on the adjustment of compensation for loss of earnings after the incapacity
resulting from an accident at work or occupational diseases and on the adjustment of the refund
the cost of survivors under the labour legislation (regulation
on the adjustment of the refund)
Government orders under section 390 para. 2 of Act No. 262/2006 Coll., code
work, as amended by Act No. 362/2007 Coll.:
§ 1
Compensation for loss of earnings after the incapacity resulting from
an accident at work or an occupational disease (hereinafter referred to as "compensation for loss
earnings ") and cost recovery for survivors of belonging
employees or survivors under the labour code, as appropriate,
earlier legislation ^ 1) shall be adjusted so that the average earnings
decisive for the calculation of compensation for loss of earnings or increased
According to the labour legislation ^ 2), and for the calculation of refunds of the costs of
survivors, increased, where applicable, in accordance with labour legislation,
increased by 1.6%.
§ 2
(1) where a claim for compensation for loss of earnings and for compensation
costs for survivors after 31 December 2006. December 2014, the average earnings
decisive for the calculation of compensation for loss of earnings and costs on
survivors, according to § 1 does not increase.
(2) the adjustment referred to in paragraph 1 shall be made without the request of the employee or
survivors; at the request of the employee, be carried out in cases where it
compensation for loss of earnings only as a result of the increase in nepříslušela
invalidity pension under the legislation on social security,
or on pension insurance.
(3) the adjustment referred to in paragraph 1 shall be carried out at the request of the staff member, in cases
the compensation for loss of earnings, nepříslušela, because it
not allow the provisions of § 195 para. 2 of Act No. 65/1965 Coll., code
work, effective from 1. June 1994.
§ 3
For compensation for loss of earnings payable to under labour law
the rules even after the adjustment made under paragraph 1 shall apply. In Act No.
160/1993 Coll., amending and supplementing Act of the Czech National Council.
589/1992 Coll., on social security and a contribution to the State
employment policy, as amended by Act of the Czech National Council No. 10/1993
Coll., and some other laws.
§ 4
Compensation for loss of earnings and cost recovery for survivors,
adjusted in accordance with this regulation, it is for the 1. January 2015.
§ 5
This Regulation shall enter into force on 1 January 2000. January 2015.
