Establishing technical requirements for products in terms of noise emissions

Act no. 71/2000 Coll. and Act no. 102/2001 Coll., (hereinafter the "Act")
PART ONE


Requirements for products in terms of noise emissions

§ 1

(1) This regulation transposes the relevant European Community
^ 1) and regulates noise level of technical requirements
at

A) equipment used outdoors listed in Annex no. 1 to
this Regulation

B) equipment used outdoors listed in Annex no. 2 to
this Regulation

(Hereinafter referred to as "equipment") and

C) household appliances.

(2) The equipment used outdoors is considered any
own power moving or transporting machinery capable
according to a special legal regulation, 2) as well as machinery
by special legislation, 2) without the drivetrain
used for industrial purposes or for purposes of conservation, which is regardless
driving part or parts of a type designed to be used outdoors
space and that this space is burdened by noise when it is placed
on the market as a whole, and is suitable for use by the installer.
For use in the outdoor area is also considered the use of the conditions under which
transmission of sound is not or not restricted (such as tents,

(3) This Regulation shall not apply to:

A) equipment manufacturer intended for the transport of goods or passengers by road
roads, 3) rail-4) and Inland ^ 5) or air
roads ^ 6)

B) Equipment specially designed and constructed for military and police supplies
^ 7) and for emergency services, ^ 8)

C) accessory devices without their own power, which are on the market
reported separately, except for hand-breakers and picks and
hydraulic hammers,

D) Handling equipment at trade fairs, exhibitions, demonstrations or similar events
if the device indicates that it is not
marketed and that it meets the requirements of this Regulation.

(4) The activities of the manufacturer, if it is so stipulated in this regulation can ensure

§ 2

Definitions for the purposes of this Regulation

(16) Loaders means a self-propelled wheeled or tracked chassis

§ 3

Devices are products determined in accordance with § 12 para. 1 point. a) of the Act.

§ 4

The device can be placed on the market or put into service only if they meet the following technical requirements
:

A) are visibly, legibly and durably marked
indication of the guaranteed sound power level corresponding to the specimen in Annex.
10 of this Regulation,

B) guaranteed sound power level of equipment listed in Annex
no. 1 hereto shall not exceed the maximum permissible noise emission values ​​
set out in Annex no. 4 to this Regulation.

§ 5

(1) Manufacturer or authorized representative shall, prior to placing
equipment listed in Annex no. 1 hereto
market assessment of the conformity of each type of equipment with the requirements of this Regulation
one of the following methods: | ||
A) internal production control with assessment of technical documentation and
periodic inspection in accordance with Annex no. 5 to this Regulation

B) verification of individual equipment in accordance with Annex no. 6 to this Regulation, or


C) the full quality assurance according to Annex no. 7 to this Regulation.

(2) The manufacturer, or authorized representative shall, prior to placing
equipment listed in Annex no. 2 to this Regulation on market conformity assessment
each type of equipment with the requirements of this Regulation
internal production control in accordance with Annex . 8 hereto.

(3) When a conformity assessment in accordance with paragraphs 1 and 2 to determine the level
sound power devices, the methods specified in Annex no. 3 to
hereto.

§ 6

(1) Evidence of conformity assessment pursuant to § 13 para. 7 of the Act include
technical documentation to the extent specified in Annexes Nos. 5-8 to
hereto, copies of certificates issued in conformity assessment authorized
Body according to Annex no. 6 hereto and
documentation, results and reports listed in Annex no. 7 point 5

(2) The manufacturer, or authorized representative shall keep evidence of
conformity assessment for the period specified in Annexes Nos. 5-8 to this
regulation and on request provide the supervisory authority.

§ 7

Authorization pursuant to § 11 of the Act to conduct conformity assessment activities
under this Regulation may only be granted subject to the conditions specified in Annex
no. 9 hereto.

§ 8

(1) A device that meets the technical requirements laid down in this

Regulation, the manufacturer or authorized representative shall affix a visible, legible and permanent
CE marking in accordance with a special legal regulation
^ 10) and issue to him an EC declaration of conformity containing
requirements set out in Annex . 11 hereto. Issue
EC declaration of conformity is required for affixing the CE marking.

(2) A copy of the EC declaration of conformity kept by the manufacturer or authorized representative
for 10 years from the termination of production equipment and
request, it will provide for the necessary supervision.

(3) The manufacturer, or authorized representative shall send a copy of the EC declaration of conformity
for each type of device Office for Standards,
Metrology and Testing and the European Commission.

§ 9

The device can be placed on the market or put into service only

A) if it meets the technical requirements specified in § 4

B) bears a visible, legible and permanent CE marking in accordance with
special legislation ^ 10) and

C) if it manufacturer or authorized representative
accompanied by the EC declaration of conformity containing the particulars set out in the Annex. 11
hereto.

§ 10

(1) The device can be connected to other indications, provided that
not thereby reduced visibility and legibility of the CE marking or statement
guaranteed sound power level. Equipment must be equipped
markings or inscriptions that its meaning or appearance
could lead to confusion with the CE marking or the indication of the guaranteed sound
performance according to Annex no. 10 hereto.

(2) If the equipment is also subject to other legislation that
set different requirements for equipment, including the affixing of the CE marking CE
indicates that such equipment also fulfills the requirements of these laws
. However, if a law allows manufacturers

indicates that the device only meets the requirements of the legislation, under which the manufacturer

§ 11

(1) Household appliances can be marketed only
if the manufacturer or importer shall indicate in the instructions accompanying the

Change of Government Regulation laying down technical requirements for products
noise emissions

§ 12

Annex no. 1 to Government Regulation no. 194/2000 Coll., Laying down

authorized person shall issue the applicant a certificate of conformity to the model in section 6

If an authorized person refuses to issue a certificate of conformity must
provide detailed reasons for such denial.

Fifth Manufacturer or authorized representative must keep with the technical documentation
together with a copy of the certificate for a period of 10 years after the
equipment on the market and, on request, provide to the supervisory authority.

Příl.7 FULL QUALITY ASSURANCE


First This annex provides for a procedure whereby the manufacturer ensures and
declares that the equipment complies with the requirements of this Regulation.
Manufacturer or authorized representative shall draw for each device
EC declaration of conformity in accordance with § 8 and marks the equipment in accordance with § 4.
) And § 8

Second The manufacturer must have an approved quality assurance system
the design, manufacture and final product inspection and quality testing
referred to in Section 3 and must be subject to supervision under Section 4

Third Quality assurance system

3.1 The manufacturer must submit an application for assessment of his quality assurance system
authorized person chooses.

Application for assessment of the quality assurance system includes

- All the necessary information on the assessed category of devices, including
technical documentation of all equipment already in production or
produced, which includes at least the following information:

- The business name and address of the manufacturer or authorized representative

- Description of the equipment

- Make

- Trade name,

- Type, series and serial or serial number,

- The technical data relevant for the identification of the equipment and the assessment of its noise emission
including schematic drawings, or explanation
if they are necessary for their understanding

- Reference to this Regulation,

- The technical report of noise measurements carried out in accordance with Annex no. 3 to
this Regulation

- The technical instruments applied and the results of the evaluation of the uncertainties caused
variations in production, as well as their impact on the guaranteed sound power level
,

- The documentation concerning the quality assurance system.

3.2 The quality assurance system must ensure compliance of the product with
requirements of this Regulation.

All the elements, requirements and provisions adopted by the manufacturer must be
systematically and properly documented in the form of written policies, procedures and guidelines
. Quality assurance system documentation is done in such a way
to ensure consistent interpretation and understanding of the principles and practices
system, including all programs, plans, manuals and reports.

3.3 quality assurance system must include a description of:

- The quality objectives and the organizational structure, responsibilities and powers
senior staff regarding the quality of the design
equipment and appliance,

- The technical documentation drawn up for each device that contains
least the information referred to in point 3.1

- Methods for the control and verification of the design,
systematic procedures and activities used in device design
belonging to the relevant category

- Methods of manufacturing, quality control and quality assurance procedures used
and systematic actions

- The examination and tests that will be carried out in pre-production, production and post-production
phase and frequency with which they will conduct

- The quality records, such as inspection reports and test data and
calibration, records on the qualifications of the personnel concerned, etc.,

- The means of monitoring the achievement of the desired quality of design and construction
equipment and efficient operation of the quality system.

The authorized person shall assess whether the quality assurance system complies with the requirements
point 3.2. Quality assurance systems that implement
ISO 9001, compliance with these requirements.

The auditing team must have at least one member with experience of assessing

Appropriate technology. The assessment procedure must include an inspection visit
manufacturer in buildings.
Result of the assessment system must contain the conclusions of the inspection and proper justification
. Outcome assessment indicates authorized person manufacturers.

3.4 The manufacturer must undertake to fulfill the obligations arising from
approved quality assurance system, and that it will keep on
adequate and efficient level.

Manufacturer or his authorized representative shall inform the authorized person
which approved the quality system of any planned change
this system.

The authorized person shall assess the proposed changes in terms of whether
quality assurance system will change after the meet point 3.2 or
whether an entirely new assessment of the quality assurance system
. Outcome assessment of the proposed changes must include the conclusions of
controls and adequate justification. Outcome assessment indicates
person authorized manufacturers.

Fourth Supervision by an authorized person

4.1 of surveillance is to ensure that the manufacturer duly fulfills the obligations
arising from the approved quality assurance system.

4.2 The manufacturer must allow the authorized person for the purposes of access control
to design, manufacture, inspection, testing and storage
space and must provide it with all necessary information, in particular:

- Documents about the quality assurance system,

- The quality records produced pursuant to section
quality assurance system concerning the preparation of the design (for example
results of analyzes, calculations, tests)

- The quality records produced pursuant to section
quality assurance system related to production (such as the quality records, such as
inspection reports, test data, calibration data, reports on the qualifications of relevant
employees).

4.3 The authorized person shall conduct periodic audits to make sure that
manufacturer maintains and applies the quality assurance system, and gives them a
report to the manufacturer.

4.4 The authorized person may carry out unannounced visits to the manufacturer
. During such visits, the notified body may carry out tests
or have them carried out to verify if necessary whether the system
quality assurance functions properly. An authorized person must
manufacturers to provide a report on the inspection visit, and when performing the test
also with a test report.

Fifth Manufacturer or authorized representative must at least
10 years after cessation of production facilities to store and upon request, to provide surveillance needs


- The documentation concerning the quality assurance system

- The results of the assessment of the quality assurance system in accordance with paragraph 3.3 and
results of the assessment of the proposed changes under point 3.4

- Audit reports and visits by paragraphs 4.3 and 4.4 and
test report according to Section 4.4.

6th Each authorized person is obliged to provide other authorized persons
information on her results worked
assessment of the quality assurance system, or its amendments.


Příl.8 INTERNAL CONTROL OF PRODUCTION


First This annex provides for a procedure whereby the manufacturer or
authorized representative ensures and declares that the equipment is in
accordance with the requirements of this Regulation. Manufacturer or authorized representative
draw for each device EC declaration of conformity in accordance with § 8
marks and facilities in accordance with § 4. a) and § 8

Second Manufacturer or authorized representative
establish and maintain the technical documentation for a period of 10 years from the termination of production equipment and
request, it will provide for the necessary supervision. Manufacturer or authorized representative may
keep the technical documentation
entrust another person.

Third Technical documentation is used to assess the conformity of the equipment with the requirements
this Regulation and contains the following information:

- The business name and address of the manufacturer or his authorized representative
,

- Description of the equipment

- Make

- Type, series and serial or serial number,

- The technical data relevant for the identification of the equipment and the assessment of its noise emission
including schematic drawings, or explanation
if they are necessary for their understanding

- Reference to this Regulation,


- The technical report of noise measurements carried out in accordance with Annex no. 3 to
this Regulation

- The technical instruments applied and the results of the evaluation of the uncertainties caused
variations in production, as well as their impact on the guaranteed sound power level
.

Fourth Manufacturer shall take all necessary measures to permanently
ensure compliance of the manufactured equipment with the technical documentation referred to in points
2 and 3 and with the requirements of this Regulation.


Příl.9
Conditions for granting authorization

First Authorized person, its director and the staff responsible for carrying out verification
not be a designer, manufacturer, supplier or installer of
nor the authorized representative of any of those parties.
These people may not be interested directly or as authorized representatives
in the design, manufacture, marketing or maintenance of such equipment must
nor represent the parties engaged in these activities. This does not exclude the possibility
exchange of technical information between the manufacturer and the authorized person
.

Second The body and its staff must carry out the verification and assessment
while maintaining the integrity and technical competence and must
withstand pressurized and motivations, particularly financial, which might
influence their judgment or the results of their work, especially from | || persons having an interest in the outcome of the verification.

Third The body must have the necessary staff and
must have the necessary equipment to permit a proper design
administrative and technical tasks related to supervision;
also must have available the equipment required for any special verification.

Fourth Staff responsible for the performance of conformity assessment must have:

- Quality technical and vocational training,

- Sufficient knowledge of the requirements for the assessment of technical documentation

- Sufficient knowledge of the requirements of the tests carried out and appropriate
practical experience in carrying out such tests,

- The ability to draw up certificates, records and reports required to authenticate the performance
tests.

Fifth The impartiality of staff carrying out activities in conformity assessment
must be guaranteed, and their remuneration must not depend on the number
tests carried out or on the results of such tests.

6th An authorized person must have a liability insurance policy for damage
unless that liability the State or the State itself is directly responsible for the tests
.

7th The authorized person shall be bound to secrecy about all
evidence obtained in carrying out tests under this Regulation, with the exception
providing information to the relevant administrative authorities.

MODEL INDICATION OF THE GUARANTEED SOUND POWER LEVEL

Indication of the guaranteed sound power level consists of
single-number of the guaranteed sound power in dB,
sign LWA and (pictogram) of the following form:



If the data depending on the device size decreases or increases
must be respected the proportions shown in the figure.
Vertical dimension must not be less than 40 mm.

TERMS OF DECLARATION OF CONFORMITY

EC declaration of conformity shall contain the following information:

A) the identity of the manufacturer or his authorized representative (name and surname
, or even business name, residence or place
business and identification number, if assigned, in the case of a natural person
or the name or business name, address and identification number,
if assigned, if a legal entity)

B) identification of the person who keeps the technical documentation (
name and surname, as well as business name, address or place
business and identification number, if assigned, if a person
physical, or the name or business name, address and identification number,
if assigned, if a legal entity)

C) description of the equipment

D) details of the conformity assessment procedures according to § 5 and
business name, registered office and identification number of the authorized person (if assigned
) in the event that the conformity assessment participated

E) measured sound power level on an equipment representative for

F) guaranteed sound power level device

G) a reference to this regulation, which is in compliance with the European Directive

Parliament and Council Directive 2000/14 / E of 8 May 2000 on the approximation of the laws
of the Member States relating to noise emission devices

H) a statement that the device complies with the requirements of this Regulation

I) if the device is subject also to other Government (§ 10 paragraph.
2) a declaration of conformity with reference to the use of government regulation,
