The State Office for Nuclear Safety, pursuant to § 47 par. 7 to perform
§ 13 par. 3 point. d) and § 18 par. 2 point. b), para. 4 and 5
Act no. 18/1997 Coll., on peaceful use of nuclear energy and
ionizing radiation (Atomic Act) and amending and supplementing certain
laws, (hereinafter the "Act ')
Subject Matter


§ 1
This decree


A) provides activities that have direct impact on nuclear
safety and activities especially important for radiation protection

B) defines the requirements for qualification and training of selected personnel
nuclear installations and selected personnel
with sources of ionizing radiation for obtaining special professional competence,

C) regulates the method of verification of special professional competence, method
authorization to selected employees (hereinafter referred to as "license") and
scope and method of implementation of approved documentation for permits
training of selected personnel of nuclear installations and selected
workers to ionizing radiation.

§ 2

For the purposes of this Decree:

A) nuclear energy facilities nuclear facilities according to § 2. h)
section 1 of the Act, with a heat output exceeding 50 MW,

B) research nuclear facilities nuclear facilities according to § 2. h)
section 1 of the Act, with a heat output of 50 MW, inclusive.

§ 3

Activities that have an immediate impact on nuclear safety and
activities especially important for radiation protection

(1) activities having a direct impact on nuclear safety
means the work done on

A) nuclear energy facilities, and it

First Handling on the block and emergency control room, incl.
separate shutdown of the reactor, control and supervision of the commissioning and management and control of the entire operation
nuclear energy equipment,

Second Handling on the block and emergency control room, incl.
separate shutdown of the reactor, control and supervision of the commissioning and management and control
operation of only one reactor block

Third Handling on the block and emergency control room, incl.
separate shutdown of the reactor, control and supervision of the commissioning and management and control
primary operation of the reactor block

Fourth Handling on the block and emergency control room management and control
putting into operation and management and control of the operation of the secondary reactor
block

Fifth direct management of each step
tests of physical and power start to the control room of the reactor block,

6th management and supervision of handling with various fuel assemblies inside the reactor block
outside node fresh fuel

B) nuclear research facilities, and it

First handling control room and direct control of each step
tests of physical and power start-up of the reactor and the management and control
trigger further work

Second manipulation in the control room, the management and control of putting the reactor into operation
, management and control of reactor operation, management and control
handling of the fuel in the reactor core and the control and supervision of the activities
shift

Third management and control assembly and core configuration, implementation
physical measurements during physical and power start
reactor and the management and control of basic critical experiment

Fourth manipulation in the control room, the control and supervision of commissioning and managing
control and operation of the reactor.

(2) activities especially important for radiation protection means:

A) performing systematic supervision [§ 18 par. 1 point. i) of the Act]
over compliance with the requirements of radiation protection, and it

First supervisors at workplaces operated under
authorization under § 9. 1 point. d) of the Act or which are handled

Ionizing radiation on the basis of an authorization pursuant to § 9. 1 point.
I) of the Act,

Second persons with direct responsibility for radiation protection during
medical exposure in the workplace II. and higher categories, which are determined in
quality assurance program,

Third other persons with direct responsibility for radiation protection
during radiation practices, other than under paragraph 2, on the basis
authorization under § 9. 1 point. d) i), j) s) or r) of the Act, which are designed
in the quality assurance program,

B) evaluation of properties of ionizing radiation sources performed on the basis
permission to ionizing radiation in accordance with § 9
paragraph. 1 point. i) of the Act, management and execution of the tests laid down
special legislation ^ 1)

C) management services subject to authorization under § 9. 1 point. r) of the Act, and it


First personal dosimetry, including for the purposes of § 6 par. 3 point. b) of the Act,

Second monitoring by the monitoring program in workplaces III. and IV.
Categories, with the exception of the activities of the licensee pursuant to § 9
paragraph. 1 point. d) of the Act,

Third measuring and evaluating the occurrence of radon and radon decay products in buildings and determining
radon index,

Fourth measurement and evaluation of natural radionuclide content in building materials
, water intended for public drinking water supply and
bottled water.

§ 4

Requirements for qualification of selected personnel

(1) The qualification of selected personnel of nuclear installations means for
activities referred to in

A) § 3 para. 1 point. a) under item 1 - university
physical or technical direction, completing basic training and performance
activities according to § 3 para. 1 point. a) paragraph 2 at least two years and
's preparation for changing activities

B) § 3 para. 1 point. a) under item 2 -
university education of physical or technical direction, completing basic training and performance
activities according to § 3 para. 1 point. a) Section 3 of at least one year and
performance of activities according to § 3 para. 1 point. a) point 4 for at least one year and
's preparation for changing activities

C) § 3 para. 1 point. a) under paragraphs 3, 5, 6 - university
physical or technical field and completing basic training,

D) § 3 para. 1 point. a) under item 4 - Higher education
physical or technical field and completing basic training or
complete secondary education in the physical or technical direction
performance of activities to subordinate (related) functions for at least four years and
completing basic training,

E) § 3 para. 1 point. b) under item 1 - university
physical or technical direction, the performance of activities under § 3 para. 1
point. b) paragraph 2 at least one year, the performance of activities under § 3 para. 1 point.
B) Section 3 of at least one year's preparation for changing activities

F) § 3 para. 1 point. b) under item 2 -
university education of physical or technical direction, appropriate professional experience of at least two
years, completing basic training and exercise activities according to § 3 para. 1
point. b) point 4 for at least two years and completing preparations for changing
activity or complete secondary education or physical
technical direction, appropriate professional experience of at least five years and
completing basic training and exercise activities according to § 3. 1 point. b) Section 4
least two years and completing preparations for changing activities

G) § 3 para. 1 point. b) under item 3 - Higher education
physical or technical direction, appropriate professional experience of at least two years and
completing basic training,

H) § 3 para. 1 point. b) under item 4 - Higher education
physical or technical direction, appropriate professional experience of at least two years and
completing basic training, or full secondary vocational education
physical or technical direction, appropriate professional experience of at least five
years and graduating from basic training.

(2) the performance of activities as part of the qualifications required by § 4
paragraph. 1 point. a), b), d), e), f) means the performance of activities on the same
nuclear facility.

(3) In the case of newly built nuclear facilities, the State Office for Nuclear Safety
(hereinafter the "Authority"), recognized as the performance of activities as part

Qualifications required under § 4 para. 1 point. a), b), e), f) performance
activities at a nuclear facility of this type in less than six months
.

(4) The qualification of selected personnel with the ionizing radiation means


A) for the activities of persons referred to in § 3 para. 2 point. a) 1
least a bachelor's degree in a relevant field, in the case of ongoing oversight
very significant ionizing radiation or significant sources
ionizing radiation, which are designed for medical exposure;
in other cases set forth in § 3 para. 2 point. a) 1
least complete secondary education in a relevant field,

B) activities referred to in § 3 para. 2 point. a) Section 2
competence to perform medical profession ^ 2)

C) activities referred to in § 3 para. 2 point. a) point 3
least complete secondary vocational education in the relevant direction

D) for the management and execution of tests in the evaluation of sources of ionizing radiation
under § 3 para. 2 point. b) at least complete secondary vocational education in the relevant
direction and control tests in evaluating
significant sources of ionizing radiation, which are intended for medical
irradiation, at least a bachelor's degree in a relevant field,

E) activities referred to in § 3 para. 2 point. c) points 1 and 2
least a bachelor's degree in a relevant field,

F) activities referred to in § 3 para. 2 point. c) paragraphs 3 and 4
least complete secondary education in a relevant field.

§ 5

Requirements for professional training of selected personnel of nuclear installations
to acquire special competence

(1) Training for obtaining and maintaining special professional competence
takes place in the following stages:

A) Basic training,

B) periodic preparation to maintain qualification

C) preparation for the change operations in the event of changes in performance of activities within
§ 3. 1 point. a) or under § 3 para. 1 point. b).

(2) Basic training consists of the following components:

A) theoretical training,

B) internship at the nuclear facility at least five weeks

C) activities referred to in § 3 para. 1 point. a) Items 1, 2, 3
training on full-scope simulator at least five weeks for activities
specified in § 3 para. 1 point. a) under item 4 at least three weeks

D) training on the operation of at least five weeks.

(3) Periodic preparation includes

A) theoretical training,

B) activities referred to in § 3 para. 1 point. a) Items 1, 2, 3, 4
training on full-scope simulator at least two weeks per year,

(4) Preparing for a change of activity consists of the following components:

A) theoretical training,

B) activities referred to in § 3 para. 1 point. a) Items 1, 2, 3, 4
training on full-scope simulator for at least one week

C) training on the operation of at least four weeks.

(5) Completion of the respective phase of training is a prerequisite for
authorization.

§ 6

Requirements for training of selected personnel with sources of ionizing radiation
to acquire special competence

(1) Training for obtaining special professional competence consists


A) completion of basic training,

B) from 1 year experience

First in dealing with the corresponding ionizing radiation for
out activities referred to in § 3 para. 2 point. a) except
stable industrial measuring devices containing simple
sources of ionizing radiation

Second in the performance tests for holders of the relevant authorization from the manufacturer
adequate resources or a service organization for performing
activities listed in § 3 para. 2 point. b)
sources for medical exposure, if such tests must be carried out by personnel
least a bachelor's degree under § 4 para. 4 point. d)

Third in the performance of services and tests for holders of the relevant authorization by
manufacturer or service organization for carrying out other activities
listed in § 3 para. 2, except the activities listed in § 6 para. 1 point.
C)
c) two years experience in the performance of tests on respective holders
permission, the manufacturer of adequate resources or service organization
for carrying out the activities listed in § 3 para. 2 point. b) Resources

Intended for medical exposure, if these tests can be performed
workers with secondary education under § 4 para. 4 point. d). d)

paragraph 3. 2 point. a) at workplaces where defined-controlled zone, and
under § 3 para. 2 point. b) and c).

(2) Basic training is aimed at gaining knowledge of principles and practices
including radiation protection procedures for radiation accidents [§ 2. k)
Act] and radiation accidents [§ 2. l) of the Act].

§ 7


Examination Board
Activities of the state board of examiners and expert examination boards Office
method of implementation and evaluation of the tests and their individual parts and other details
statutes governing these commissions issued by the Office.

§ 8

Method of verification of special professional competence of selected personnel at nuclear facilities


(1) The verification of special professional competence of selected personnel at nuclear facilities
takes the form of examination before the State Examination Commission.

(2) The test consists of

A) tests on full-scope simulator for the activities referred to in § 3
paragraph. 1 point. a) paragraphs 1 to 4

B) a written exam,

C) oral examination

D) the practical part of the exam.

(3) In the event that a re-authorization, may
state board of examiners decide to waive the practical part of the exam.

(4) Application for test, which gives the holder of the permit under § 9
paragraph. 1 point. b), c), d), e), f) of the Act must contain the following information:

A) the name, legal form and address of the licensee,

B) name, surname and date of birth of the selected worker

C) educational attainment, including the specialization chosen
worker

D) the name of the nuclear facility and working activities under § 3 para. 1, for
to be granted permission,

E) a certificate of completion of training selected by the employee
§ 5

F) certificate of compliance in accordance with § 17 para. 1 point. i) of the Act,

G) report on the fitness of selected worker (
not be older than one year)

H) report on mental fitness of selected worker (
not be older than two years)

I) confirmation during the previous working activities, whose
completion is required in § 4 for the performance of activities under § 3
paragraph. 1, for permission to be granted.

(5) The accuracy of the information contained in the application corresponds to the permit holder.

(6) If the worker does not pass the test can repeat the test at the
from one to six months; date of the exam provides state test
Commission.

§ 9

Method of verification of special professional competence of selected personnel with the ionizing radiation


(1) The verification of special professional competence of selected personnel with
ionizing radiation through a written and oral exam before
relevant professional Board of Examiners Office. For activities under § 3 para.
2, whose performance is necessary practical knowledge and skills, may have
exam also practical.

(2) The verification of special professional competence of selected personnel with
ionizing radiation is performed on the basis of the application for the exam
filed with the Office of the person whose special professional competence has to be verified
.

(3) The application for the test must contain the following information:

A) name, surname, date of birth, address,

B) highest level of education, incl. professional orientation,

C) certificate of completion of training

D) selected persons who are or intend to be professionals
category A certificate of medical fitness,

E) specification of activities for which it has to be special professional competence
verified

F) for activities under § 3 para. 2 point. b) c)

First measurement methodology and interpretation of results provided by them,

Second results of participation in the test and comparative measurements

Third Sample measurement protocols and evaluation.

(4) If the worker does not pass the test can repeat the test at the
from one to six months; date of the exam provides specialized testing
Commission Office.

§ 10


Method of granting authorization of selected personnel of nuclear installations


(1) Authorisation for the activity of selected personnel of nuclear installations
Grants Office at the request of the licensee
meet the qualification requirements and verifying professional competence in the form of special
examination before the State Examination Commission for activities under § 3 paragraph. 1
point. a) paragraphs 3 and 4 and point. b) paragraph 4 for two, up to four years
other activities for a period of two to eight years.

(2) Permission is granted to nuclear facilities in the Czech Republic and
working activities under § 3 para. 1st

(3) Authorisation for the activity of selected personnel subject to the condition that
performance of work referred

A) of § 3 para. 1 point. a) paragraphs 1-4 was interrupted for a period longer than six months
,

B) of § 3 para. 1 point. a) Sections 5 and 6 is not interrupted for more than
eighteen months

C) of § 3 para. 1 point. b) points 1-4 was interrupted for a period longer than 12 months
.

§ 11

Method of granting authorization of selected personnel with sources of ionizing radiation


(1) Authorisation for the activity of selected personnel with the ionizing radiation
Office awarded on the basis of their qualification by
§ 4, paragraph. 4, meet the training requirements pursuant to § 6 and form a successful verification
passing the examination before an expert examination committee.

(2) Permission is granted for work activities under § 3 para. 2nd

(3) Authorisation for the activity of selected personnel with the ionizing radiation
grants for activities with very significant ionizing radiation
for a period of two to eight years for other activities for a period of one year to ten
flight. Authorization for the selected personnel action under §
paragraph 3. 2 point. a) paragraph 2 shall be granted for an indefinite period.

§ 12

The scope and method of documentation for permits to training
selected personnel of nuclear installations and selected personnel
workplaces with ionizing radiation

Papers documenting the process for the preparation of selected personnel means

A) teaching methods, including procedures for evaluation and analysis process
training of selected personnel

B) training programs defining the course of the preparation of form,
content, scope, objectives and methods of their achievement, particularly curricula
preparation and method of verification knowledge, understanding, skills, habits and attitudes acquired in
all the various stages of the process of preparation.

§ 13
Transitional provisions


(1) The authorization of selected personnel to perform activities at nuclear facilities
and the approval of organizations to prepare selected employees
issued under previous regulations remain unaffected.

(2) The validity of certificates issued by Decree of the Ministry of Health
Czech Socialist Republic no. 59/1972 Coll., On protection
health from ionizing radiation, supervising staff and managing
directly and approvals issued by the responsible representatives by Act no.
85/1995 Coll., amending and supplementing law no. 287/1993 Coll., on
scope of the State Office for nuclear safety and the measures associated with it
expire no later than the expiration of five years from the effective date of this decree
.

§ 14
Efficiency


This Decree shall take effect on the date of publication.

Selected provisions of amendments


Art. II Decree no. 315/2002 Coll.

(1) The authorization of selected personnel to perform activities at nuclear facilities
issued under existing legislation expires time
which it was issued.

(2) The authorization under § 3 para. 2 point. a), b) and c) points 6 and 7
Decree no. 146/1997 Coll. issued under existing legislation expires
expiry of the period for which it is issued and

A) performing systematic supervision under § 3 para. 2 point. b) Decree No.
. 146/1997 Coll. It is considered the activities of the supervising person under § 3
paragraph. 2 point. a) 1 according to detailed specifications in the authorization referred
(type of workplace, resource classification, etc.)

B) management of works under § 3 para. 2 point. a) Decree no. 146/1997 Coll.
be considered as an activity under § 3 para. 2 point. a) paragraphs 2 and 3 of this Decree
according to detailed specifications set out in the authorization (type of workplace
classification of resources etc.)


C) Control tests and services under § 3 para. 2 point. c) points 6 and 7
Decree no. 146/1997 Coll. is regarded as an activity under § 3 para. 2 point.
C) paragraphs 3 and 4 of this decree by detailed specifications in the authorization
mentioned.

(3) The authorization under § 3 para. 2 point. c) points 1-5
Decree no. 146/1997 Coll. issued before the effective date of this decree expires
expiry of the period for which it was issued, but no later than 31 December 2008
and

A) control tests and services under § 3 para. 2 point. c) points 1-4
Decree no. 146/1997 Coll. It is considered the management and execution of tests
ionizing radiation sources under § 3 para. 2 point. b) hereof
according to detailed specifications set out in the authorization (type of activity, type
workplace, resource classification)

B) control tests and services under § 3 para. 2 point. c) Section 5
Decree no. 146/1997 Coll. is regarded as the management of personal dosimetry services according to §
paragraph 3. 2 point. c) 1 of the Decree by detailed specifications in the authorization referred
.

1) Decree no. 307/2002 Coll., On radiation protection.

2) Decree no. 77/1981 Coll., On healthcare workers and other
professional health care personnel.
