Parliament has passed the following Act of the United States:
PART THE FIRST
THE CONDITIONS FOR THE OPERATION OF ZOOS
§ 1
The subject of the edit
This law regulates the conditions for the issuing of licences to operate
zoos (the "license"), the procedure for the issue of licences,
control of compliance with the obligations arising from this Act,
the basic conditions for the granting of subsidies from the State budget and other
public resources to operators of zoos and the penalties for
violation of the obligations laid down in this law.
§ 2
Basic concepts
(1) for the purposes of this Act, means the
and) Zoo a permanent establishment where they are bred and for

(2) for the purposes of this Act shall not be regarded as in Zoo

§ 3
The conditions for the operation of zoos
(1) the Zoo can only be run on the basis of licences,
issued by the Ministry of the environment (hereinafter referred to as
"the Ministry").
(2) the names of the "Zoo" or "zoo" can only use
an operator who holds a valid license.
(3) the operator must ensure that a copy of the license in a visible place in the entrances
to the Zoo intended for the public.
Licence application
§ 4
(1) an application for a licence (hereinafter referred to as "the application") serves the Ministry of legal
or natural person who intends to operate a Zoo (
"the applicant").
(2) the request shall contain the
a) trade name or name, identification number of the person if
granted, registered office and legal form, name, surname, date of birth and
place of residence of persons who are members of the statutory body
the applicant, if the applicant is a legal entity,
(b)) name, surname, or Appendix, ^ 4) date of birth, identification
number of the person, if any, and place of permanent residence, if the
the applicant is a natural person,
(c) the designation of the person) the owner and the person of the founder of the Zoo,
If they are not identical with the person of the applicant, in the manner specified in (a)), and
(b)),
(d)) the list of species of animals and the estimated number of animals sorted by
rules of Zoological systematics, who are or will be bred,
e) overview of participation in the research to be meaningful for the protection of species,
f) overview of participation in training courses in conservation skills
g) information on the participation in the exchange of information relating to the protection of species
h) information on the participation in technically assured reintroduction of species of
wild animals in native occurrence (reintroduction),
I) information about participation in the education of the public to protect the environment,
for example, by providing information about the species, their
natural habitats and the role in the ecosystems,
j) for information on how the leadership of interim records collection free
wild fauna.
(3) the Ministry in order to prove the integrity of the requests referred to in
special legal regulation ^ 3a) an extract from the criminal register.

§ 5
(1) the Ministry in proceedings for the issue of a licence shall obtain the written observations
(hereinafter referred to as "observations") for each request from the Czech environmental inspection

§ 6

2. prevents evasion of farmed animals, in particular with regard to the possible
ecological threat to native species and prevents the spread of parasites and

4. participate in research beneficial to the protection of species or training in
conservation skills or exchange of information in relation to the protection of
species, breeding of endangered or rare species of animals in human care

professionally secured reintroduction of species of wild fauna in the

6. provide for the performance of activities related to the care of captive animals

§ 7
License
(1) the decision to issue the license contains

in section 6 (1). 3.

Cancellation and termination of the license
§ 8
(1) the Ministry shall initiate the procedure for cancellation of a licence, where
the control of the operator, found a violation of the terms of this

animals, affecting the consequences of violation of the terms of this
the law (§ 6) exclusively for this operation or breeding.
(3) in justified cases, it may stay the proceedings on the Ministry
cancellation of a licence, and to establish a deadline for the removal of the operators of the decision
deficiencies for which the procedure was initiated. Period may not be longer than
12 months.
(4) if the operator removes the deficiencies within a specified time,
the Ministry of the proceedings for the revocation of a license stops.
(5) the cancellation of a licence, the Ministry shall inform the inspection,
locally appropriate Veterinary Administration and the Central Commission for the protection
animals and all participants in proceedings for the issue of the licence.
§ 9
The license expires
and) the expiry date under section 6 (1). 3,

to notify the Ministry of the intention to terminate the operation of the Zoo.

§ 10
Cancellation or termination of the licence does not relieve the operator's obligations
ensure the proper care and handling of animals reared in accordance with the

§ 11
The Ministry of
(1) the Ministry as the central administrative authority for the area of operation of the
Zoological gardens
and) decide on the issue, where appropriate, the cancellation of a licence under this Act,
(b)) keeps records of zoological gardens,
(c) the periodic inspection) performs the Zoological Gardens (section 13 (1)),
(d)) provides subsidies to the operators of zoos,
e) decides on appeals against decisions issued by the inspection referred to in this
the law,
f) cooperates with the inspections, the locally competent veterinary administrations and
The Central Commission for animal welfare and inform them of the cancellation of licences
issued pursuant to this Act,
(g) the Commission as its) sets up an advisory body and its rules of procedure and
the Statute.
(2) the Commission presents a report of the on-spot investigation (§ 5 para. 5),
opinion, in providing subsidies (§ 14 para. 2) and participates in the
regular checks (section 13 (1)).
(3) the members of the Commission appointed and recalled by the Minister of the environment on
a proposal from the State Veterinary Administration, inspection, the Central Commission for the protection of
animals and Professional Association of zoos, which
they are members of the European Association of zoos and aquariums, or World
Association of zoos and aquariums.
(4) a member of the Commission may be appointed only a natural person with
a university degree in the field of veterinary doctor, biologist-zoologist
agricultural engineer-animal husbandry, or a natural person with another
University education and practice in the area of breeding of animals kept
in zoos, carried out in the last 10 years.
Review
§ 12
(1) inspection checks, as are legal or natural persons

§ 14
Support operators
(1) an operator who holds a valid license may be of
the State budget or budgets of territorial self-governing units
provided subsidies in particular
and) breeding species of wildlife protected under the Special
legislation, ^ 11)
(b)) the management of herd books of protected wildlife species
under special legislation ^ 11) and process information about their
breeding into electronic form and made available,
(c) promote the participation of the operator) projects for nature protection in the Czech
Republic,
(d) promotion of cooperation of the operator) in the framework of international programs,
e) care of animals protected and taken under special laws
regulations, ^ 11)
f) science and research projects
(g)) in the field of educational projects, educational and cultural activities,
h) continuing vocational training of workers, security of the Zoo
the garden,
I) construction or reconstruction of the Zoo,
j) equipment security and fire protection system of the Zoo
systems.
(2) in determining the priority areas for the provision of subsidies, the Ministry of
takes into account the opinion of the Commission.
(3) the rules for the granting of aid under paragraph 1, in particular, under what
conditions, how much and in what time-limits are provided,

§ 15
The closure of the Zoo to the public
(1) the inspection shall take a decision on the conclusion of the Zoological Garden for
the public in the case that is operated without a licence.
(2) the inspection shall initiate the procedure concerning the conclusion of the Zoo to the public
referred to in paragraph 1 within 30 days after the day on which the facts set out in the
paragraph 1.
(3) where a person is operating a Zoo without a license request

Offences and other administrative offences

§ 17

Transitional provisions

2 shall apply the provisions of § 10.

applications for licences lodged pursuant to paragraph 1, shall be 1 year from the date of
receipt of the request.

Amendment of the Act on the breeding, breeding and registration of livestock and
amending certain related laws (law plemenářský)
section 22
In section 1 of the Act No. 155/2000 Coll., on the breeding, breeding and registration
farm animals and amending certain related laws
(plemenářský Act), paragraph 2 reads as follows:
"(2) this Act does not apply in the field of breeding and breeding
listed livestock on the research and development activities and
in the field of marking and registration does not apply to animals kept in
zoos. ".

Mandatory requirements annual reports on the activities of zoos
Annual report on the activities of zoos must contain the following information
and information for the period of the calendar year:
1. the name, surname and place of residence, or business name, or
the name and address of the operator, phone, fax, address in public information
Network (Internet address) and an electronic mail address, if any.
2. the data about the person of the owner and the founder of the Zoo in accordance with § 4
paragraph. 2 (a). a) to (c)), if the owner or founder of the other person
before the operator.
3. the information referred to in section 4, paragraph 4. 2 (a). a) and b) on the members of the Board
the operator, if it is a legal person, or to the head of the
personnel (for example, Director), data on the processor of the annual report and
details of the person responsible for public relations.
4. basic economic data about the Zoo, which are information about
revenue and expenditure, economic self-sufficiency, the value of the property,
provided by subsidies and on the number of visitors.
5. Investment information aimed at breeding and lairaging of animals.

the calendar year, the comings, goings, the birth at the zoo, death) according to the
taxonomic groups: mammals, birds, reptiles, amphibians, fish and
invertebrates. For mammals and birds shall bear a list of all reared individuals
