The Ministry of Agriculture stipulates pursuant to § 3 para. 9, § 4 para. 9, § 5, paragraph
. 9, § 6 par. 4, § 7 para. 6, § 13 and § 21a paragraph. 9 of Act no.
91/1996 Coll., On feed, as amended by Act no. 214/2007 Coll., (Hereinafter
only the "Act")
PART ONE

GENERAL PROVISIONS


§ 1

(1) This Decree incorporates the relevant European Communities
^ 1) and governs the details and requirements for the manufacture, importation,
use, labeling and putting into circulation of feed additives and premixes
.

(2) This Decree was notified in accordance with Directive
European Parliament and Council Directive 98/34 / EC of 22 June 1998 on the procedure
providing information in the field of technical standards and regulations and rules for services | || information society, as amended by Directive 98/48 / EC.

Undesirable substances and products, warehouse pests

(1) The content of undesirable substances in feed products is considered
conform if the analytical result does not exceed the maximum limit specified in
directly applicable regulations of the European Union, which governs the area of ​​undesirable substances
^ 17) .

(2) A list of warehouse pests with illustrations is given in Appendix 3.

§ 22

Content details of the annexes to applications for approval or registration operation


(K § 4 and § 5 para. 9 of the Act)

(1) An application for approval of operation for the production or putting into circulation of feed products
attached separately for each operation

A) the manufacturer of the Annex mentioned in § 4 para. 4 point. a) to c), e) to g) and j) until
l) Act


B) a distributor of the Annex mentioned in § 4 para. 4 point. a) j) to m)
Act

C) the supplier of the Annex mentioned in § 4 para. 4 point. a) j) to l) of the Act,
if packaging is carried out also in § 4 para. 4 point. b) of the Act,

F) importer Annex mentioned in § 5 para. 4 point. h) to l) of the Act, if
packaging is carried out also in § 5 para. 4 point. b) of the Act,

(3) If the applicant for approval of an operation also conducts activities subject to registration
, also joins the annexes referred to in paragraph 2.

§ 23

Data on feed

(K § 4 and § 5 para. 9 of the Act)

(1) Applicants for approval or registration of operations for the manufacture of
annex relating to data on feedingstuffs

A) for feed materials, feed additives groups and types and possibly their trade names
,

B) for compound feeds, the types of animals for which they are intended; these animals are


First livestock

Second farm animals other than ruminants,

Third ruminants

Fourth pets

Fifth carnivorous fur-bearing animals,

6th fish

C) data on the use of feed materials of animal origin

D) method for testing new feed materials, unless given in special legislation
^ 10).

(2) Applicants for approval or registration of operations for the marketing of products to
feeding into circulation in the annex relating to data on feedingstuffs

A) the categories of ingredients

B) for additives, the categories and functional groups

C) for compound feeds, the types of animals for which they are intended;
these animals are animals referred to in paragraph 1. b)

D) types of feed materials of animal origin, possibly data on their
use in complete and supplementary feed

E) method for testing new feed materials, unless given in another
legislation ^ 10).

(3) The importer of the annex relating to data on feed
addition to those provided in paragraph 2, the types of imported feed products and, for pre-mixes and
compound feeds, also their composition and use and possibly trade names.

(4) Operators at primary production level manufacturing compound feeds with
using supplementary feed in the annex relating to data on feedingstuffs

A) the types of animals for which they are intended

B) data on the use of feed materials of animal origin.

§ 24

Verification of the homogeneity of feed additives or premixes

(K § 4 and § 5 para. 9 of the Act)

(1) Homogeneity means a property that expresses
homogeneous dispersion of the components in the premix or feed general.
Efficiency mixing equipment, as regards homogeneity, demonstrated by an operator

B) the type of mixing equipment, production number and year of manufacture,

C) the name of the mixing equipment manufacturer,

D) the mixing time and rotational speed of the mixing element,

E) document on homogeneity attached by the mixing equipment manufacturer as part
technical documentation and operator's declaration that
proved efficiency of the mixing device in terms of homogeneity ^ 13).

(2) The method for verifying homogeneity published by the institute
manner allowing remote access.

§ 25

Certificate of professional competence

(K § 6 par. 4 of the Act)

Certificate of professional competence issued by the institute for

A) the manufacture and putting into circulation of additives by applicants with a

University education in a biological field (chemistry, biology,
biotechnology, pharmacy, medicine, veterinary medicine, food industry or agriculture
) except
bachelor degree programs and professional experience in the manufacture or use of additives || | at least two years,

B) production of premixes, complete and supplementary feed using
additives or premixes

First applicants with a university education in agriculture or veterinary medicine
except for bachelor's degree programs, or


Second applicants with a university education in a biological field and
with professional experience in the manufacture or putting into circulation of pre-mixes or
complete and supplementary feedingstuffs using additives or premixes
at least two years,

C) production of feed using additives or premixes applicants with
graduation exam at secondary school agricultural or veterinary or food
direction and professional experience in manufacturing
feed using additives or premixes minimum
lasting two years

D) circulating premixes applicants who have graduated from secondary school
examination.
PART SIX


Requirements for operation

(K § 7 para. 6 of the Act)

§ 26

Mobile feed mill

Timetable for the production of feed includes a planned period of operation, date, time and place
manufacturing kinds of manufactured feed and registration number of the vehicle carrying the mobile industry
feed.

§ 27

Risk monitoring for primary producers

(1) In operations at primary production level, the operator focuses on control


) Physical danger, in particular foreign bodies in products, for example
contaminating products of plant origin, pieces of wood, metal,

B) biological hazards, which are

First pathogenic microflora (for example from soil, water, salmonella)

Second mycotoxins produced by molds (aflatoxins, fumonisins)

Third animal pests (for example the risk of infections being spread by insects and wild
living birds and rodents)

C) chemical hazards to which they are

First heavy metals (such as arsenic, cadmium, lead, mercury)

Second prohibited substances and products listed in Annex no. 1 and undesirable substances and
products listed in Annex no. 2

Third Incorrect use of feed additives.

(2) The provisions of paragraph 1 shall not affect the requirements resulting from other legislation
^ 14) and the directly applicable European Community
about the safety of the food chain ^ 15).
PART SEVEN

BIOLOGICAL TESTING


(K § 21a paragraph. 9 of the Act)

§ 28

(1) Biological testing of feed materials or products that have been
obtained or processed using new technological processes or which did not previously have the nature
feed is carried out in parallel repeated
comparative trials and shall proceed in accordance attachments no. 12 to 18

(2) Testing of additives is carried out under Commission Regulation (EC) No.
429/2008 ^ 16). In case of application of Article 4 of Commission Regulation (EC) No.
429/2008 ^ 16) will proceed according to § 29 para. 2, § 30. 2, Annex.
12 point 3, Annex. 14, Annex no. 16 of part I and Annex No. 18.

(3) Data on the results of biological testing shall be recorded for each
retry separately.

(4) Biological testing shall include analytical verification
composition of additives, premixes, feed materials or products
obtained or processed using new technological processes
or which did not previously have the nature of the feed.
The results of analytical verification shall adequately express the content of nutrients, the content of additives and
wholesomeness.

§ 29

(1) For basic biological testing shall be recorded

A) the name and address of the legal person conducting the tests and name
or names and surname of the person responsible for them,

B) type of test feed contained an additive or premix
their composition and a quality features determined by analysis, reference number
batch used, qualitative and quantitative composition of the daily ration,

C) the species, breed, age and sex of the animals and their designation,

D) number of test and control groups of animals, number of animals in each
group and number of parallel repeated comparative trials,


E) animal health conditions, feeding and rearing conditions, including any changes
,

F) date of start and end of testing,

G) test venue,

H) results and statistical assessment of the conclusiveness
results, unfavorable effects and other changes arising during testing.

(2) for preservative effectiveness testing was recorded

A) the name and address of the legal person conducting the tests and name
or names and surname of the person responsible for them,

B) type of preservative substance, its composition and concentration,

C) method of metering the preservative

D) the type of feed used for preservation, processing method, composition and quality of feed
determined at the start of testing by physical, chemical and other testing
,

E) venue, date of start and end of testing,

F) particular indicators monitored during testing, such as temperature, weight loss
during preservation,

G) composition and quality of feed determined after the end of testing by physical,
chemical and other testing,

H) any unfavorable effects and other changes arising during testing,

I) results of further testing, if any.

(3) The animal product quality testing shall be recorded

A) the name and address of the legal person conducting the tests and name or names
and surname of the person responsible for a place
design,

B) types of animal product samples taken,

C) the number of animals from which samples were taken, categories and age
animals, method of feeding, quality of test feed additive or premix
,

D) date of sampling and method of storing samples until the date of commencement
tests

E) test results.

(4) for safety testing shall be recorded

A) the name and address of the legal person conducting the tests and name or names
and surname of the person responsible for a place
design,

B) type of tests and test method,

C) the species and number of animals on which the test was performed, the number of repetitions
,

D) date of start and end of testing,

E) test results and statistical conclusiveness of the results,

F) the results of monitoring animal health and animal health
products.

(5) All tests shall be documented separately.

§ 30

(1) Summary documentation of the biological testing,
feed materials or products obtained or processed using new
technological processes or which did not previously have the nature of the feed, the
treated in the manner set out in the Annex. 17 .

(2) Summary documentation of the analysis of feed additives, the following
monographs pursuant to Annex 18.
PART EIGHT

TRANSITIONAL PROVISIONS


§ 31

(1) Feed additives and premixes
marked according to existing regulations may be put into circulation until 31 December
, 2009.

(2) § 28 para. 2 second sentence, § 29 para. 2, § 30. 2, Annex no. 12
item 3, Annex no. 14 and Annex no. 18 shall expire on 31 .
May 2009.

Particular nutritional purposes
Part
A

General


(1) If for the same nutritional purpose in column 2 of Part B of more groups
nutritional characteristics separated by the words "and / or", the manufacturer has the option
use one or both of the main characteristics that a
achieve the nutritional purpose defined in column 1. Labelling declarations
corresponding to each of the options are shown in column 4.

(2) If the column 2 or column 4 of Part B are grouped
additives must be used additives permitted by Regulation
European Parliament and Council Regulation no. 1831/2003 on additives
used in animal nutrition as it meets specified
main characteristics.

Basic biological testing of feed

First Biological testing

01.01 The methods of making

1.1.1. Biological testing is a set of at least five parallel repeated comparative
group of three or periodicko- group
comparative trials. Attempts are arranged so as to eliminate the effects of all factors on
response monitoring except for the factor itself.

1.1.2. Group comparative experiment is carried out with two or more
groups of animals.

1.1.3. Periodic-group comparative experiment is carried out with two
groups of animals, with test feed alternating in groups so that each group
animals was always at least once as a control and
once as experimental.

1.1.4. Repeating group and periodic-group comparative
trials, except for biological testing on fish and laying hens, with
placed in multiple locations, but at least three.

1.2 Provision feed

Flour mixture and ration for the control and experimental groups of animals
