of 19 December 2003. December 2014



on the approval of the technical competence and the technical conditions of operation

vehicles on the road



The Department of transportation shall determine under section 91, paragraph. 2 Act No. 56/2001 Coll.

on the conditions of the use of vehicles on the road and on the amendment of the law

No 168/1999 Coll., on liability insurance for damage caused by operation

vehicles and amending certain related laws (the law on insurance

liability from the operation of the vehicle), as amended by Act No. 309/1999 Coll. in

the text of Act No. 103/2004 Coll., Act No. 411/2005 Coll., Act No.

226/2006 Coll., Act No. 311/2006 Coll., Act No. 170/2007 Coll., Act No.

297/2009 Coll., the Act No. 152/2011 Coll. and Act No. 239/2013:



PART THE FIRST



INTRODUCTORY PROVISIONS



§ 1



The subject of the edit



(1) this Ordinance shall apply to legal relations in the field of approval

technical competence and the technical conditions of the use of vehicles on

the road, which are not regulated by directly applicable

the EU regulation governing the approval of technical competence

vehicles of categories L, T, C and R ^ 1).

§ 2



The basic concepts



For the purposes of this Decree:

THE BASIC CHARACTERS OF THE TYPE AND CATEGORY OF VEHICLE



§ 3



The basic characters to specify the types of vehicles, variants and versions for each

categories of vehicles

§ 4



The basic characters for the determination of the types of systems, components and

(To section 2, paragraph 11 of the Act)



(1) Basic characteristics for determining the types of systems, components and

§ 5

Category of road and special vehicles

PART THE THIRD



TYPE-APPROVAL



section 7 of the



Road vehicle systems, components and separate technical
units, which do not apply the relevant provisions of the European Union



(Section 16 paragraph 9 of the law)



The relevant provisions of the European Union shall not apply to

b) vehicles designed and made for use by the armed forces,

civil defence, the fire service and the services relevant for the

maintenance of public order, or



(c)) the systems, components and separate technical units intended for

vehicles referred to in letters a and b)).



§ 8



Technical requirements for road vehicles, systems, components and

separate technical units



(Section 16 paragraph 9 of the law)



(1) for the determination of technical requirements for road vehicles referred to in section 7,

systems, components and separate technical units intended for this

the vehicle shall apply to annex No. 3, 4 and 6 of this Decree apply mutatis mutandis.



(2) for the determination of technical requirements for systems, components

and separate technical units intended for road vehicles, under section 7,

apply Annex No 5 to this notice mutatis mutandis.



§ 9



The harmonised technical requirements for vehicles, systems, components

and separate technical units



(Section 16 paragraph 9 of the law)



(1) harmonised technical requirements for road vehicles of categories M

N and O, systems, components and separate technical units intended

for these vehicles are listed in annex 3 to this Decree and in the right

the applicable regulations of the European Union on the approval of vehicles

of categories M, N and O.



(2) harmonised technical requirements for road vehicles of category L,

systems, components and separate technical units intended for this

vehicles are listed in annex 4 to this notice.

§ 10



The international technical requirements for systems, components and

separate technical units



(Section 16 paragraph 9 of the law)



The international technical requirements for systems, components and

separate technical units are listed in the decisions taken at the

§ 11



How to ensure the conformity of production vehicles, systems, components

§ 15



Essentials of the communication of the result of verification of conformity of production



(§ 19 (2) of the Act)



Communication on the results of the verification of conformity of production must be for all vehicles

subject to the approval of the harmonized type contain at least the information

listed in annex X to Directive 2007/46/EC.

§ 17



How to determine the number of road vehicles, components or

separate technical units for the purposes of verification of the technical requirements,

the harmonized technical requirements and international technical

§ 19



Type-approval documentation

The Declaration of conformity



(To section 23 (4) of the Act)



(1) a declaration of conformity to a harmonised type-approval shall be issued for

road vehicles of categories M, N, O, and L.

special vehicles of category T, C, R, and S.



(3) the formalities for declaration of conformity and its duplicate are for vehicles

of categories M, N, O listed in the article. 18 and in annex IX to Directive 2007/46/EC,

for vehicles of category L in the article. 7 and in annex IV to Directive 2002/24/EC, for the

vehicles of category T, C, R and S in the article. 6 and in annex III to the directive

2003/37/EC.

Type-approval mark



(To section 23 (4) of the Act)



(1) the approval mark shall be placed on all road and special

TECHNICAL SERVICE AND TEST STATION

The technical service



(Section 27 (6) of the Act)



(1) the categories of activities of technical services for vehicles of categories M, N

and, their systems, components and separate technical units

(2) the requirements for equipment and other necessary technical equipment and

facilities necessary for the performance of the activities of the technical service, the requirements for

the internal organisation and management of the system and the method of assessing compliance with these

§ 25



Control techniques



(To section 72, paragraph 3, of the Act)



(1) the technical inspection of vehicles before approving their technical

for use on the road, to the extent determined by the Ministry of

in accordance with paragraph 2 and of the examination of professional competence referred to in paragraph 4

The type and amount of remuneration



(Section 87 of the Act)



(1) for the training of the control technique for the type in the basic rate of pay

(2) for the training of the control technique for the type in the zdokonalovacím course

(3) in the final exam of the course in the basic pay and zdokonalovacím

INDIVIDUAL PRODUCTION AND RECONSTRUCTION OF ROAD VEHICLE

(Section 31, paragraph 1, section 33, paragraph 2, of the Act)



(1) the technical requirements for individually manufactured vehicle are set out in

Appendix 10 to this Decree.

Conversion of vehicle



(Section 74, paragraph 1, section 74, paragraph 2, of the Act)

LINKABILITY AND A MAXIMUM PERMITTED WEIGHT AND DIMENSIONS



§ 34

(To section 2, paragraph 5, 6 and 7 of the law)

Annex 2



Category of road and special vehicles



1. CATEGORY L includes all two or three-wheel motor vehicles

and quadricycles, i.e.. motor vehicles with four wheels, either twin

the wheels, or any other, intended for use on the road, and to

components or separate technical units of such vehicles.



This Directive shall not apply to this vehicle



and) vehicles with a maximum design speed not exceeding 6 km h-1,



b) vehicles intended for pedestrian control;



c) vehicles intended for use by the physically handicapped,



d) vehicles intended for use in competition, on roads or

in the field,



e) vehicles designed primarily for off-road leisure use of the infrastructure,

having wheels arranged symmetrically with one wheel at the front and two wheels

in the back,



(f)) cycles with pedal assistance which are equipped with an auxiliary electric

motor having a maximum continuous rated power of 0.25 kW, of which the output is progressively

reduced disposal of engine of activity, when the vehicle reaches a

speed 25 km h-1, or sooner, if the cyclist stops pedalling.



1.1. Category L1e: the two-wheeled vehicle (moped) with a maximum design

speed not exceeding 45 km h-1 and



-cylinder capacity does not exceed 50 cm3 if of the internal combustion type, or



-maximum continuous rated power does not exceed 4 kW in the case of

the electric motor.



1.2. Category L2e: three-wheel vehicle (moped) with a maximum design

speed not exceeding 45 km h-1 and



-cylinder capacity does not exceed 50 cm3 if of the spark-ignition type, or



-maximum net power output does not exceed 4 kW in the case of other internal combustion

1.3. Category L3e: two-wheeled vehicle (motorcycle) without the sidebar

cart equipped with an engine that has a cylinder capacity of more than 50 cm3

in the case of the internal combustion engine, or with a maximum design speed

higher than 45 km h-1.



1.4. Category L4e: two-wheeled vehicle (motorcycle) with sidecar

-equipped with an engine that has a cylinder capacity of more than 50 cm3 if

the internal combustion engine, or with a maximum design speed of more than

45 km h-1.



1.5. Category L5e unless specified differently: motor tricycles, i.e.. a vehicle with three symmetrically

arranged wheels fitted with an engine that has a cylinder capacity of more than

50 cm3 if of the internal combustion engine, or with a maximum design

speed of more than 45 km h-1.



1.6. Category L6e: light quadricycles whose unladen weight

Off road vehicles



"4WD" means a vehicle of category M or N,

that has the specific technical properties allowing its use outside the

5.1.5. Category T5: wheeled tractors with a maximum design speed

higher than 40 km h-1.



5.2. Crawler tractors category C



Crawler tractors are driven and controlled by endless belts and their

category C1 through C5 are defined by analogy to categories T1 to T5.



6. the category R-trailer is any agricultural or forestry

trailer intended mainly to carry loads and designed to

Each of the relevant European Union legislation and international agreements in

the area of the approval of technical competence, which is the Czech Republic

tied to that required for the approval of the vehicle type or of a harmonised

4. The vehicle must meet the requirements of its right-hand

left-hand traffic, the vehicle must be accompanied by a technical Protocol

technical service confirming fulfilment of the requirements for the right-hand

operation. The Protocol must include an assessment of the particular vehicle lighting,

indirect projections, etc.

1. This annex shall also apply to all vehicles, systems, separate

technical units and components mounted on the above

vehicles or intended to be fitted to the vehicles.



2. For vehicles of category T, C applies the EU directive referred to in the table in the article.
