The Energy Regulatory Office (hereinafter referred to as "the authority"), pursuant to section 98 provides for paragraph 1. 7

Act No. 458/2000 Coll., on conditions for business and public administration

in the energy sectors and on amendments to certain acts (the energy

Act), as amended by law No 670/2004 Coll., and according to the article. (II) section 18 of the Act

No 670/2004 Coll., amending Act No. 458/2000 Coll., on conditions for

business and public administration in energy sectors and amending

§ 1



The subject of the edit



This Decree lays down the rules for the electricity market, which provides for



and) conditions for access to the transmission system and distribution systems,

the billing for the supply of electricity and other services, the procedures for

evaluation, clearing and settlement of imbalances, including clearing and

settlement of regulating energy in a State of emergency and the State of prevention

emergency,



(e) procedures for the procurement of regulatory) energy and ways of clearing

regulating energy,



f) organisation of the short-term electricity market and the balancing market and

their methods of settlement



g) rules, assignment and use of type-delivery diagrams

electricity,



h) terms, and how to select the electricity supplier,



I) procedure for interruption, restriction and restoration of power supply in the

unauthorized subscription distribution, unjust and unlawful transfer,

§ 2



Definition of terms



(1) For the purposes of this Ordinance, means the

daily air temperatures for each trading days for the whole

State and thirty-year regional average daily air temperatures for the

individual trading days for the territory of the region type of diagrams



I) business hour-base time period in which it is contractually

limited supply or electricity consumption; business hour is an essential

acceptance of the agreement for the supply of electricity to the obligation of transmission system

or distribution system or the commitment of the electricity imported into the

§ 3



Electricity market



(1) subject to the electricity market is the supply of active electrical energy.

Electricity market will take place on the basis of the



and on the organized short-term participation) of the electricity market,



(b) bilateral trades between participants) of the electricity market,



(c)) on the balancing market participation with regulating energy, or



(d)) with market participation support services.



(2) in the context of the electricity market are all time data placed in time

valid on the territory of the Czech Republic ^ 3).



§ 4



Registration of participants in the electricity market, and assigning responsibility for the

the derogation



(1) the market operator creates and manages a register of the registered participants

electricity market, dials and offtake points in heat transfer

system and distribution systems and other dials are necessary to

the identification of participants in the electricity market and the particular places of connection.

The registration number of the customer may be identical with the identification number

the code of its load.



(2) on the basis of the instructions of the market operator allocates transmission

system or distribution system by the sampling and delivery points

participants in the electricity market identification code number of dials. On

the request of a market participant shall notify the operator of electricity

transmission or distribution system that party identification

the numeric codes its offtake, and forward positions.



(3) if any of the sampling and the forward points are not assigned to subjects

clearing, the market operator will prompt the transmission or the

distribution system to remedy the situation.



(4) in the event that the distribution system operator operates a part of the

distribution system non electric systems of the Czech

Republic, registers for one market operator summary submission site

for all the pass-through space with the measurement of type A or B ^ 1) connecting this

part of its distribution system to foreign countries. For this summary

submission site passes data to the extent of the market operator and the deadlines

for the type of measurement referred to in section 18.



(5) in the event that the distribution system is connected to the foreign

distribution system that is not connected to a foreign power

the system, the distribution system operator shall register with the operator

single market summary submission site for all pass-through space with

the measurement of type A or B connecting this part of its distribution system is

foreign countries. For this summary submission site passes the market operator

the information in the extent and dates listed for the type of measurement in section 18.



(6) the operator of a local distribution system operator to market demands

the registration of all operated by local distribution systems in

the market operator's system. The parent distribution system operator

the market for individual sampling or pass-through space of all market participants with the

electricity connected to the local distribution system, with the exception of

the sampling or pass-through points at which took over responsibility for the

(8) the sampling or pass-through space with electricity market participants, which

do not register the procedure referred to in paragraph 7, the operator registers the local

the distribution system for the market operator as the sampling locations

(10) if the assigned sampling or forward instead of a market participant with

electricity to the responsibilities referred to in paragraph 3, the market operator

does not include sampling or submission site to evaluate the derogations referred to in §

21, art. 2 and unregisters the sampling or a pass-through space in

the market operator's system. The market operator shall inform the

transmission or the distribution system and the

participant of the electricity market. In this case, the electricity consumption of

a sampling of space or the supply of electricity to a pass-through space assessed

pursuant to section 8 (2). 2.



§ 5



Providing regulated access to the transmission system and distribution

networks



(1) a regulated access to the transmission system and distribution systems

be made on the basis of the contract

(2) the contract of electricity transmission or distribution of electricity shall be concluded on the

the basis of the requests for the provision of electricity transmission or distribution

electricity. Application for an electricity transmission or distribution

the applicant shall submit to the operators of the electricity transmission and distribution

system in the case of a newly established sampling locations, or in case of changes

reserved input at that point at least 30 calendar

days prior to the required date begin transmission of electricity or

distribution of electricity, and that for each hub transport or supply point

separately. Requirements for the provision of electricity transmission and requests for

the provision of electricity distribution are listed in annexes 1 and 2 to the

This Decree.



(3) the contract of transfer of electricity or the distribution of electricity is in the case

the customer contracted for supply point of the customer or its summary, and in

the case of a distribution system operator for a summary of transfer points

stipulated in the contract. For each sampling or pass-through

the place is concluded only one contract on the transit of electricity or with one

distribution system operator only one contract for the distribution of

electricity. In the case that this is a customer with the measurement type (C)

for the possibility of the negotiation of a Treaty on the transit of electricity or the Treaty on

the distribution of electricity to the load of the customer by the supplier is

the consent of the customer.



(4) in the event that the supplier provides electricity supply to the customer

through the contract pursuant to § 7 para. 1 (b). (d)), the operator shall conclude

distribution system with this supplier framework contract on distribution

electricity. General contract on distribution of electricity means the contract for the

distribution of electricity for more sampling or forward sites participants

of the electricity market.



(5) the supplier submits proposals to the distribution system operator

the change of the framework contract for the distribution of electricity, as a rule, to the last day

the calendar month preceding the calendar month in which the

the change of the framework contract take effect, at the latest, however, within the deadline referred to in

the provisions of this Decree governing the procedure for change of the supplier in

the regime transferred responsibility for deviation. Distribution operator

the system passes to the supplier within 5 working days after the end of

calendar month, a report containing information on the sampling or

transfer points that are current as of the first day of the month in

which the report is sent to the distribution system operator in

the scope and structure of the annex 6a.



(6) in the event that it is between the distribution system operator and

supplier of contract referred to in paragraph 4, the operator of distribution

the system will enable suppliers through electronic invoicing

the market operator's information system.



(7) on the basis of the Treaty on the transit of electricity shall be borne by the regulated price,

that is the price for transmission of electricity, the price for system level services

the transmission system, and in the case of the customer whose device is connected

to the transmission system, as well as the price to cover the extra costs associated with the support

electricity and the price of clearing the market operator.



(8) on the basis of the Treaty on the distribution of electricity shall be borne by the regulated price,

that is the price for distribution, the price for system level services

the transmission system, the price to cover the extra costs associated with the support

electricity and the price of clearing the market operator.



(9) the operator of a transmission or distribution system concerned

evaluates and invoiced payments arising from the Treaty on the transfer of

of electricity or the distribution of electricity in relation to each of the sampling

locations for each voltage level separately, with the exception of cases

in accordance with paragraph 12.



(10) the payment for electricity transmission and electricity distribution payment

consists of payments for the use of networks, payment for the reserved capacity, and in

the case of the distribution of electricity also from payment for exceeding the reserved

capacity. Electricity market participant pays the payment for electricity transmission

or for the distribution of electricity transmission system operators or

the operators of the distribution system to which the device is

electricity market participant connected. Payment for electricity transmission

arranged only for the subscription of the transmission system. Payment for distribution

electricity is taken out separately for each subscription of the distribution system operator with

the voltage between phases

(11) the reserved capacity agreed in the contract on distribution of electricity

(16) the payment for the use of the network refers to the electricity actually collected

of the transmission system or distribution system.



(17) the payment for the reserved capacity, and for the use of networks, including payments for

reserved capacity being exceeded are listed separately on the invoice.

Method of payment payment for electricity transmission or distribution of electricity,

payment deadlines and advance payments are listed in the rules of operation of the

the transmission system operator ^ 7) and in the rules of operation of the distribution

System ^ 8).



(18) the distribution system operator shall be charged for non-compliance range

Section 5a



Test operation



(1) electricity transmission or distribution of electricity in the test operation is

electricity transmission or distribution of electricity for the verification of the technical

parameters, operating values and demonstrate the operability of the newly

installed or refurbished sampling of electrical equipment

the Subscriber whose sampling device is connected to the voltage level 1

kV or higher.



(2) in the case of the existing sampling devices are the transmission of electricity, or

electricity distribution in trial operation, made possible in the case that

the installed output of the newly installed or refurbished

the electrical equipment in the point reaches a minimum of 10% of the value

reserved input power stipulated in the contract, or if the connection

installation of new electrical equipment installed input of at least

1 MW.



(3) the request for the provision of electricity transmission or distribution of electricity in the

test operation, the applicant shall submit to the operator of a transmission or

the distribution system of at least 30 calendar days before

the required date begin transmission or distribution of electricity in the

test operation for each hub transport or supply point separately.

Requirements for an application for the provision of transmission or distribution of electricity in the

test operation are listed in annexes 1a and 2a this Ordinance.



(4) the operator of a transmission or distribution system for transmission or

electricity distribution in trial operation at the Subscriber first day

referred to in the request and terminates on the date specified in the application, but not later than

the last day of the third calendar month following the month in the

which the transfer or distribution of electricity was launched.



(5) during the evaluation and billing payments in test operation progresses

the operator of a transmission or distribution network pursuant to § 5 para. 8

(6) the payment for electricity transmission and distribution of electricity in the payment

test operation consists of payments for the use of networks and payment for

reserve capacity and the maximum measured values čtvrthodinového

input of the local distribution system operator

§ 6



The conditions of access to networks for cross-border exchanges in electricity



(1) cross-border trade in electricity is carried out on the basis of the Treaty

on cross-border transmission of electricity under the conditions laid down directly

the applicable law of the European communities) and ^ 9 rules of operation

the transmission system.



(2) cross-border trade in electricity is carried out no more than

transmission capacity reserved on the basis of the results of explicit auctions

the capacity is obtained by converting the reserved for cross-border transmission capacity

from other natural or legal persons, on the basis of implicit auctions or

with the use of the negotiation of transit of electricity within the business day.



(3) the settlement of cross-border business by financing section

23 para. 1. If the market operator shall be notified by transmission system operators

the lack of financial security payments subject to clearing, the operator of

electricity transmission system or transmission of electricity

from abroad, the subject of settlement in accordance with the Treaty on cross-border

transmission of electricity.



§ 7



Agreement on the electricity market



(1) the bilateral trades on the electricity market are carried out on the basis of

(b)) of the Treaty on the settlement of regulating energy ^ 13),

§ 10



Organized short-term electricity market



(1) the Organized short-term electricity market consists of

§ 19

Clearing and financial settlement of imbalances

Foreign electricity system.



(13) the distribution system operator pays the price for reduced the need for

system services for local consumption, manufacturer of transmission

or distribution system to which the device is the payer system

services connected. The amount of the payments is determined by the product of the size of the local

manufacturers and prices for system services in Eur/MWh in accordance with

price decision of the Office.



(2) not later than the twenty-eighth day of the calendar month

following the period for which billing system services

the ratio between the installed power plant and the reserved power in

the discharge or delivery point equal to or greater than 5. After

the end of the calendar year of the transmission system operator or

the distribution system operator shall reassess the classification of producer to the first

or the second category on the basis of data from measurements found in the

preceding calendar year.



(18) the inclusion in the categories of producers referred to in paragraphs 16 and 17 apply

The scope and timing of the bill payments for the services of the market operator



(1) for services to the participants of the market operator of the electricity market charges

(3) the prices for market operator's activities shall be paid by the participant of the electricity market

the market operator directly, with the exception of the prices referred to in paragraph 2 (a). and)

which shall be borne by the participant of the electricity market operator of a transmission or

distribution system to which the device is a participant in the electricity market

connected, and at least once a month.



(4) the prices referred to in paragraph 2 (a). and are not charged for electricity)

consumed by the manufacturer for the pumping of water plants, přečerpávajících

or distribution system.



(5) the operator of a regional distribution system operator passes

(2) when the special mode of clearing and financial settlement pursuant to section 26

is the market operator developed analysis of the situation in

allowing remote access. At the request of the subjects of settlement are

customers that have been connected to the transmission or distribution system

from the 1. January 1, 2002.



(3) a precondition for lodging an application for amendment of a new vendor

the vendor is a contract for the supply of electricity and/or combined

electricity supply services concluded between the electricity market participant and

new supplier.



(4) at least 4 months in advance and no later than 10:00 a.m. tenth

the working day before the date on which the shipment has to be effected (

"the effective date of the change of the supplier"), serves a new supplier for

the market operator's application for change of the supplier that contains

the following data:



and the new vendor registration number),



(b) the type of contract), the object is to be the supply of electricity,



(c) the effective date of the change of the supplier),



(d)) the duration of the legal relationship established by the Treaty,



(e)), the name or trading name, name, head office or place of business and

the registration number of the entity, which is responsible for clearing the derogation for

the sampling locations for that shipment will be effected,



f) identification numeric codes offtake, or transfer points,



(g)) whether the contract was for the supply of electricity or combined

electricity supply services concluded by the consumer or business

a natural person at the premises of the usual business or outside spaces

the usual business.



(5) If a request for change of the supplier referred to in paragraph 4 is lodged

the market later than 10:00 a.m., the request for

the implementation of changes to the vendor was made the next business day.



(6) the market operator will allow the sending of the request for change of the supplier for the

the sampling or pass-through space information system and market operator in

where in the information system of the market operator is not sampling or

submission site is registered. Identity of such sampling

or a pass-through space is allocated identification code number in accordance with § 4

paragraph. 2. If the identification code number was not for sampling or

pass-through space assigned, shall ensure that the operator of a transmission or

delay to the allocation distribution system.



(7) not later than the date referred to in paragraph 4 or 5 serves a market participant

electricity in the transmission system operator or the competent

distribution system operator request to conclusion of the contract of transfer

electricity or electricity distribution arrangements referred to in

Annex No. 1 or 2, or to request the negotiation of changes to legal relations

the existing treaty-based transmission of electricity or the Treaty on

distribution of electricity for sampling or pass-through space referred to in paragraph 4

or 5, if there is such agreement between the electricity market participants already

closed. Request for an agreement on the transit of electricity or the Treaty on

distribution of electricity is not served if such contract between the

electricity market participants concluded. The application is made

of electricity or the request for negotiation of changes to legal relationships established

the existing treaty or of the Treaty on the transit of electricity distribution

electricity until 18:00 hours the fifth working day following the period referred to in

paragraph 8, if it is a change of the supplier, when a new supplier

has concluded a contract on associated electricity supply services. The operator

distribution of electricity than the effective date of the change of the supplier in

request for change of the supplier.



(11) the transmission system operator or the owner of the distribution

the system informs you about the specific reasons for denial of the request referred to in

paragraph 10 a new vendor through the information system

the market operator no later than 6:00 p.m. on the fourth working day following the

transmission of the information referred to in paragraph 8. The transmission system operator

or the distribution system operator accepts the request referred to in paragraph 10,

electricity transmission or distribution of electricity referred to in paragraph 10

and in case of refusal of the application for conclusion of a contract for the transmission of electricity

or contract for the distribution of electricity or a request for extension of the existing

Treaty or of the Treaty on the transit of electricity distribution of electricity by

paragraph 10 shall also inform the existing vendor and an existing entity

the showdown on the continuation of electricity supply.



(14) the new supplier may submit a request for a termination of the process changes

vendor until 14:00 hours eighth working day following the submission of information

in accordance with paragraph 8.



(15) the current supplier may submit an application for suspension of the process of change

vendor until 18:00 hours the fifth working day following the submission of information

in accordance with paragraph 8, if the effective date of change of the supplier not to

termination of the contract with an existing supplier, the object of which is the supply of

electricity, or if the market participant in writing reflected the will of the process changes

vendor to stop.



(16) in the event that the request for change of the supplier was listed information

about the contract outside the areas common to the business and the customer has resigned

from the contract pursuant to § 11a. 2 ^ 9) Energy Act and at the same time

requests the continuation of supply from the existing vendor, can the existing

supplier to stop through the information system of the market operator

change of the supplier in the period referred to in paragraph 15.

paragraph. 14 or 15 to 8 hours working day, in which the application was

taken. If the new contractor must lodge an application according to § 30 para. 14, operator

market change of supplier process terminates.



(3) If an existing supplier shall submit an application in accordance with section 30 paragraph 2. 15, but

new supplier on the basis of the customer's written observations, from which it is

clear that the customer intends to change supplier, confirmed in the information

the system of the market operator request for change of the supplier, and not later than

2 pm on the eighth working day following the date of specific information on the planned

the implementation of changes to the supplier according to § 30 para. 8, the market operator

continues in the process of change of the supplier. New supplier shall provide written

representation of the customer at the request of the market operator. Otherwise,

the market operator change of supplier process exits and shall immediately inform the

an existing vendor, a new vendor, all stakeholders

clearing and the transmission system operator or the competent

distribution system operator to which a sampling or

pass-through space electricity market participant connected, on the continuation of

the supply of existing supplier.



(4) the market operator shall notify the existing suppliers, new suppliers,

all clearing and the entities concerned by transmission system operators

or the relevant distribution system operator, to which they are

the sampling or pass-through space electricity market participant connected,

registration changes in 8 a.m. ninth working day from the date of

information about the planned implementation date of change of the supplier according to § 30

paragraph. 8.



(5) following the notification of the registration of the change of the supplier enters into a new supplier

the Treaty on the transit of electricity or electricity or distribution agreement

arranges for Treaty change to electricity transmission or distribution

electricity including a sampling or pass-through space according to § 30 para. 4.

The transmission system operator or distribution system operator
