings intended for the production of letorostu

seedlings,



the vine 68) vineyard vines intended for the production of approved

cuttings or cuttings,



l) phenotypic vine vines vineyard intended for graft nurseries or

cuttings,



m) for kindergarten vines intended for the production of rooted cuttings of vines or

whether seedlings,



n) propagating material of fruit genera and species, seeds, rootstocks,

chop, screw, loop, oddělek, školkařský, výpěstek, seedlings or

another part of the plants intended for the propagation and production of fruit plants,

u) propagating material of ornamental species of plant material intended to

reproduction or to the cultivation of ornamental plants. In the case of the cultivation of

finished plants this definition applies only if the resulting ornamental

the plant intended to further putting into circulation.



§ 3



The recognition of, and scientific or propagating material of vine of hops,

and fruit genera and species, and the circulation of



[To section 3, para. 8, § 7 para. 6 (a)), b), (d)) and paragraph 23 of the u), para. 8 and § 24

(1) the requirements for the properties of the crop species and planting

the material of the hops used in circulation are listed in annex 1.



(2) the requirements for the properties of the crop species and planting

(3) the requirements for the properties of the crop species and planting

material of fruit genera and species, placed into circulation are listed in

Annex # 3.



(4) the model documents, the vendor who puts into circulation the propagating material

hops, vines, fruit genera and species other than final consumers

§ 4



The categories and numbers of generations of propagating material of the hops and their

labelling, conditions on the properties of the land, the soil or substrate



[To section 3 paragraph 8, section 7 (6) (a). p) and with) law]



(1) the categories of propagating material of the hops is:

1. comes from a crossing of the propagating material,



2. is maintained in terms of preventing infection of individual plants,



3. is regularly checked for the presence of harmful organisms,

4. is considered preliminary, is reproduced under the same conditions,



(b)) the basic propagating material, which



1. first generation is referred to (E) (I) and which comes from propagating

material pressurized prestage,



2. the second generation is referred to (E) (II), and that comes from the first generation

c) certified propagating material which is referred to (C) and that

comes from the propagating material of a pressurized prestage, from the first or second

generation of basic propagating material.



(2) in the substrate on which it is propagating material of a pressurized prestage

grown, may not be present for the parasitic nematode Xiphinema genera and

Longidorus. If this condition is met, it is possible that a preliminary

§ 5

labelling, conditions on the properties of the land, the soil or substrate

(1) the categories of propagating material of vine is:

2. is maintained in terms of preventing infection of individual plants,



3. is regularly checked for the presence of harmful organisms,

4. is considered preliminary, is reproduced under the same conditions,



5. is being tested internationally recognised diagnostic method every five

years on the harmful organisms referred to in annex 8, point 2 and is a plain

these harmful organisms,



(b)) basic propagating material, which is called E, and that



1. is reproduced by vegetative propagation directly from propagating material

prestage,



2. at least once every 6 years starting from the third year after planting tested

the internationally accepted method of the harmful organisms listed in annex

# 8, point 2 and is free of those harmful organisms. In the case that it is

certification of basic propagating material carried out each year, it is

material tested at least every six years starting from the sixth year after the

planting,



c) certified propagating material which is referred to (C) and that



1. is reproduced by vegetative propagation directly from propagating material

prestage, or from basic propagating material,



2. at least once every 10 years, starting with the fifth year after planting tested

an internationally recognized diagnostic method on harmful organisms

referred to in annex 8, paragraph 2, and to be free from those harmful organisms.

year, the material is tested at least once every 10 years, starting at the tenth

d) standard propagating material which is called STANDARD.



(2) in the substrate or in the soil in which it is propagating tested

the material must not be pressurized prestage grown, present parasitic nematodes

(3) in the soil in which it is tested, basic and certified propagating

the material must not be pressurized prestage grown, present parasitic nematodes

Xiphinema and Longidorus genus.



§ 6



The categories and numbers of generations of propagating material of fruit genera and

species and their labelling, conditions on the properties of the land, the soil, the

(1) the categories of propagating material of fruit genera and species, with

the exception of the strawberry, is:



a) propagating material of a pressurized prestage, which indicates 1 and that

2. is maintained in terms of preventing infection of individual plants,



3. is regularly checked for the presence of harmful organisms,

reduce the quality of the propagating material,



4. is considered preliminary, is reproduced under the same conditions,




(b)) the basic propagating material, which



1. first generation is referred to an I and comes direct vegetative

2. the second generation is referred to (E) (II), and that comes from the first generation

c) certified propagating material which is referred to (C) and that

comes from the propagating material of a pressurized prestage, from the first or second

a) propagating material of a pressurized prestage, which indicates 1 and that



1. comes from a crossing of the propagating material,



2. is maintained in terms of preventing infection of individual plants,



3. is regularly checked for the presence of harmful organisms,

reduce the quality of the propagating material,



4. is considered preliminary, is reproduced under the same conditions,



(b)) the basic propagating material, which



1. first generation subsidiary plant is referred to an I and is rozmnožena

direct in a vegetative way of propagating material of a pressurized prestage

by using the aerial parts of the plant are maintained to shoots and individually in the

conditions to prevent infection, or that is rozmnožena direct

vegetative propagation from a pressurized prestage in vitro when the maximum

2. the second generation subsidiary plant is referred to (E) (II) and is rozmnožena

direct in a vegetative way from the first generation of basic propagating

material by means of the aerial parts of shoots,



c) certified propagating material which is called C, which is

produced by vegetative propagation directly using the aerial parts

shoots from basic propagating material.



(3) in the substrate on which it is grown propagating material of a pressurized prestage

the strawberry, almonds, apricots, cherries, sour cherries, Prunus, peach,

currants, gooseberries, Red Raspberry or raspberry, must not be present

parasitic nematode Xiphinema and Longidorus genus. If this condition is

(4) in the substrate, in the soil or on the property, where it is grown base

§ 7



The deadlines for the submission of the application, a model application for crop certification

and planting material of the hops, vines, fruit genera and species, the pattern

grown in the laboratory or in greenhouse conditions is served

no later than 20 days before placing into circulation of propagating material.



(4) to verify the origin of certified propagating material is used, in particular,

invoices, delivery notes, international certificates and certificates issued by the

the competent authority responsible for certification or checking in the

the State, include the information referred to in section 3, paragraph 3. 7 of the Act.



(5) a document issued by the supplier in accordance with paragraph 4 may be replaced

by a plant passport in accordance with special legislation ^ 4),

§ 8



Procedures for the evaluation of scientific

stands.



§ 9



The method of labelling and health properties of classes of propagating

recognition of scientific material and propagating material



[To section 3, para. 8, § 7 para. 6 (b), (d)), and (g)), § 24 para. 8 the law]



(1) Viruprostý the propagating material is referred to by the abbreviation VF.



(2) Tested the propagating material is referred to by the abbreviation VT.



(3) the propagating material in health class, viruprostý must have these

properties:

(b)) has been stored in conditions that ensure the absence of any

infection,

(d)) has been produced and maintained under conditions ensuring freedom from

any infection.



(4) the propagating material in health class under test must have the following

properties:



a) is found to be in accordance with the internationally uznávacími diagnostic

(b)) has been stored under conditions ensuring the absence of any

infection,



(c)) comes straight in a vegetative way set number of generations of

(d)) has been produced and maintained under conditions ensuring freedom from

any infection.



(5) the list of viruses and virus-like organisms harmful to

tests the propagating material of hops, is given in annex 8, point 1.



(6) the list of viruses and virus-like organisms harmful to

tests the acclaimed propagating material of fruit genera and species is listed

in annex 10, paragraph 1 and for a list of specific harmful organisms

of fruit genera and species, reducing quality is given in annex No 10 point

2.



(7) a list of specific harmful organisms and diseases, reducing the

the quality of propagating material of ornamental species is given in annex No.

11.



§ 10



The method of record keeping in the production of propagating material,



[To section 7 para. 6 (a) (j)), § 14 para. 6 of the Act]



(1) Evidence in the production of propagating material of vine of hops, and

of fruit genera and species is leading in nursery books.



(2) the seed planted, rootstock and selektované vineyards, mother

cropping of Strawberry, seed-bearing trees and shrubs of fruit genera and species, the master

stands of vegetative rootstocks, the master unit of fruit trees and shrubs

§ 11

(b) the management of the list of varieties), which contains the



1. the name of the variety, where appropriate, its commonly known synonyms,



2. information on the maintenance of the variety and propagation of the variety,



3. information on the extent to which they differ from the nearest similar varieties,




4. Description of the varieties at least to the extent provided in annex No 9.



(2) to verify the origin of the Conformal propagating material is used

in particular, invoices, delivery notes, international certificates and certificates

issued by the competent authority responsible for certification or checking

in that State, if the data according to § 3 (2). 7 of the Act.



(3) a document issued by the supplier in accordance with paragraph 2 can be replaced

(6) Conformal propagating material in the cultivation and marketing

§ 15



Labelling and packaging of propagating material of vine



[To section 14 (6) of the Act and section 19 para. 15 (b)), b), c), (f)), and (h))

(1) the propagating material of vine and putting into circulation when packaged and marked in

the volumes or in containers that are sealed so that they cannot be opened

without damaging the seal.

(5) top-graft cuttings, cuttings, nursery crops, rootstocks and on entry into circulation

on volumes marked at least one duly completed the official label.



(6) the putting into circulation of nursery crops after the individual pieces

with each piece of the duly filled-in marks the official label, with the exception of

the strawberry, Red Raspberry and Raspberry.



(7) the propagating material of Strawberry produced in vitro

When the circulation indicated in the accompanying document.



(8) the Patterns of official labels are listed in annex No 14.



(9) the supplier identifies the marketing of a genetically modified variety to

circulation, that it is a genetically modified variety ^ 5).



§ 17



The group stands of propagating material of the hops, vines, fruit genera and

species



(To section 24a of paragraph 7 of the law)



(1) a group of crops of the propagating material of the hops are:
