Amending Decree no. 541/2005 Coll., On Market Rules
electricity pricing principles for activities of the electricity market operator
and execution of certain other provisions of the Energy Act
Energy Regulatory Office (the "Office"), pursuant to § 98 paragraph. 7
Act no. 458/2000 Coll., On business conditions and public administration
in the energy sectors and amending certain laws (
energy Act), as amended by Act no. 670/2004 Coll., and pursuant to Article. II, section 18 of Act No.

Article I
Decree no. 541/2005 Coll., On Electricity Market Rules and principles of pricing
Market Operator, electricity and execution
certain other provisions of the Energy Act, is amended as follows:
First In § 2 para. 1, at the end of the text of letter i) the words "for the territory
entire state and thirty regional average daily temperatures for each
business days for the region of typical".

7th In § 5 para. 9, first sentence reads: "Payment for electricity transmission and
payment for the electricity distribution consists of payments for the use of networks
payment for reserved capacity and in the case of distribution of electricity as well as a payment for
exceeding booked capacity. ".
8th In § 5, at the end of paragraph 10, the sentence "If there is a change

Balancing market with regulating energy

Rounding actual values when calculating deviations
(1) Deviations of clearing entities are evaluated in MWh with a resolution of 1
decimal place.
(2) The actual value of the undertaking cleared entity

(3) Electricity prices under paragraph 2 is used to determine the settlement price
according to § 25 par. 2 and are included in the evaluation system and clearing
deviations.
(4) The TSO provides the overall costs associated with the solution
state of imbalance between contracted and actually implemented
supply and consumption of electricity for each trading hour
amount of electricity as referred to in paragraph 2 and in MWh their prices
CZK / MWh and shall forward this information to the market operator by 11.00 pm on the first working day following

"§ 25
Clearing and financial settlement of imbalances
(1) Clearing and financial settlement of imbalances conducted by the market operator
provide the electricity market participants, payment of electricity, which was
delivered to the grid or removed from the power system
beyond the agreed amount, or not
delivered to the electricity system or been removed from the electricity grid, despite being in
contracts negotiated.
(2) Settlement prices for individual trading hours provides market operator
based on electricity prices according to § 24 paragraph. 2. The method of account creation
Prices is given in Annex no. 5 hereto.
(3) The market operator determines for each trading hour
additional costs for electricity utilized by the TSO for balancing
system imbalance. These additional costs are defined as the positive difference between the total
electricity costs according to § 24 para. 2 in the respective trading hour
absolute value of the product of system imbalance and settlement
prices. If this difference is negative, the additional costs are zero.
(4) For all hours, when there is a positive difference between the absolute value
product of system imbalance and settlement price and electricity costs
according to § 24 para. 2 is a summary of these differences for a given calendar month || | reclassified market operator TSO

costs of deviations and electricity costs according to § 24 paragraph.

provision of system services in accordance with a special legal
regulation which establishes the procedures for price regulation in the energy-20a).
(6) Based on the settlement of imbalances conducted for each subject
settlement in each trading hour, the market operator shall determine the amount of payment

(7) Every working day to 14.00 hours notify the market operator subject

(8) After the end of the billing period, which is 1 calendar month

issue a tax receipt for the entire billing period, if applicable added tax on the value
output market operator or the basis for the tax document

Settlement payments is secured by the market operator
least once per calendar month.
(9) In the event that a settlement entity fails to pay debts owed
market operator within their maturity, market operator applies to their
payment of funds from the financial security payments, in the manner specified
agreement on settlement of imbalances. If the entity
showdown is contrary to the agreement on settlement of imbalances, may
market operator to cancel the registration.
(10) Cancellation of registration pursuant to paragraph 9 publishes market operator

24th V § 26 paragraph 4 reads:
"(4) in the special mode of settlement for evaluation and settlement of imbalances
are contracted amounts of electricity for the obligation to supply power to the electricity grid and
agreed amount of electricity for the commitment to remove | || electricity from the power system of clearing entities determined in accordance with § 12 paragraph
. 4, including electricity provided by the TSO
according to § 24 para. 2, zero. ".
25th in § 29 paragraph. 1, letter d) reads:
"d) information on complaints raised by participants in the electricity market
to the market operator."

"§ 30

c) final customer transition from one supply point to another
supply point in a different distribution system
d) change of supplier last resort for another supplier, or
e) in the case of an electricity market participant in the household or small
customer change over to a supplier of last resort ^ 23).
(2) Prior to the first changing suppliers administered electricity market participant at
respective transmission or distribution system
request for a new contract on connections, not later
a) 8 working days prior to the change of supplier, the case
a change of supplier at the supply point measurement type a or b;
change of supplier takes place the first day of the calendar month

(3) Following the conclusion of a new contract for connection in accordance with paragraph 2

(4) Paragraph 2 shall not apply to associated delivery points
electricity generating plants. Furthermore, does not apply to customers' supply points, which was
connected to the transmission or distribution system after January 1, 2002.
(5) Prior to switching suppliers, at least in terms pursuant to paragraph 2
administered electricity market participant at the respective operator's transmission and distribution system
request to contract for electricity transmission or distribution of electricity
with appurtenances pursuant to Annex no. 1 or 2

(6) Request for contracts for electricity transmission or distribution of electricity
referred to in paragraph 5 is not served if such a contract between the parties concerned
electricity market is already closed.
(7) In the case of the first change suppliers already connected with the transfer
place of electricity generating plant or point of an end customer, which
was connected to the transmission or distribution system after January 1, 2002, and the final customer
already has an offtake agreement concluded instead of
electricity transmission or distribution of electricity, given market participant
relevant electricity transmission or distribution system
application for registration of transfer or supply points
later than the deadlines by paragraph 2.
(8) Prior to the first change of supplier, but not later than 3 working days from the date of delivery
request to conclude a connection agreement under paragraph 2
contract for transmission or distribution of electricity in accordance with paragraph 5, or complete
application for registration of supply point under paragraph 7
registers the transmission or distribution system operator with
market supply points of the electricity market participant.
(9) The transmission or distribution system enters into a
electricity transmission or distribution of electricity within 3 working
days of receipt of a complete application under paragraph 5.
(10) Prior to switching suppliers, at least four working days after the deadlines
pursuant to paragraph 2 shall conclude the electricity market participant a new supplier
electricity supply contract. By the same date given by the new supplier
market operator the request of any modifications to the supplier, which contains the following information from
contract:
A) the identification and registration number of the new supplier,
B) the type of contract for the supply of electricity, the date from which the supply is effected
(the "effective date of the change of supplier") and duration
contract
C) the supplier's obligation to assume responsibility for Deviations participant
electricity market or consent cleared entity responsible for
difference as supply points for which the delivery was made,
D) list and identification of supply points.
(11) No later than one business day after the request under paragraph 10

(12) If the data transmitted pursuant to paragraph 11 are complete, the operator may

The first delivery of electricity to the newly established supply point
(1) Not later than 30 calendar days prior to the requested date of commencement
transmission or distribution of electricity shall electricity market participant,
which has a contract for connection to the appropriate operator
transmission or distribution system a request for
electricity transmission or distribution of electricity under § 5 para. 2,
A) the supplier if the electricity supply realized on the basis
contract under § 7 para. 1 point. d) or under § 7 para. 1 point. a) point

B) other participant in the electricity market, where supply of electricity
held under a contract; while the market participant
inform the operator of the electricity transmission or distribution system
which vendor will supply the newly established outlet.
(2) In the event that new supply point will deliver supplier
which is not part of a vertically integrated company whose
part of the distribution system operator, to which the new
supply point is connected, register
transmission or distribution system supply point for the market operator within 10 working
days of receipt of a complete application pursuant to paragraph 1
(3) Not later than four working days prior to the transmission or distribution of electricity
closes the electricity market participant and supplier
contract for electricity supply.
(4) In the event that new supply point will deliver supplier
which is not part of a vertically integrated company whose
part of the distribution system operator, to which the new
supply point is connected, served supplier no later than four working days before the start
transmission or distribution of electricity market operator
request for initiation of deliveries to the supply point (hereinafter referred to as "start
deliveries"), which contains the following data from the concluded agreement: | ||
A) the identification and registration number of the supplier,
B) the type of contract for the supply of electricity, the date from which the supply is
take place, and duration of the contract,
C) the supplier's obligation to assume responsibility for Deviations participant
electricity market or the consent of the subject of settlement with
taking over responsibility for deviation for supply points for which delivery will be carried

(5) Not later than one business day after the request under paragraph 4 passes
market operator request for initiation of delivery to the transmission system or the relevant
DSOs to

(6) If the data transmitted pursuant to paragraph 5 is complete, the operator may
