amending Act No 99/2004 Coll., on fish farming, the performance of the fishing
rights, Fisheries Guard, protection of marine fishery resources and amending
Some laws (Act on fishery), as amended, and
Act No. 200/1990 Coll. on offences, as amended
Parliament has passed the following Act of the United States:
PART THE FIRST
Fisheries (Amendment) Act
Article. (I)
Act No. 99/2004 Coll., on fish farming, fishing, fishing rights performance
Guard, protect the marine fishery resources and on amendments to certain laws
(Act on fishery), as amended by Act No 444/2005 Coll., Act No.
267/2006 Coll., Act No. 124/2008 Coll., Act No. 41/2009 Coll., Act No.
228/2009 Coll., Act No. 281/2009 Coll., Act No. 104/2010 Coll., Act No.
375/2007 Coll. and Act No. 18/2009 Coll., is amended as follows:
1. in section 20, the following paragraph 3 is added:
"(3) the local authority of ORP hears misdemeanors (§
30) and administrative offences (§ 31). ".
2. in section 21 para. 2 g) repealed.
Letter h) is renumbered as paragraph (g)).
3. in section 30 paragraph 2. 1 at the end of the letter h) dot is replaced by a comma and
the following letter i), which read as follows:
"even) illegally catching fish.".
4. in section 30 paragraph 2. 6 for the second sentence is added to the sentence "for the offense under
paragraph 1 (b). I) fined up to 8 000 CZK; for this, you can
also save the ban to one year. ".
5. in § 31 para. 8, the words "the scope of the delegated region are income
the competent region "shall be replaced by the words" municipal authority of the municipality with extended
competencies are the income of municipalities with extended powers ".

1. the title of section 35 is "Offences in the field of agriculture and wildlife management".
2. In section 35 para. 1 (b). (c)), the words "for the protection of agricultural land
the Fund, about hunting or fishing "shall be replaced by the words" for the protection of
agricultural land resources or about hunting ".
3. In section 35 para. 1 (b). f), the words "or catching fish" are deleted.
PART THREE
TRANSITIONAL PROVISIONS
Article. (III)
1. the procedure for offences or other administrative offences in the area of
fisheries pursuant to Act No. 99/2004 Coll., or Act No. 200/1990 Coll., on
the version in force until the date of entry into force of this law, which has not been
finally completed before the date of entry into force of this Act,
completes in accordance with the existing legislation.
2. The proceeds of the fines imposed on the fishing of the guard or the delegated region
scope of Act No 99/2004 Coll., in the version in force before the date of application
the effectiveness of this law, the income of the relevant region.
PART FOUR
The EFFECTIVENESS of the
Article. (IV)
This Act shall take effect on the first day of the second calendar month
following the date of its publication.
