REGULATION OF THE GOVERNMENT



of 9 June. December 2002,



laying down technical requirements for gas appliances



The Government ordered pursuant to section 22 of Act No. 22/1997 Coll., on technical

requirements for products and amending and supplementing certain acts, as amended by

Law No 71/2000 Coll. and Act No. 205/2002 Coll. (hereinafter the "Act") to

the implementation of § 11 (1). 2, § 11a paragraph. 2 (a). (c)), section 12 paragraph. 1 and 3 and section 13

paragraph. 2 of the Act:



§ 1



Basic provisions



(1) this regulation in accordance with the law of the European Communities ^ 1)

provides technical requirements for gas appliances.



(2) for the purposes of this regulation, shall be considered as appliances burning gaseous fuels



and) appliances that burn gas and are designed for the preparation of the

meals, heating, hot water heating, cooling or washing, and if

they used water, with the water temperature not exceeding 105th. (C), or

for lighting, burners with forced air flow and heat source

equipped with such burners (hereinafter referred to as "the machine"),



(b)), or regulatory security control device and construction group

with the exception of the burner with forced air flow and heat sources such

equipped with burners that are separately placed on the market and are designed to

incorporated in appliances such as part thereof, or to connect to the

appliances (hereinafter referred to as "equipment").



(3) for the purposes of this regulation, the appliances are not considered appliances

specially designed for the use of the technological processes

(4) for the purposes of this Regulation shall mean any gaseous fuel

§ 2



For appliances and equipment on the market and putting into service



(1) the appliance can be placed on the market and put into service only if they

in normal use it will not endanger the safety of persons, domestic and economic

animals or property.



(2) the appliance and equipment must comply with the technical requirements laid down in

Annex 1 to this regulation, which will apply to them (hereinafter referred to as

"essential requirements").



(3) the essential requirements shall be considered satisfied if the appliance or

the equipment is in conformity



and with the harmonised Czech) technical standards, where appropriate,

foreign technical standards incorporating in the Member States

The European Union harmonised European standards (Section 4a of the Act), or



(b)) with specified standards (Section 4a of the Act), including the Czech or foreign

technical standards, which have been notified for this purpose by the Commission of the European

§ 3



Conformity assessment procedures



(1) in the case of series-manufactured appliances to carry out the assessment of conformity

§ 4



The CE marking and other labelling



(1) the appliance or with plate appliances must be

CE marked, whose graphic design provides for a specific legal

(2) For the CE marking must bear the identification number of the notified

§ 5

§ 8

requirements for gas appliances.



2. Government Regulation No. 287/2000 Coll., amending Decree-Law No.

177/1997 Coll., laying down technical requirements for appliances

gaseous fuels.



§ 9



The effectiveness of the

Annex 1



THE BASIC REQUIREMENTS



Introductory note



The obligations arising from the essential requirements for appliances

in this annex also apply to fittings where the corresponding

1. General CONDITIONS



1.1. Appliances must be so designed and manufactured to work

assets in normal use, as defined in § 1, para. 5 of this

3. Design and production of

3.7 Food, drinking and utility water

CONFORMITY ASSESSMENT PROCEDURES



1. Ec type-examination



1.1. the EC type-examination is that part of the procedure by which a notified body

person checks and certifies that an appliance, representing the subject

production, meets the provisions of this regulation that apply to it.



1.2. The manufacturer or his authorized representative, must submit an application for

type-examination with a single notified persons.



1.2.1 application must contain

2. EC surveillance with the type



2.1. EC surveillance with the type is part of the procedure which the manufacturer

declares that the appliances concerned are in conformity with the type as described in the

EC type-examination certificate and satisfy the essential requirements

3.2. the manufacturer shall apply a quality system that ensures conformity

3.3. Quality System



3.3.1. The manufacturer must provide the notified to the person of your choice

approved by the quality system, of any updating of the quality system in

relation to changes brought about by, for example, new technologies and concepts

modified quality system complies with the relevant provisions or whether it is

necessary new assessment. Must notify its decision to the manufacturer. Notification

3.4. EC surveillance

4.2. the manufacturer shall apply an approved quality system for final inspection

4.3. Quality System

4.3.2. In the framework of the quality system, each appliance must be controlled and

necessary new assessment. Must notify its decision to the manufacturer. Notification

must contain the conclusions of the inspection and the reasoned assessment decision.



4.3.5 Notified the person who withdraws approval of a quality system must

4.4. EC surveillance



4.4.1. The purpose of EC surveillance is to ensure that the manufacturer duly fulfils the

the obligations arising from the approved quality system.



4.4.2. The manufacturer must allow the notified person for inspection purposes

access to the inspection, testing and storage premises and shall

provide all necessary information, in particular



and) the quality system documentation,

test data, calibration data, qualification of the concerned

workers.

years, to make sure that the manufacturer maintains and applies the approved system

quality, and manufacturers must provide a report on this inspection.

5. EC product verification



5.1. Ec verification is the procedure of the product, when the manufacturer or his authorised

5.2. The manufacturer must take all measures necessary to ensure that, when

the production process ensure the conformity of the appliances with the type as

described in the EC type-examination certificate and with the requirements of this

the regulation, which applies to him. The manufacturer or his authorised representative

must affix the CE marking to each appliance and issue a written declaration of

conformity. The Declaration of conformity may cover one or more appliances and

5.4. verification by checking and testing of each appliance



5.4.1. All appliances must be individually inspected and must be

appropriate tests, as set out in the relevant

the presentation of the certificates of conformity issued by the person.



5.5. Statistical verification



5.5.1. The manufacturer must submit to the appliances in the form of uniform batches and

take all necessary measures to ensure that the manufacturing process

ensure the uniformity of each batch produced.



5.5.2. Statistical check shall be carried out as follows:



The appliance is subjected to statistical control by comparison. They should be

grouped into identified production batch, consisting of units

a particular model, produced under the same conditions. The production batch,

5.5.4. The manufacturer or his authorised representative must, on request, provide

the presentation of the certificates of conformity issued by the person.



6. Ec verification of individual products



6.1. Ec verification of individual products is the procedure whereby the manufacturer, or

his authorised representative ensures and declares that the appliance, the

which has been issued with the certificate referred to in point 2, conforms to the requirements of this

the regulation, which applies to him. The manufacturer or his authorised representative

must affix the CE marking to the appliance and to issue a declaration of conformity,

to understand the design, manufacture and operation of the appliance.

Annex No. 3.



6.4 If the notified body deems it necessary, may be

inspection and tests carried out after installation of the appliance.



6.5. the manufacturer or his authorised representative must, on request, provide

the presentation of the certificates of conformity issued by the person.



Annex 3



CONSTRUCTION DOCUMENTATION
The design documentation must contain the following information, if it is

notified body for assessment requests



and a general description of the appliance),



(b)), the design and manufacturing drawings and schemes of components, components

groups, wiring diagrams, etc.



c) descriptions and explanations necessary for the understanding of the above

facts, including the operation of the appliance,

THE CONDITIONS FOR THE AUTHORIZATION OF
