GOVERNMENT REGULATION



of 21 June 1999. July 2014,



amending Government Decree No. 478/2009 Coll., laying down certain

conditions for the grant of aid for fruit and vegetables and products processed from fruit,

vegetables and bananas to children in educational establishments



The Government ordered pursuant to section 2b, paragraph 1. 2 of law No 249/1997 Coll., on

Agriculture, as amended by Act No. 128/2003 Coll., Act No. 441/2005 Coll. and

Act No. 291/2009 Coll., and pursuant to section 1 (1). 3 of Act No. 256/2000 SB., about

The State agricultural intervention fund and amending certain other

laws (the law on the State agricultural intervention fund), as amended by

Act No. 441/2005 Coll. and Act No. 291/2009, code:



Article. (I)



Government Regulation No. 478/2009 Coll., laying down certain conditions for the

providing support for the fruit and vegetables and products made from fruits, vegetables and

bananas for children in educational establishments, is amended as follows:



1. in article 1, section 3, paragraph 3. 3 and 9, § 4, paragraph 4. 2 and 3 and in § 5 para. 2, the words

"European Community" shall be replaced by the words "European Union".



2. In paragraph 1, the words "the first to fifth-year students of elementary schools (^ 3)

"the school") "shall be replaced by the words" the first grade of primary schools, including

children from preparatory classes of primary schools ^ 3) (hereinafter referred to as the "first degree") ".



3. Footnote 1 and 2 shall be added:



"1) European Parliament and Council Regulation (EU) no 1308/2013 of 17 May.

December 2013, which lays down the common organisation of the markets in

agricultural products and repealing Council Regulation (EEC) no 922/72, (EEC) No.

234/79, (EEC) no 1037/2001 and (EC) No 1234/2007, as amended.

down detailed rules for the application of Council Regulation (EC) No 1234/2007, as regards

for community support for the provision of fruit and vegetables and products made from

2) part IX to XI of annex I to regulation of the European Parliament and of the Council (EU)

No 1308/2013. ".



4. in article 2, paragraph 1, including footnote No. 4 reads as follows:



"(1) the aid is granted for the following products:



a) fresh fruit and vegetables, or on packed fresh fruit and

vegetables that are set out in part IX of annex I directly applicable

Regulation of the European Union, which lays down the common organisation of the markets in

agricultural products ^ 4), if they do not contain additives referred to in annex V,

directly applicable European Union legislation laying down common

organisation of the markets in agricultural products ^ 4), and



b) packaged fruit and vegetable juices and fruit puree, if they do not contain

additives referred to in annex V directly applicable European Union legislation,

establishing a common organisation of the markets ^ 4) in agricultural products,

nor preservatives.

Footnote 5 is deleted.



5. In article 2 (2). 2, after the word "juices", the words "and fruit

7. In paragraph 2, the following paragraphs 4 and 5, including the footnotes No.

"(4) the proportion of the products originating in countries outside the European Union in the course of

the relevant school year may not exceed 10% of the total number of

products supplied to elementary schools, with whom the applicant has concluded

the contract for the supply of the products ^ 16).



(5) the aid is in addition to the products referred to in paragraph 1 shall be provided in

the scope of a directly applicable regulation the European Union ^ 17) on the

(b)) lectures, training and information campaigns about the products

distribution and consumption of fruits and vegetables, with the exception of the establishment and operation of the

Internet presentations,



c) tasting fruit and vegetables and products from fruit and vegetables,



d) school competitions that promote the consumption of fruit and vegetables,



e) participation in the days of health in primary schools associated with the promotion of

fruit and vegetable consumption, or



(f) support for the school facilities of the land), in particular the acquisition of tools,

kompostérů or the seedlings, which relates to the activities of the pupils at the school

a plot of land.

9. in section 3, paragraph 3. 3, after the word "each" is inserted after the word "basic".



10. In section 3, paragraph 3. 5, the words "the approved applicant" shall be replaced by

"an applicant who has been approved for the delivery of the products (hereinafter referred to as

"the approved applicant") "and the words" sign in the school the applicant "shall be replaced by

the words "sign in primary schools to the approved applicant".



11. in section 3, paragraph 3. 6, after the words "the number of" following the word "fundamental",

for the Czech Republic, after deduction of related costs including the costs

for accompanying measures ^ 9) and the total number of children aged 6 to 10 years in

calendar year shall notify in writing the applicant of each approved minimum

the number of delivery of products per month of the relevant school year based on the amount of

15. in section 3, paragraph 3. 9, after the word "limit", the words "on products",

children aged 6-10 years in the Czech Republic listed in the directly

applicable legislation the European Union ^ 7).



(11) Approved the applicant delivers to 31. October of the calendar

year plan of accompanying measures with the quantification of the financial cost

and costs of each of the accompanying measures for the school

The present paragraph 10 shall be renumbered as paragraph 12.



17. In the heading of section 4, the words "on the products".

"§ 4a



The application for the grant of aid for accompanying measures

application for the grant of the aid in accordance with the limit laid down in article 3 (2).

(c) a copy of the statement of work) and documents relating to salary and to the other

the cost of the approved applicants, related with the accompanying

measures and



(d)) a copy of the bank account statement in accordance with § 3 (1). 4 (b). (b))

proving the payment of the invoices for the accompanying measures referred to in subparagraph (b)). ".



24. In footnote No 14, the words "annex III" shall be replaced by

"Article. 14 and annex III ".



25. in § 5 para. 2, after the word "each" is inserted after the word "essential" and

the word "fruit" with the words "and vegetables".
