DECREE



of 22 March. October 2008,



amending the Decree of the Ministry of industry and trade no. 328/2000

Coll. on the method of making certain types of prepacked goods whose

the quantity is expressed in units of mass or volume



The Ministry of industry and trade shall determine in accordance with section 27 of Act No. 506/1990

Coll. on metrology, as amended by Act No. 121/2000 Coll. and Act No 137/2002

Coll. (hereinafter the "Act") to implement section 9a, paragraph 2. 2 and 3 of the Act:



Article. (I)



Decree No 328/2000 Coll., on the way in the making of some types of cash

packaged goods, the quantity of which is expressed in units of weight or

volume, is amended as follows:



1. in article 1, paragraph 1, including footnote No 1 is added:



"(1) this Decree incorporates the relevant provisions of the European

Community ^ 1) and lays down requirements for the making prepackages,

that apply if the importer or packer intends to prepackaged

the item of their choice to indicate the symbol "e". This Decree shall apply

on the combination of the products and of the individual containers in which the products are

cash wrapped, (hereinafter referred to as "prepackages") and are intended for sale in the

constant unit nominal quantities which



and are equal to the values specified) in advance of the Packer,



(b)) are expressed in units of weight or volume and



(c)) are not less than 5 g or 5 ml and not more than 10 kg or 10 l.

2. In article 1 (1). 2, after the word "goods", the words "and prepackages" and

the words "that meets" are replaced by the words "to fulfil".



3. in article 3, after paragraph 2, insert a new paragraph 3, including notes

footnote 2a is added:



"(3) in the case of aerosol dispensers ^ 2a) shall indicate the nominal total volume

of the container, and this information needs to be in such a manner that it cannot

can be confused with an indication of the nominal volume of the contents. Products that are

sold in aerosol dispensers need not be marked with the nominal

the weight of your content.



2A) of Decree-Law No 192/2001 Coll., laying down technical

requirements for aerosol dispensers, as amended. ".



The former paragraph 3 shall become paragraph 4.



4. in article 3, the following paragraph 3a is inserted:



' section 3a



(1) the liquid products listed in point 2 of annex 3 to this Decree,

that are pre-packed in the margins referred to in point 1 of the annex No 3

This Decree, may be put into circulation only if they are packed in cash

in the nominal quantities listed in point 1 of annex 3 to this

the Decree. This also applies to individual prepackages, if offered for sale

on the market as a group package consisting of two or more individual

prepackages.



(r3 in the case of the prepackage consisting of two or more

individual packages which are not intended to be sold individually, the

nominal quantities listed in point 1 of annex 3 to this Decree for

the finished package.



(3) the provisions of paragraph 1 shall not apply to products that are sold

in the tax-free shops and are intended for consumption outside the European

Union. ".



5. After annex No. 2, annex 3, including notes below

line no. 5 to 12 as follows:

THE PERMISSIBLE NOMINAL QUANTITIES OF CONTENTS OF PREPACKAGES



This annex lays down the permissible nominal volumes of the contents for the complete

packages containing liquid products.

2. PRODUCT DEFINITION

Silent wine wine, as defined in the applicable legislation of the European communities directly ^ 5) and referred to

nomenclature (CN) code ex 2204 in directly applicable provisions of the European

Community ^ 6).

Yellow wine wine, as defined in the applicable legislation of the European communities directly ^ 7), referred to

nomenclature (CN) code ex 2204 in directly applicable provisions of the European

Community ^ 6) and with designation of origin: "Côtes du Jura", "Arbois", "L ' Étoile"

and "Château-Chalon" in bottles as defined in the applicable provisions of the European right

Community ^ 8).

Article. (II)



Regulation (EEC)



Shall be repealed:



1. Decree No 329/2000 SB., about how the making prepackages

by volume for liquid products.




2. Decree No. 337/2000 Coll., laying down a series of nominal

weight and nominal capacities permitted for certain kinds of cash

packaged goods.
