Amending Decree no. 365/2009 Coll., On the gas market rules
Energy Regulatory Office pursuant to § 98a paragraph. 2 point. i)
Law no. 458/2000 Coll., On business conditions and public administration in
energy sectors and amending certain laws (Energy Act)
amended by Act no. 158/2009 Coll .:
Art. I
Decree no. 365/2009 Coll., On the gas market rules, as follows:
First In § 1, paragraph 3 is deleted.
Second In § 2 para. 1, letter b) reads:
"B) financial security - securing the obligations of a financial nature
gas market participant arising from business relations with the operator
market or distribution system operator".
Third In § 2 para. 1 at the end of the text of letter j) the words "in
calendar year, assuming normal weather conditions."
Fourth In § 2 para. 1 letter r) reads:
"R) storage capacity - the amount of traffic of all or part of the virtual
m3 gas storage, extraction or injection rate in m3 / day or production or injection
curve m3 / day."
Fifth In § 2 para. 1, letter t) reads:
"T) normal climatic conditions - the average daily temperature of
years 1971 - 2000 for the gas created by the Czech Hydrometeorological Institute
calculated from data of all measuring stations of the Czech Hydrometeorological Institute
lying to an altitude of 700 m n.
m., ".
6th In § 2 para. 2 at the end of subparagraph p) is replaced by a comma and subparagraphs
q) to t), added:
"Q) the planned annual gas consumption - gas consumption value obtained from historical
actual subscriptions gas, adjusted for the effect of temperature,
determined in accordance with Annex no. 10 hereto,
R) real climatic conditions - the average actual daily
air temperature in the Czech Republic for individual trading days
which is calculated from data of all measuring stations of the Czech Hydrometeorological Institute
lying to an altitude of 700 m n.
m.,
S) Restated annual gas consumption - gas consumption value obtained from actual subscriptions
gas converted to a 365-day period pursuant to Annex
no. 10 hereto,
T) planned monthly consumption of gas - monthly value of gas consumption
agreed in the contract for the distribution of gas. ".
7th In § 4, at the end of paragraph 1 the phrase 'gas market participant
or foreign natural or legal persons who are not parties
settlement, negotiated transporting gas to the border point. ".
8th In § 5, paragraph 1 reads:
"(1) Under a contract on gas transmission allows the operator of the transmission system

standard firm transmission capacity, daily firm transmission capacity, standard interruptible transmission capacity
daily interruptible transmission capacity | || firm coordinated transmission capacity on a day or
firm uncoordinated transmission capacity on a day.

10:00 am prior to the shipment.
Transmission system operator evaluates the request to conclude a contract on gas transmission
and if a positive evaluation send a draft contract for gas
applicant for a contract within 5 working days from 16:00

9th In § 5 para. 2, the first sentence is replaced "Reservation Request
standard transmission capacity, daily transport capacity and transport
capacity on a day electronically filed.".
10th In § 5, at the end of paragraph 3 the phrase "Carrying capacity in
scheme for the following day is reserved for border points.".
11th In § 5, paragraph 4 reads:
"(4) Transportation of gas at the reservation of the standard transmission capacity
launches first gas day of the calendar month for which the transmission capacity is reserved

reserve transmission capacity and the other gas month than the gas
month immediately following the month in which the reservation

"(6) Fixed coordinated transmission capacity on the following day

Former paragraphs 6 to 8 shall be renumbered 8 to 10
13th Under § 5, the following § 5a is inserted:
"§ 5a
(1) Long-term contracts on gas transmission with firm transmission capacity
agreed with the TSO gas market participant
or foreign natural or legal person for a single entry and exit border
point transmission system for the period at least 10 years.
Minimum size required long-term firm transmission capacity is 10
000 MWh / day.
(2) Reservation of long-term firm transmission capacity is only possible in the
above, in which the sum of all other capacities
reserved for a period longer than 10 years will not exceed 65% of the technical capacity of the corresponding input
or exit border point, in every
time period required reserve capacity.
(3) The applicant shall submit the request for a long-term firm transmission capacity
TSO earliest 24 and at least 3
calendar months before the first gas day of the calendar month in which to
gas transmission started. The TSO
evaluate all applications received during the preceding calendar month
on the 15th day of the calendar month for which the term application delivery

(4) The transmission system operator shall notify the applicant
reservation required long-term firm transmission capacity throughout

16th In § 6, the following paragraphs 5 and 6 are added:
"(5) Request for booking firm transmission capacity on

25th In § 11, paragraph 8 shall be added:
"(8) The distribution capacity for supply points of customers can not be
booked with insufficient financial security of the applicant, if the application
booking distribution capacity does not meet the established requirements,
not submitted within the specified deadline or applicant failed to amend or
failed modification request submitted by 14:00 pm next working day after the notice
distribution system operator indicating
required adjustments. ".
26th In § 12 para. 1 and 2, the words "A or B," the words "for
customer's supply point, which is situated in the low offtake category,
is equipped with measurement type A or B and which are carried out properly
monthly readings, or for delivery points between distribution systems
".
27th In § 12, the following paragraph 4 is added:
"(4) The distribution system will change the reserved
distribution capacity for delivery between distribution systems

28th In § 13 par. 3, the words "maximum daily distribution capacity"
replaced by "dvacetičtyřnásobek secured hourly capacity".
29th In § 16 para. 4 at the end of the text in subparagraph d) the words "

30th In § 17 para. 1 second sentence deleted.
31st In § 17 para. 2 of the introductory part of the provision reads:
"The underground gas storage
public in a manner allowing for remote access not later than 30 calendar days before the beginning
multi-round auction, and earlier than 12 months before the first
gas day immediately following storage year for which
annual storage capacity with fixed capacity booked,
conditions of the auction for free storage capacity. Conditions
auction must be reasonable, non-discriminatory and transparent. Terms of the auction include ".
32nd In § 17 par. 2 letter a) reads:
") Minimum price per unit of storage capacity for the first storage
year and the method of calculating prices for other storage years after the reservation time
storage capacity."
33rd In § 17 para. 8, the words' by CZK 0.02 to CZK 0.05 per 1 m3

49th Under § 42 the following § 42a, including the heading reads:
"§ 42a
Unused Tolerance Market
(1) The market operator organizes unused tolerance market and allows
registration of bilateral unused tolerance transactions.
(2) If the unused tolerance opposite sign system

(3) Unused Tolerance Market runs from the eleventh day of the calendar month
from 12:00 hours to 10:00 hours the following calendar day
for all gas days of the preceding calendar month.
(4) The market operator will announce the results unused tolerance market at 11:00 pm
twelfth day of a calendar month. After the announcement of the results of market
unused tolerance to individual subscribers will publish the market operator
manner enabling remote access, supply and demand curves

(5) The registration of bilateral transactions with unused tolerance

50th In § 44 para. 1 point. b) and paragraph. 2 point. b) the word "values"

market disagreement with the results of the preliminary evaluation of imbalances for the preceding gas day
pursuant to paragraph 1. a) to c) and § 44 paragraph

62nd In § 52 paragraph 3-14 added:
"(3) 12 months before the change of gas supplier and the latest
tenth working day until 10:00 pm before the desired date change
gas supplier delivers new gas supplier request to change the standard
gas supplier to the operator market. In the event that the new gas supplier
ensures delivery under the contract on bundled gas supply services,
a request for distribution capacity booking under § 11

Transitional provisions
First In evaluating the application for the reservation of standard and daily transmission capacity
filed before the effectiveness of this Decree shall be governed by
existing legislation.
Second The provisions of Decree no. 365/2009 Coll., As amended by this Decree, the

Third The transmission system operator transferred on 1 January 2011, all
reserved transmission capacity with the exception of reserved transport capacities
customers directly connected to the transmission system and transport
capacity reserved for a pair of input and output boundary point of the unit m3

listed in Annex no. 14 of Decree no. 365/2009 Coll., as amended by this ordinance.
Fourth If after the effective date of this decree renegotiated contract on gas transmission
concluded prior to the effective date of this decree, which
amend the agreed reserve transmission capacity for a pair
input and output boundary point on the reservation of transmission
capacity separately for entry and exit border point transmission system converts
TSO effective date of such change
contract for gas reserved transmission capacity of the unit
m3 / day thousandth MWh / day using gross calorific value specified in Annex no.
14 of Decree no. 365/2009 Coll., as amended by this ordinance.
Art. III
Efficiency
This decree comes into force on 1 January 2011, except for paragraphs 22,
23, 63, 65 and 67, which come into effect on July 1, 2011, and points
44, 45, 49 and 61, which come into effect on 1 January 2012.
