DECREE
from day 4. in May 2005,
amending Decree No. 223/1995 Coll., on the eligibility of vessels to
traffic on inland waterways, as amended by Decree No 83/2000
SB.
The Ministry of transport shall be determined according to § 52 of Act No. 114/1995 Coll., on
inland waterway, as amended by Act No. 359/1999 Coll. and Act No.
118/2004 Coll. (hereinafter the "Act"):
Article. (I)
Decree No. 223/1995 Coll., on the eligibility of the vessels to operate on
inland waterways, as amended by Decree No 83/2000 Coll.,
be amended as follows:
1. § 1, including footnote No 1 is added:
"§ 1
This Decree incorporates the relevant provisions of the European
community. ^ 1)
1) Council Directive 82/714/EEC of 4 May. October 1982 laying down the
technical requirements for inland waterway vessels (article 4), of Directive
The European Parliament and of the Council 94/25/EC of 16 December 2002. June 1994 on the
approximation of the laws, regulations and administrative provisions of the Member States relating to the
recreational craft (article 4). ".
2. in article 1, the following paragraph 1a is inserted:
' section 1a
Ferry zone of waterways
(1) for the purposes of this order will be of navigational waterways of the zone:
a) zone 1-with the appearance of waves with a height up to 2.0 m,
b) zone 2-with the appearance of waves with a height of up to 1.2 m,
c) zone 3-with the appearance of waves with a height of up to 0.6 m,
d) zone 4-with the appearance of waves with a height of up to 0.3 m.
(2) the Navigational zone monitored the waterways the United States are listed
in annex 1. ".
3. In paragraph 3, at the end of paragraph 3, the words "and must be carried out
as unsinkable, according to annex No 3 point 2.02.1 ".
4. In section 4, paragraph 4. 1, letter c) dot replaced with a comma and the following
new subparagraph (d)), and (e)) including footnote No 2:
"d) vessels whose capacity to operate on the waterway has confirmed
a valid vessel certificate issued pursuant to article 22 of the revised
Convention for the navigation of the Rhine ^ 2) on the basis of technical inspection of the vessel,
with regard to the extension of the ship's certificate,
(e)) the Association ships seating up to 12 people only
operated on waterways transport significant exploitable,
waterways and on other waterways.
2) article 4 of Council Directive 82/714/EEC of 4 May. October 1982, which
laying down technical requirements for inland waterway vessels ".
The existing footnote 1 to 4, including links to these
the notes referred to as footnote No. 3 to 6.
5. In article 7 (2). 1 introductory part of the provisions, the words "on the water"
the words "for the purposes of certificate eligibility the vessel to operate on
waterway ".
6. In paragraph 7, at the end of paragraph 2, the words ", or the validity of the
ship's certificate issued to vessels referred to in article 22 of the revised Convention
for navigation on the Rhine ".
7. In article 7 (2). 3, after the words "classification surveys", the words "
, or the presentation of a valid ship's certificate issued under the vessel
Article 22 of the revised Convention for the navigation of the Rhine ".
8. in annex No. 3 in article 1.01. the following new paragraph 1.01.4. and
1.01.5., including the footnotes 7 and 8 are added:
"1.01.4., if a small vessel that is a pleasure craft referred to in
a special legal regulation, ^ 7) bears the CE marking
and the manufacturer, his authorized representative or the importer
applying the appropriate procedures for the assessment of
compliance with technical requirements and issued about the EC declaration
of conformity according to the law of the European communities, ^ 7) ^ 8) meets
that vessel at the time of placing on the market of technical
the conditions for eligibility of small vessels under this annex
In addition to its articles, 5.02.3 1.03.2, 5.03., 5.05.4.,
5.05.5., 5.06.3., 5.06.4. and 6.01. up to 6.04.
1.01.5. If a small vessel, which is a water scooter by
a special legal regulation, ^ 7) bears the CE marking
and the manufacturer, his authorized representative or the importer
applying the appropriate procedures for the assessment of
compliance with technical requirements and issued about the EC declaration
of conformity according to the law of the European communities, ^ 7) ^ 8) meets
that vessel at the time of placing on the market of technical
the conditions for eligibility of small vessels under this annex.
7) Government Regulation No. 174/2005 Coll., laying down technical
requirements for recreational craft, partly completed recreational
craft and their selected parts, on jet skis and propulsion engines
recreational craft and personal watercraft.
8) Directive 94/25/EC of the European Parliament and of the Council of 16 December 2002. June
1994 on the approximation of the laws, regulations and administrative measures
Member States relating to recreational craft.
Directive 2003/44/EC of the European Parliament and of the Council of 16 December 2002. June
2003 amending Directive 94/25/EC on the approximation of the laws, other
legislation and administrative action of the Member States relating to the
recreational vessels. ".
Article II
This Decree shall take effect on the date of its publication.
