Government directs pursuant to § 2b par. 2 Act no. 252/1997 Coll., On
agriculture, as amended by Act no. 128/2003 Coll., Act no. 441/2005 Coll. and
Act no. 291/2009 Coll., § 1 par. 3 of Law no. 256/2000 Coll., on
State Agricultural Intervention Fund and amending certain other
laws (the State Agricultural intervention Fund), as amended
Act no. 441/2005 Coll. and Act no. 291/2009 Coll .:

§ 1
Subject Matter


This regulation governs in response to a directly applicable regulation
European Union ^ 1) (hereinafter "the European Union")
certain conditions for providing special aid under EU regulations governing
rules for direct support schemes ^ 2), which are provided
farmers (hereinafter referred to as "payment of the special aid ')
State agricultural intervention Fund (the" Fund ").

§ 2

Request for payment of the specific aid

(1) The Fund shall provide special support payment under § 1, upon request
at

A) potato starch

B) hops

C) calf meat type,

D) ewes or goats grazing on grassland or

E) cows kept in the system to market milk production.

(2) The application for the payment of special aid must be delivered to the Fund
it form issued by 15 May of the year for which payment is requested
(hereinafter "the calendar year").

(3) The application for the payment of special aid apart
requirements laid down by administrative rules and regulations of the European Union ^ 3) contains

) Listing and acreage of land parcels according to § 3a par. 3 of the
agriculture, or parts of land blocks according to § 3a par. 4 of the

(4) An application under paragraph 2 does not bring the Fund commencing on April 1
2015.

§ 2
Compensation of financial discipline


(1) According to the EU regulations governing the financing, management and monitoring
common agricultural policy ^ 31)
respective calendar year for the compensation of financial discipline
calendar year an application for payment of special support.

(2) Compensation of financial discipline is carried out by the applicant for payment
specific support for which the Fund was an adjustment payments
specific aid granted on the basis of the payment request special support
filed in the calendar year.

(3) The percentage of the compensation fund provides financial discipline
ratio of the amount notified by the European Commission to the sum of the amounts of adjustments
specific support payments made in the calendar year in
applicants pursuant to paragraph 2.

(4) The Fund provides applicants for payment of the specific aid decision
amount of compensation of financial discipline by multiplying the percentage of compensation
financial discipline in accordance with paragraph 3 of the amount of payments adjustments
special aid given to the applicant in the calendar year and performs | || payment of compensation to financial discipline, October 16
calendar year following the application for payment of the special aid in the respective
calendar year.

§ 3

Special aid for potato starch

(1) An applicant for the payment of special aid for potato starch
may be a natural or legal person managing
farmland as recorded in the register at her as arable land under § 3i
point. a) Agriculture Act.

(2) The request for payment of the specific aid for potato starch
a


A) a contract for the cultivation of potatoes for starch or its copy
done by the applicant for the payment of special aid for potato starch
with starch manufacturer for the marketing year

B) confirmation of the participation of the applicant for the payment of special aid
potato starch for the vocational training in the relevant calendar year
held Central Control and Testing Institute of Agriculture
conditions for the cultivation of potatoes for potato starch
set out in Annex no. 1 hereto,

C) list and acreage of land parcels or parts of land blocks, which are
filed a request for payment of special aid for potato starch
concerned

D) mapping of soil blocks or parts of blocks in the soil under subparagraph
c) map soil blocks or parts of blocks of soil, scale 1: 10
000 or more detailed,

E) recognition certificate ^ 7) the recognition of varieties of potatoes.

(3) Minimum acreage ^ 8), which may receive a payment
special aid Potato starch is at least 1 ha of arable land on
which are growing potatoes for starch production;
critical data is recorded in the register.

(4) The Fund shall give the applicant the payment of special aid for potato starch
to the area of ​​arable land, which is

A) registered in the records and meets the conditions for granting payments under this Regulation
government

B) registered in the register of applicants for a minimum of receipt
Fund 31 October of the calendar year,

C) the applicant farmed in the calendar year
throughout the period during which it registered in the records on applicants by letter and

D) maintained in conditions of good agricultural and environmental condition
listed in Annex no. 2 to Government Decree no. 309/2014 Coll., On
determining the consequences of a breach of the Provision of Certain
agricultural subsidies throughout the relevant calendar year

E) maintained by the conditions of cultivation of potato starch
listed in Annex no. 1 hereto 31 October of the calendar year
.

(5) The Fund shall give the applicant the payment of special aid for
potato starch for the area of ​​arable land on which they grow potatoes for
potato starch, in accordance with paragraph 4 of the full amount if the applicant
on the payment of special aid potato starch
meets the conditions laid down in this Regulation and throughout the calendar year
complies with the conditions of good agricultural and environmental condition
specified in Annex no. 2 to Government Decree no. 309/2014 Coll., on the consequences of the breach

according to regulations of the European Union ^ 1) or under § 8

§ 4

Special aid to hop

(1) An applicant for the payment of special aid for hops may be
natural or legal person managing agricultural land that is
that person in the register as a hop field under § 3i point. d)
law on agriculture and on it hops grown aromatic variety
referred to in terms of growing hops specified in Annex no. 3 to
hereto.

(2) The request for payment of special aid for hops is

A) confirmation of the participation of the applicant to provide specific aid payments to
hop on vocational training in the relevant calendar year, held

conditions for growing hops specified in Annex no. 3 to this regulation

B) a list and acreage of land parcels or parts of land blocks, which are
filed a request for payment of special aid for hops concerned

C) plotting soil blocks or parts of blocks in the soil under subparagraph
b) the map in soil blocks or parts of blocks of soil, scale 1: 10
000 or more detailed.

(3) Minimum acreage ^ 8), which may receive a special payment
aid for hops, is at least 1 hectare of hop garden;
critical data is recorded in the register.

(4) The Fund shall give the applicant the payment of special aid to hop on hop
which is

A) registered in the records and meets the conditions for granting payments under

This Regulation

B) registered in the register of applicants for a minimum of receipt
Fund until the end of the calendar year,

C) the applicant farmed in the calendar year
throughout the period during which it registered in the records on applicants by letter and
)

D) maintained in conditions of good agricultural and environmental condition
listed in Annex no. 2 to Government Decree no. 309/2014 Coll., On
determining the consequences of a breach of the Provision of Certain
agricultural subsidies throughout the relevant calendar year

E) maintained under the terms of hop growing in Annex no. 3 to this Order
throughout the whole calendar year.

(5) The Fund shall give the applicant the payment of special aid to hop on hop garden acreage
, which is grown hops, pursuant to paragraph 4 in full
if the applicant for the payment of special aid for hops meets
conditions laid down in this Regulation and throughout the calendar year
complies with the conditions of good agricultural and environmental condition set out in Annex
no. 2 to Government Decree no. 309/2014 Coll., on the consequences of the breach of cross
provision of certain agricultural aid
barring the fact leading to the reduction or withholding
payment of special aid for hops European Union regulations ^ 1), or pursuant to § 8


§ 5

Special aid for calf meat type

(1) An applicant for the payment of special aid for calf meat type
may be a natural or legal person with the economy
registered in a central register kept by the Breeding Act ^ 10)
(hereinafter " central register ") reported the birth of a calf meat type
in the period from April 1 of the year preceding their application by 31 March
relevant calendar year.

(2) Mother of the body to which the request for payment
provide specific support for calf meat type, the cow must be kept in the system
suckler according to EU regulations laying
establishing common rules for direct support schemes under the common
agricultural policy and establishing certain support schemes for farmers
^ 11), while the father must be a bull calf beef cattle breed
registered in the central register of sires ^ 12); List
meat breeds of cattle are defined in Annex no. 4 to this Regulation.

(3) A request for payment of special aid for calf meat type
is a list of calves under paragraph 1, including their
identification numbers and dates of birth, identification number of mothers with
indication of their breeding system In terms of market milk production
designation by the father of a central register of sires ^ 12) and the calculation of large
livestock units; conversion factor to determine the number of large livestock units
to pay for calf meat type is specified in Annex No.
. 5 hereto.

(4) The Fund shall give the applicant the payment of special aid for calf meat type
the total number of livestock units, set the number
calves born during the period specified in paragraph 1, based on the data referred to in paragraph 3
if the total amount of direct payments that were
applied or to be granted before the reductions and
exclusion from payments in a given calendar year is less than 100 EUR 8 ^).

(5) The Fund payment of special aid for calf meat type fails to
meat type calf whose mother is a cow, which is in the same calendar year
required payment of the special aid for cows kept in the system

(6) The Fund will pay special aid for calf meat type

§ 6

Special support ewe or goat grazing on grass stands


(1) An applicant for the payment of special aid for ewes

Or goats grazing on grassland registered to the applicant
records may be natural or legal person breeding and waist
ewes or goats for EU regulation laying down common rules
for direct support schemes under the common
agricultural policy and establishing certain support schemes for farmers
^ 13), grassland ^ 14), the minimum period from 15 May to 11 September
respective calendar year for the economy
registered in a central register.

(2) The applicant for the payment of special aid for the ewe or
goats grazing on grassland is required during the period specified in paragraph 1
day lead a period of 5 years from the date of submission of the application store || | grazing record containing information which indicates

A) the identification number of grazing ewes or goats; if the applicant
waist all the ewes or goats from the barn or farm
registered in a central register is sufficient to record a grazing place
identification numbers of ewes or goats, indicate the number of stables or registration number

B) identification number of a land block or its part,
utilized in a given calendar day for grazing, while if the ewe or goat
, grazed in one calendar day for more land blocks, indicate | || identification numbers of all these soil blocks

C) the date of grazing ewes or goats grazed on grasslands.

(3) A request for payment of special aid for ewes
or goats grazing on the grasslands is a list of ewes
or goats, in accordance with paragraph 1, including their identification numbers and dates of birth
or the date of registration in the central records, and
calculation of livestock units;
conversion factor to determine the number of livestock units for payment of the ewe,
or goats grazing on grassland is set out in Annex no. 5
hereto.

(4) The Fund shall give the applicant payment of the ewe or goat,
grazing on grassland on the total number of livestock units
set by the number of farmed and grazed ewes or goats, on the basis of data
pursuant to paragraph 3, the condition for the payment of at least 2
livestock units and the total amount of direct payments
the amount claimed or due to be granted before the application
reductions and exclusions from payments in a given calendar year, at least EUR 100
^ 8).

(5) The Fund will pay special aid to the ewe or goat
grazing on grassland in full if the applicant meets
conditions laid down in this Regulation and throughout the calendar year complies with the good agricultural conditions
and environmental conditions set out in Annex
no. 2 to Government Decree no. 309/2014 Coll., on the consequences of the breach of cross
provision of certain agricultural subsidies and
barring the fact leading to the reduction or withholding | || payment of special aid for the ewe or goat grazing on grass
stands by the regulations of the European Union ^ 1), or pursuant to § 8

§ 7

Special aid for cows kept in the system with suckler

(1) An applicant for the payment of special aid for cows kept in
system of dairy is a natural or legal person who keeps cows
system to market milk production (hereinafter referred to as "cow") to
economy registered in the central register on 31 March
relevant calendar year.

(2) The request for payment of special aid for cows
behavior in the market milk production is

A) a list of dairy cows held by the applicant on 31 March of
calendar year, including the identification numbers and dates of birth, or
date of registration in the central register, breeding system
terms of market milk production and calculation livestock units;
Conversion factor to determine the number of livestock units
for payment to dairy cows is stipulated in Annex no. 5 to this Regulation

B) evidence for determining the share of milk showing the share of income or
revenue from sold milk in the total income, or revenue from agricultural production
according to § 2e para. 3 point. a) to e) of the Act on agriculture

Calendar year preceding the date of application;
to the total income or sales do not count income or revenue from facility operations
processing of biomass to produce energy and fuels from renewable sources
, subsidies and compensation for the damage event in the calendar year preceding the date
application ,

C) copies of documents proving the sale of milk purchasers for the calendar year
preceding the date of application.

(3) In the event that the applicant produces and sells dairy products from milk produced by cows
applicant shall be regarded as
dairy milk sold pursuant to paragraph 2. b) a calculation of income or sales
are based on data from monthly reports on direct sales of milk by
Government Decree no. 244/2004 Coll., laying down detailed conditions for the application
levy on milk and milk products under the common market organization
milk and milk products, as amended
regulations, through the conversion of dairy products
equivalent amount of milk in accordance with Annex Government Decree no. 244/2004 Coll

detected by the Czech statistical Office for the calendar year preceding the year of application

(5) The Fund shall determine the rate on the payment of special aid for cows kept in
system with suckler

A) in full, if the share of income or revenue from sold milk to
total income, or revenue from agricultural production pursuant to paragraph 2
point. b) and paragraph 3 of the calendar year preceding the date of filing the application
is greater than or equal to 30% and, barring the fact
leading to reduction or withholding payment of the special aid
cows kept in the system with suckler according to the regulations of the European Union
^ 1) or § 8, or

B) half the amount if the share of income or revenue from sold milk to
total income, or revenue from agricultural production pursuant to paragraph 2
point. b) and paragraph 3 of the calendar year preceding the date of filing the application
is greater than or equal to 15% and less than 30% and barring
fact leading to the reduction or withholding payments
special aid for cows kept in system with suckler
according to regulations of the European Union ^ 1), or pursuant to § 8

(6) The Fund shall provide payment of the specific aid for cows kept in the system
dairy, when the total number of livestock units
at least two livestock units if the total amount of direct payments
about amount claimed or due to be granted before
the reductions and exclusions specific support for the cows
behavior in the market for milk production in a given calendar year is less than 100 EUR
^ 8).

(7) The Fund does not provide payment of the specific aid for cows kept in the system
to market milk production per cow,

A) which is in the same calendar year required payment on breeding
cow suckler ^ 15)

B) whose body is in the same calendar year required to pay
specific aid for calf meat type according to § 5.

(8) The Fund shall provide payment of the specific aid for cows kept in the system
dairy in full if the applicant meets the conditions laid down in this Regulation
and throughout the calendar year complies with the conditions of good agricultural and
environmental condition set out in the Annex.

§ 8

Reducing payments or refusing requests

(1) If the Fund that the applicant's application under § 2 did not
any area in accordance with European Union regulations ^ 16) and the difference between the total
area declared and the sum total of the area declared
application and the application is not recognized

A) greater than 3% but less than or equal to 4% of the area declared,
reduce payments by 1% ^ 16)

B) greater than 4% but less than or equal to 5% of the area declared,
reduce payments by 2% ^ 16)

(2) If the Fund that the applicant delivered the request for payment pursuant to § 3-7
after the period specified in § 2, or change applications after the deadline set
EU regulation ^ 17), the payment is reduced or rejects the request
according to EU regulations ^ 17).

(3) If the Fund that the applicant for the payment of special aid
potato starch complied with the terms of cultivation of potatoes for starch
specified in Annex no. 1 to this Order, payment
specific aid for potato starch is reduced or
request for the payment of special aid potato starch
reject the European Union regulations ^ 18).

(4) If the Fund that the applicant for the payment of special aid
hop hop growing complied with the terms set out in the Annex.
3 to this Order, payment of special aid for hops is reduced or || | request for payment of special aid for hops reject
according to EU regulations ^ 18).

(5) If the Fund that the number of livestock units calves for meat
type-born applicants for the payment of special aid for calf meat type
days specified in § 5

A) greater than the number of livestock units referred to in the application for payment
provide specific support for calf meat type, used to calculate the payment
number of livestock units referred to in the application for payment
provide specific support to calf meat type, or

B) less than the number of livestock units referred to in the application for payment
provide specific support for calf meat type, payment reduced

(6) If the Fund that the number of livestock units ewes

(7) If the Fund that the number of livestock units
cows kept by the applicant for the payment of special aid
cows kept in the system with suckler according to § 7 to 31 March

A) greater than the number of livestock units referred to in the application for payment
provide specific support for cows kept in the system with a market
milk production is used to calculate the payment
number of livestock units referred to in the application for the payment of special aid
cows kept in the system with dairy or

B) less than the number of livestock units referred to in the application for payment
provide specific support for cows kept in the system with a market
milk production, reduced payment or request for payment
specific aid for cows behavior in the dairy
reject the European Union regulations ^ 19).


(8) If the fund that a share of revenue, or revenue from sold
milk on total income, or revenue from agricultural production under § 7
paragraph. 2 point. b) and paragraph. 3 for the calendar year preceding the date of filing
application for payment of special aid for cows kept in the system
with suckler according to § 7 (hereinafter referred to as "a share") is

A) greater than or equal to 15% and lower than 30% and the share of income or
revenue from sold milk in the total income, or revenue from agricultural production
under § 7 para. 2 point. b) and paragraph. 3
for the calendar year preceding the date of application for the payment of special aid
cow behavior in the market production of milk in a request for payment
provide specific support for cows kept in the system
market milk production (hereinafter "declared share") is greater than or equal to 30%, reduce

(9) If the Fund cases of irregularities regarding

specific aid for cows kept in the system with suckler
reject the European Union regulations ^ 19 ).

(10) If the Fund cases of irregularities with regard to the system for the identification and registration
ewes and goats, payment of special aid
ewes or goats grazing on grassland, reduce, or || | request for payment of special aid for the ewe or goat
grazing on grassland reject the European Union regulations ^ 20).

(11) Unless the applicant for the payment of special aid
ewes or goats grazing on the grassland during
on-site inspection record of pasture according to § 6 para. 2, or submits a | || record of grazing incomplete Fund applicants specific support for ewes
or goats grazing on grassland fails.

(12) The provisions of paragraphs 1 to 11 do not affect the reduction
and exclusions contained in the legislation of the European Union ^ 1).

§ 9


Payment amount Disclosure
The amount of the payment rates under § 3-7 disclose Fund
later than 30 November of the calendar year on its web site
and at least one national newspaper.

§ 10
Efficiency


This regulation comes into force on 1 March 2012.

Appendix 1


Conditions for growing potatoes for starch production

First The applicant for the payment of special aid for the production of potato starch
must use only certified seed potatoes, and the amount
least 2.2 tons per hectare; the control of this obligation shall submit an invoice for the supply of seed and
recognition leaves ^ 22).

Second The applicant for the payment of special aid for the production of potato starch adheres
crop rotation, which will be potatoes for starch production
repeatedly assigned to the same land block or the same part of the land block
first three years, and keep records of
alternation of crop rotations on these soil blocks or parts of blocks in the soil.

Third The applicant for the payment of special aid for the production of potato starch
ensure that land blocks on which they grow potatoes
starch were manure or organic fertilizer
^ 23).

Fourth The applicant for the payment of special aid for the production of potato starch as a supplement
farmyard and organic fertilizers used
mineral fertilizers in kg of pure nutrients to the maximum amount of benefits
which are listed in Table 1 below.

Fifth The applicant for the payment of special aid for the production of potato starch
may use only listed active substances which are contained in
pesticides permitted for use in the Czech Republic in the appropriate
calendar year at a specified dosage, and are listed in table no. 2 to 4.


6th Each treatment against Colorado potato beetle (Leptinotarsa

Decemlineata), the applicant may provide for the payment of special aid
potato starch use active substances contained in
insecticides approved for use in the Czech Republic in the appropriate
calendar year to the amount of the maximum dose listed in Table .

7th During each treatment potato late blight (Phytophthora infestans)
applicant may provide for the payment of special aid for the production of potato starch
active compound contained in the fungicides approved for use
in the Czech Republic in the calendar year in quantity | || the maximum dose listed in table # 3.

8th The applicant for the payment of special aid for the production of potato starch
not in use herbicides approved for use in the Czech Republic
in the calendar year exceed the maximum dose
active substances listed in Table # 4.

A) only use certified seed recognized hop in health class
"VT" or "VF" ^ 30)

B) when checking submit proof of purchase certified seed
recognized hop in health class "VT" or "VF" (tax document, planting
sheet and equivalency certificate ^ 30)).

Third The applicant for the payment of special aid for hops used
mineral fertilizers in kg of pure nutrients to the maximum amount of benefits,

Which are listed in Table 1 below.

Fourth The applicant for the payment of special aid for hops to protect
hops must be used only listed substances listed in Table no. 2
contained in pesticides permitted for use in the Czech Republic
in the calendar year. The applicant has special support for
hops hops used to protect the concentration of the product on the basis of registered
benefits.

Fifth The applicant for the payment of special aid for hops to protect
hop apply plant protection product with the same active ingredient
more than twice during the growing period of the calendar year
to secure the necessary alternation of different plant protection
plants. This does not apply to plant protection products which are permitted
used only once per growing season
