The Ministry of agriculture

of 15 November 2004. December 1998,

laying down the characteristics of the soil and environmental bonitovaných

units and the procedure for their management and update

546/2002: Sb.

The Ministry of agriculture lays down, pursuant to section 8 (2). 8 of the law No. 284/1991

Coll., on land and land offices, as amended by Act No.

38/1993 Coll. and Act No. 217/1997 Coll.:

§ 1

Characteristics of soil environmental bonitovaných units

Bonitovaná soil-ecological unit (hereinafter referred to as "BPEJ") ^ 1)

characterized by climatic region, the main soil unit

sklonitostí and exposure, skeletovitostí and depth of soil which specify

the main soil and climatic conditions of the land, taking an investigational

and the climate, the region includes territory) with about the same climate

conditions for the growth and development of agricultural crops, according to annex No 1; is

the first digit is a five-digit number expressed as a code ^ 1) (hereinafter referred to as

"code number"),

(b)) the main soil unit is purposeful grouping of soil forms

related properties, which are determined by the genetic soil type,

subtype, půdotvorným substrate, grain, soil depth, degree of

hydromorfismu, or a distinctive sklonitostí or morphology of the terrain and

zúrodňovacím measures, in accordance with Annex 2; It is expressed as the second and third

digit numeric code,

(c)) sklonitost and exposure to the cardinal describes the formation of the surface

agricultural land according to annex No 3; the fourth digit is represented

a numeric code that is the result of their combination,

(d)) skeletovitost, which means the share of gravel and stone content in ornici to

the content of gravel and stone in straight-up to 60 cm, and depth of the soil, according to the

Annex No. 4; the fifth digit is represented with a numeric code that is

the result of their combination.

§ 2

Leadership BPEJ

(1) BPEJ are uniformly kept ^ 2) in numerical and cartographic representation of the

a nationwide database of BPEJ (hereinafter referred to as "nationwide database"), which

contains information about the quality of the soil. Management of a national database is

provided by the Ministry of agriculture ^ 3) through expert

the Organization, which on demand also provides summary information about the BPEJ and

their special purpose groups, for example. for an areal and qualitative protection

land and water, for regional planning, assessment of ecological stability

the landscape, creating economic instruments in agriculture and development

of the regions.

(2) to document the nationwide database they belong:

and BPEJ in digital) maps and graphical form

(b)) information reflecting the climate and soil conditions related to

code BPEJ,

(c) update BPEJ records),

(d) data on area representation) BPEJ in the cadastral territory of,

(e)) purpose of grouping BPEJ in the cadastral territory.

Update BPEJ

§ 3

(1) Update BPEJ (hereinafter referred to as "updates") is to detect changes of soil

and climate conditions agricultural land terrain exploration and

their evaluation against the conditions that characterize so far

set BPEJ, e.g. If there is a obvious and substantial changes in the

as a result of floods, landslide, significant degradation and destruction of the land

erosion, a fundamental change in the soil or in the hydromorfismu manifest

the earlier determination of the BPEJ, etc. Updates are validated and clarified, and the

define the new boundaries, different BPEJ, or change the code number

BPEJ. For the update also means finding data on the BPEJ parcels

where the BPEJ were not previously addressed. The reason for the update is also required

a complete and detailed national database. ^ 4) Updates under this

Ordinance changes are not affected during the BPEJ boundary inaccuracies of drawings

and correction of errors resulting from trapping of the maps. The update, which results in

the changed maps, land registry office provides BPEJ ^ 5) through

professional organizations that perform enters under a special prescription. ^ 6)

(2) the basis for the map update in digital or graphical

the form are:

and maps according to § 2), para. 2 (a). and in the scale of cadastral maps),

(b)), the land registry map

c) copies of maps at a scale of earlier land registration of cadastral maps

that are displayed as recorded in the land register plots

simplified the way. ^ 7)

(3) Land Office, found the reasons for the update within the meaning of

paragraph 1, and which took account of the requirements of the owners submitted

agricultural land, announce the opening and the range of updates, including

the term the implementation of field survey and its conditions, and the location where the

proposals for amendments of maps BPEJ and after their update has already changed the map BPEJ

landed to public inspection.

(4) the Land Office so requests, the municipality in whose territorial jurisdiction are

the land covered by the BPEJ update of the publication of the

the notification referred to in paragraph 3 in the place in the usual way and launched

BPEJ and update its scope separately inform the land registry office,

protection of agricultural land resources authority, ^ 8) tax office and the territorial

the Department of the Ministry of agriculture.

§ 4

(1) the authority shall ensure Land ^ 5) overhang design changes BPEJ (map to be displayed

on the průsvitce as the příložném material to map documents referred to in § 3

paragraph. 2 or as their trap) for 30 days for public

inspection. For this purpose, the authority shall request the community land, to the way in

the place of the usual inform the public of the place where it will be interpreted by design

changes to the maps, BPEJ and the period during which it will be possible to this proposal

take a peek, and the time limit within which everyone can apply to the design of the written

observations at the land Office. To later claimed the observations will not be

taken into account.

(2) Land Office after the evaluation of the observations received to the public makes the

based on the results of the update maps change BPEJ on the map of the substrate

referred to in § 3 (1). 2 (a). (b)), or (c)), where appropriate, on each map

documentation referred to in § 3 (1). 2 (a). (b)), and (c)) and shall indicate on the changed

maps BPEJ date of their validity, and thus update the BPEJ ends. About

stopping an update of BPEJ land authority shall inform the authorities of the

referred to in § 3 (1). 4 and also ask the municipality on the publication of a communication on the

stopping an update of BPEJ way in the usual place.

| bezskeletovitá mixed with a 0 with a total content of the skeleton to 10% |

skeletovitá with weakly | 1 total 10-25% of the skeleton |

| skeletovitá with 2 medium total skeleton 25-50% |

strongly skeletovitá with | 3 total skeleton nad50% |

+------------------------------------------------------------------------------------+

The contents of the skeleton is expressed as total volume of gravel (solid content

particles of rocks from 4 to 30 mm) and stone (solid particles of rocks over 30

mm).

The depth of soil

It expresses the depth part of the soil profile either solid rock limited

or a strong skeletovitostí.

| The Code Characteristics |

+------------------------------------------------------------------+

> | 0 60 cm soil deep |

| 1 30-60 cm soil medium deep |

| 2 < 30 cm shallow soil |

+------------------------------------------------------------------+

The fifth digit is preceded by a combination of skeletovitosti and

the depth of the land as follows:

+-------+--------------+----------------------------+----------+------------------------------------+
