The DECREE



of 5 December. December 2012



on the determination of the minimum efficiency of use of energy in electricity generation and

thermal energy



The Ministry of industry and trade shall determine according to § 14 paragraph. 4 of law No.

406/2000 Coll., on the management of energy, as amended by Act No. 165/2012 and

Act No. 318/2012 Coll., to implement section 6 (1). 1 and according to § 53 paragraph. 1

(a). (b)) Law No. 165/2012 on the supported sources of energy and on

change some of the laws:



§ 1



Subject matter and scope adjustment



(1) the Decree lays down the minimum efficiency of use of energy for the construction of the new

the production plants of electricity or heat or electricity or heat for the mill, for

that will change the finished works, under section 6 (1). 1 of the law on

energy management

2. waste-heat boilers and

10. the Organic Rankine cycle, or



11. the combination of the technologies referred to in points 1 to 10.

§ 2



Determination of the effectiveness and efficiency of the use of the minimum energy in the production of

thermal energy



(1) the provisions of this section shall be subject to the requirements for the construction

new plant producing heat or for its amendment under section 6 (1). 1 of the law on

energy management and the requirements to be eligible for operating aid of heat

from biomass is supported by a nominal heat output of 200 kW according to §

24 and investment support of heat from renewable sources under section 25 of the Act

about the supported sources of energy.

§ 3



Determination of the effectiveness and efficiency of the use of the minimum energy in the production of

electricity



(1) the provisions of this section shall be subject to the requirements for the construction

new plant producing electricity or for its amendment under section 6 (1). 1 of the law on

energy management and the requirements for entitlement to the aid of electricity

§ 4



Determination of the effectiveness and efficiency of the use of minimum energy

production of electricity and heat



(1) the provisions of this section shall apply to the construction of new production plants

for the combined production of electricity and heat, or for its amendment under section 6

paragraph. 1 of the law on the management of energy and to the requirements for entitlement to the

§ 5



Reference parameters relating to the quality of fuels



(1) in the determination of the minimum efficiency of individual types of technology on

energy production is based on the calorific value of individual types of fuel

referred to in Annex 23 to this Decree, and in the case of biomass from

the water content in the fuel.



(2) the net calorific value of the individual fuel types other than those listed in

Annex 23 to this Decree, provide proof of the owner of the production plants of electricity or the

thermal energy the protocol issued by an accredited laboratory or

other authorised person.



(3) the manufacturer of the calorific value of the fuel energy verifies at least every 6

months and whenever the fuel vendor.



§ 6



Evaluation of the effectiveness of the use of the frequency of minimum energy



(1) the efficiency of the production of heat energy, the efficiency of electricity production including

the efficiency of electricity production from the combined production of electricity and heat

except in the cases referred to in paragraph 2 at least one evaluates
