Establishing detailed conditions for the implementation of measures
common organization of the markets in agricultural products in the field of viticulture and winemaking

agriculture, as amended by Act no. 128/2003 Coll., Act no. 441/2005 Coll. and
Act no. 291/2009 Coll., § 1 par. 3 of Law no. 256/2000 Coll., on
State Agricultural Intervention Fund and amending certain other
laws (the State Agricultural intervention Fund), as amended
Act no. 441/2005 Coll. and Act no. 291/2009 Coll .:

§ 1
Subject Matter


This regulation governs in relation to the directly applicable regulations
European Union (hereinafter "the European Union") ^ 1) detailed conditions at
implementing measures of the common market organization for wine by the Programme
aid in viticulture wineries and the Czech Republic for the years 2014 to 2018.


§ 2

Restructuring and conversion

(1) Request for support for restructuring and conversion of vineyards under European Union regulations
^ 1) provides grower ^ 2), based in the Czech Republic
State Agricultural Intervention Fund ^ 3) (hereinafter || | "Fund") on the form issued by him.

(2) Support can be provided for the following measures:

A) varietal vineyards or

B) transfer of vineyard slope.

(3) The applicant shall commence the implementation of measures pursuant to paragraph 2, including
grubbing up of vines, earlier than four months after the submission of applications to the Fund or before
inspection made by the Fund in accordance with European Union regulations ^ 4).

(4) If the applicant neklučí whole land block or the entire piece of land block
then as an integral part of the application under paragraph 1, the plot
grubbing-up of the scale of 1: 10,000 or more detailed and provide indications
grubbing of the land block or grubbing piece of land block
visible in the field.

(5) The applicant shall deliver the Fund on the form issued by him no later than 30 April
fourth calendar year following the calendar year in which the application
filed notice to take action on all land blocks or
their works specified in the application.
For each application, the applicant will submit only one notification to implement the measures.

(6) In the case of grant of replanting rights to pre ^ 5)
implementation of the measure means the fulfillment of the obligation to grub up an area of ​​vines in
end of the third year after planting new vines for which it was entitled to
replanting be issued.

(7) Support for measures referred to in paragraph 2 may only be granted
if the land block or its part that the measure is implemented,
is registered in the register of land use based on user relations (hereinafter || | only "evidence") to the applicant as a vineyard in accordance with the vineyard register ^ 6)
no later than April 30 of the calendar year in which they were filed
notice to take action under paragraph 5.

(8) Support for measures referred to in paragraph 2 is granted on condition
compliance with the statutory management requirements ^ 7) and requirements
good agricultural and environmental conditions specified in Annex no. 2 to the Government
no. 309/2014 Coll., on the consequences of the breach of cross
provision of certain agricultural subsidies.

(9) Fund of applications for assistance for the measures referred to in paragraph 2
evaluated in relation to the measures taken alone; fulfillment of the conditions is assessed for

vineyard.

(10) The applicant may for restructuring and conversion of vineyards only use
valid replanting rights ^ 8) registered in the vineyard register and
granted under the grubbing up of vines before September 5, 2010 ^ 9) or granted | || after that date under the grubbing up of vineyards made after checking
Fund ^ 4).

(11) If an applicant applies for restructuring and conversion of vineyards only
valid replanting rights granted under the grubbing up of vineyards
before September 5, 2010, or replanting rights of vineyards
checked Fund ^ 4 ) before the grubbing up vines, without following the procedure
pursuant to paragraph 3, the Fund submitted a request before the implementation of measures pursuant to paragraph 2
^ 10). The applicant shall commence the implementation of measures
earlier than 4 months after the application or before the control of the Fund performed on

measures pursuant to paragraph 5.

(12) Notice of the provisions of paragraph 5 shall be delivered to the Fund
later than 30 April 2018.

§ 3

Varietal vineyards

(1) Support for the measure varietal vineyards are paid on
whole land block or component ^ 11) when

A) restructured part of the vineyard from which it comes granted the right to
replanting at a time of grubbing up more than 50%
shrubs vines older than 15 years; in the case of newly acquired vineyards, and it registered
applicant in the register within the 12 months preceding the request
support must be more than 50% of shrubs vines older than 10 years to the year of application
, || |
B) acreage planted area or the sum of the areas thus restructured
vineyards applicant does not fall below 0.2 ha

C) new vineyard is planted with a different variety than the variety of vineyards from which comes
replanting right, and

D) planting is done grape variety ^ 12) registered in the Czech Republic
or in another Member State of the European Union at a number of shrubs
least 3,000 pieces per 1 ha of planted area of ​​vines.

(2) The application pursuant to § 2 para. 1 grower shall

A) land block number or part of which will be used grubbing up vines
replanting right within the application, or the number
land block or its part to be grubbed up on the basis of the award | || replanting rights advance

B) acreage planted area of ​​grubbing up vines registered in the records or portions
this area

C) grubbing variety

D) the method of growing the grubbing up of vineyards and

E) land block number or part, which will be planted new vineyards
.

(3) If the grower planted a new vineyard on a non-grubbing
soil block or component pursuant to paragraph 2. ) and the soil
block or its part is the date of filing the application registered in the register as
vineyards give him a grower in the application area planted acreage
recorded in the records, cultivars and growing method.

(4) The application pursuant to § 2 para. 11 grower shall

.

(5) In case the grower planted a new vineyard on the soil block or
its work pursuant to paragraph 4. b), which is the date of application

(6) If an application using the method of § 2 para. 3

§ 4

Move vineyards uphill

(1) Support for measures to shift the vineyard slope is paid on the entire soil

E) planting shall be carried out on the same soil block or part, of the origin
replanting rights.


(2) The application pursuant to § 2 para. 1 grower shall

A) land block number or part of which will be used grubbing up vines
replanting right within the application, or the number
land block or its part to be grubbed up on the basis of the award | || replanting rights advance

B) acreage planted area of ​​grubbing up vines registered in the records or portions
this area

C) grubbing variety

D) the method of growing the grubbing up of vineyards and

E) land block number or component on which the vineyard moved.

(3) In the event that the land block or its part in accordance with paragraph 2. e)
is the date when the application is registered in the records as a vineyard, give him

(4) The application pursuant to § 2 para. 11 grower shall

§ 5
Investments


(1) The application for support for investment in accordance with European Union regulations ^ 13)
deliver manufacturer-14) with its registered office in the Czech Republic Fund for him
form issued before 31 August of the calendar year.

(2) An application for aid can be given to these new investments:

A) wooden barrel or closed timber vessel for the production of wine of
least 600 liters

B) special fermentation vessel with an active diving grape marc hat
for the production of red wines, or

C) the cross-flow filter wine, wherein wine is fed to the membrane
tangentially and a certain volume of wine passes through the membrane as filtrate, and the remainder continues along
membrane-filtered impurities.

(3) In the application, the applicant shall

A) description of the equipment procured under paragraph 2 and its contribution to boosting business performance
^ 13)

B) in the case of exchange of information of the original equipment, including technical
parameters

C) in the case of exchange of the place where the original device

D) the place where will be located the device, which is required
support, and

E) data on micro, small and medium enterprise ^ 15).

(4) The applicant must undertake the investment soon after filing a request under paragraph 1
^ 10) and delivered to the Fund documents on its payment by 31 January
calendar year following the application.

(5) Replace the original equipment can begin executed only after
inspections to verify the status of original equipment.

(6) The Fund assesses each investment separately.

(7) An application for aid under paragraph 1 shall be delivered to the Fund not later than 31 August 2017.


§ 6
The amount of support


(1) Support for a maximum of 75% of the actual costs
restructuring and conversion of vineyards under EU regulations ^ 16) in less developed regions
^ 17) to measure

A) varietal vineyards makes

First 325 000 CZK per 1 ha of planted area of ​​vines in the event that the number of shrubs
vine exceeds or is equal to 3,000 units per 1 ha of planted area
vineyards

Second 375 000 CZK per 1 ha of planted area of ​​vines in the event that the number of shrubs
vine exceeds 4,000 units per 1 ha of planted area of ​​vines,

Third 425 000 CZK per 1 ha of planted area of ​​vines in the event that the number of shrubs
vine exceeds 5,000 units per 1 ha of planted area of ​​vines, or

Fourth 475 000 CZK per 1 ha area under vines in the event that the number of shrubs

Vine exceeds 6,000 pieces per 1 ha of planted area of ​​vines,

Third 410 000 CZK per 1 ha of planted area of ​​vines in the event that the number of shrubs
vine exceeds 4,000 units per 1 ha of planted area of ​​vines,

Fourth 460 000 CZK per 1 ha of planted area of ​​vines in the event that the number of shrubs
vine exceeds 5,000 units per 1 ha of planted area of ​​vines, or

Fifth 510 000 CZK per 1 ha of planted area of ​​vines in the event that the number of shrubs
vine exceeds 6,000 pieces per 1 ha of planted area of ​​vines.

(2) If the applicant grubbing own winery or vineyard and rights
replanting used to the new restructured vineyard under §
3 or 4, where the rate of aid set out in paragraph 1, and thus exercised the right || | replanting advance ^ 18) according to § 2 para. 6 increases the rate of
120 000 CZK per 1 hectare vineyard area planted to replace the loss of income
.

(3) Where an applicant makes a request pursuant to § 2 para. 11 and exercises the right
replanting vines before grubbing based on 5 September 2010
rights or replanting of vineyards reviewed by the Fund prior || | grubbing-up of vines, without using the procedure under § 2 para. 3, he is not entitled
increased rate pursuant to paragraph 2 ^ 10). The increased rate pursuant to paragraph 2
not belong also to the transferee replanting rights in the event of a transfer
applicant who uses replanting rights in advance.

(4) Rates measures referred to in paragraph 1. a) a point. b)
not be aggregated; measures under § 3 and § 4 can not be combined.

(5) Support in the amount of 50% of the actual costs
restructuring and conversion of vineyards under EU regulations ^ 16) in
other than less developed regions ^ 17) shall be equal to two-thirds
aid under paragraph 1.

(6) Aid for investment pursuant to § 5 does not exceed 50% of eligible expenditure
, while more than 2 million CZK according to the regulations of the European Union
^ 13) in less developed regions ^ 17) or more than 40% of the eligible
expenditure, while exceeding CZK 2 million in other than less developed regions
^ 17).

(7) The payment of aid under § 3 and 4 shall be annual amount referred to in
aid programs in viticulture and wine for the Czech Republic
designed for the financial year ^ 19) restructuring and conversion
vineyards. Fund support under § 3 and 4 shall be reduced proportionately if the sum of all
claims from aid applications under § 3 and 4 for the financial year ^ 19)
including preferential claims of the growers' applications concerning
preferred vineyards provided Annex no. 2 and claims
young vintners under paragraph 9 exceeds the amount allocated
funds from the European Union budget.

(8) The payment of aid provided for in paragraph 7 at the growers' applications concerning
preferred areas of vineyards listed in Annex no. 2
Fund added the amount of CZK 50 000 per 1 ha of planted area of ​​vines. The maximum amount of aid for growers
applications relating to areas preferred by vineyards listed in Annex
no. 2 shall not exceed the rates specified in paragraph 1

(9) The payment of aid provided for in paragraph 7 of the young vinohradníkům Fund
added the amount of CZK 30 000 per 1 ha of planted area of ​​vines. The maximum amount of support to young

(10) The payment of aid under § 5, the annual amount specified in
aid programs in viticulture and wine for the Czech Republic
designed for the financial year ^ 19) on investments. Fund support under § 5
reduced proportionately if the sum of all claims from aid applications under § 5
for the financial year ^ 19), including preferential claims of young winemakers
accordance with paragraph 11 exceeds the amount of funds allocated from | || EU budget.

(11) The payment of aid provided for in paragraph 10 young winemakers Fund
added 5% of the total amount of aid calculated in accordance with paragraph 10 without using
preference. The maximum amount of support to young winegrowers not exceed the rate
listed in paragraph 6

(12) If, after the payment of aid under § 3, 4 or 5 will be available

(13) Application for support under § 3, 4 or 5, who did not
final decision of the Fund until September 30 financial year will
paid under the same conditions as other payments support

§ 7

Young grower and winemaker young

(1) Young grower, the applicant pursuant to § 2 para. 1, which first gained
his first vineyard or the first rights to replant vineyards that were
vineyard register it is written in the 12 months prior
applying for support under § 3 or 4, and the day of the application for support
under § 3 or 4 has not reached the age of 40 years.

(2) Young winemaker is an applicant under § 5 para. 1, which was first filed in
vineyard register a notice of commencement of production of wine in the 12 months prior
applying for aid under § 5, while the day
applying for support under § 5 has not reached the age of 40 years.

(3) In case of commercial corporations condition has not reached the age of 40
meet the natural person carrying over business corporations
effective and long-term monitoring in terms of management decisions, profits
and financial risks. Such a person is a particular majority shareholder
^ 20) or more natural persons meeting the requirements
not reached the age of 40 holding together a majority of the voting rights
arising from participation in a business corporation.

(4) If the above business corporation sole or joint control
other business corporation based in the Czech Republic
( "controlling business corporation"), the conditions set out in paragraph 3
for all natural persons who have control over this
controlling business corporations. When not controlling
business corporation shareholders who are natural persons meeting the conditions
referred to in paragraph 3, the preferences under § 6. 9 or 11
reckon.

(5) The facts set out in paragraphs 3 and 4 demonstrates the applicant of the date

§ 8
Providing data


(1) A person determined EU regulation laying down detailed rules
terms of compliance, modulation and the integrated
administration and control system, under the direct support schemes for farmers and
regarding compliance under the support scheme provided for the wine sector
^ 21), the Fund delivered later than 15 May

(2) An integral part of the single application form is plotting all
area occupied by paragraph 1 of the map soil blocks or parts of blocks

§ 9

Reducing or eliminating support

(1) If the Fund, the growers did not in the form of a single application
^ 24) under § 8 entire surface in accordance with the regulations of the European Union
^ 25) and the difference between the total area in the form of uniform
request a summary of the total area mentioned in the single application form
and the single application form is not recognized

A) greater than 3% but less than or equal to 4% of the areas referred to in
single application form, reduce support ^ 25) under § 3 or 4, to which

(2) If an applicant for assistance

(3) If the applicant for assistance under § 5, which has the obligation to submit a declaration
harvest, production or stock in any state of

application of the measures will reduce the Fund aid under § 5, about 1% ^ 29).

(4) barriers to reduce or exclude a
support in the event of force majeure or exceptional circumstances set out in Regulation
EU-30) shall also apply to the procedure pursuant to paragraph 2. a)
b).

(5) aid shall be granted to the relevant part of the land block or its
part, if it finds a violation of the Fund pursuant to § 2 para. 3
not to initiate the implementation of measures, including the grubbing up of vines, earlier than four months after filing
applications to the Fund or before the inspection carried out by the Fund.

(6), aid shall be granted for the whole land block or its part, if it finds a violation of the Fund
according to § 2 para. 11, not to initiate the implementation of measures
earlier than four months after the application or prior to an inspection carried out | || Fund.

(7) If the Fund violation of conditions under § 3 para. 1 point. a) § 3
paragraph. Point 1. c) or § 4 para. 1 point. a) at any of the rights
replanting, provide the applicant with the support on the part of the land block
part or in whom the condition is met.

(8) Except in accordance with § 10 of the Fund will not provide support to the relevant part
land block or part, if the applicant applies for planting new vineyards
other replanting rights than those stated in the request
under § 3 para. 2 point. a) § 3 para. 4 point. a) § 4 para. 2 point. a)
or § 4 para. 4 point. and).

(9) If an applicant fails to deliver in accordance with § 2 para. 5
Fund notice of the implementation of measures on all soil blocks or parts
specified in the application, the applicant shall provide fund support to meet
conditions on land blocks or parts thereof, that the notification of transposition measures
said.

(10) The provisions of paragraphs 1 to 9 shall not affect the provisions for reductions and exclusions contained in
EU regulations ^ 1).

§ 10

Changes applications

(1) Except in cases of force majeure and exceptional circumstances ^ 31) is not
after the inspection carried out by the Fund in accordance with European Union regulations ^ 3)
application permitted completion of a land block or part, or || | change land block or part,

A) of which will be used grubbing vineyard replanting right
under the measure § 2 para. 2, or

B) which will be planted new vineyards in the framework of measures pursuant to § 2.
2; It does not apply in the case of transfer of replanting rights under § 11th

under § 3 para. 4 point. a) or § 4 para. 4 point. a) the applicant can make
later with the filing of the notice pursuant to § 2. 5th

§ 11

Transfer replanting rights

(1) In the case of transfer of replanting ^ 32) provided in the application
support for restructuring and conversion of vineyards under § 2
notify the purchaser of this fact Fund. Aid is granted to the transferee in the amount
according to § 6 without prior grubbing up of vineyards of the notice of
implementation of measures submitted by the purchaser. The fund is based on data
transfers of replanting rights in the register of vineyards.

(2) In the event that the purchaser will implement measures pursuant to § 2 para. 2
soil to block or component registered in the register as a vineyard, do not start a vineyard grubbing
earlier than four months after submission of the application changes

^ 4).

§ 12

Use of prior replanting rights

If the applicant uses the previously granted replanting rights pursuant to Regulation
EU-33) shall deposit with the Fund security amounting to CZK 150 000
1 ha of newly planted vineyards. The security shall be returned to the applicant after meeting

Conditions in accordance with European Union regulations ^ 33).

§ 13
Efficiency


This regulation comes into force on 1 August 2014.
