DECREE

the extent and the way of keeping records and reporting of data from this

registration



Ministry of the environment shall determine pursuant to § 50 para. 2 of law No.

477/2001 SB., on packaging and on amendments to certain acts (the Act on the packaging),

as amended by law No 94/2004 Coll. (hereinafter the "Act") to implement section 15

paragraph. 3 of the Act:



§ 1



The way and extent of record keeping



Person who places on the market or into circulation packaging or packaged products, leads

keep the packaging at least register in the scope of the data that it provides

the obligation pursuant to § 3, including the documents required for

to prove the veracity of this data.



§ 2



The range of reporting of data from the register



(1) a person who places on the market or putting into circulation packaging or packaged products,

If there is not a person referred to in paragraph 2 or 3, it reports to the Ministry of

the environment (hereinafter referred to as "the Ministry") information from the records in the form of

completed annual statement referred to in annexes 1 and 3; indicates if this

the person on the market or putting into circulation also reusable packaging which meets the

conditions referred to in section 13(2). 2 of the Act, as well as from the registration of marks in the

form of the annual statement referred to in annex No. 2.



(2) a person who places on the market or putting into circulation only reusable

packaging which meets the conditions of § 13 para. 2 of the Act, reports the Ministry of

information from the records in the form filled out by the annual reports referred to in

Annexes 1 and 2.



(3) a person that has been demonstrated to market or circulation of less than 300

kg of packaging for the calendar year, the Ministry of information from the register marks in the

form filled out by the annual reports referred to in annexes 1 and 4.



§ 3



The method of reporting of data from the register



Annual reports of the completed pursuant to § 2 shall be sent for the previous calendar year

Ministry in paper format and on the technical device always data

by 15. February of the following year.



§ 4



Repealing provisions



Repealed the Decree No 117/2002 Coll., on the extent and the way of leadership

registration and reporting of data from the register.



§ 5



The effectiveness of the



This Decree shall enter into force on 1 January 2000. January 1, 2005.
