Amending Government Regulation no. 272/2011 Coll., On health protection against
adverse effects of noise and vibration
Government directs pursuant to § 108 Sec. 3 of the Act no. 258/2000 Coll., On protection
public health and amending certain related laws, as amended
Act no. 274/2003 Coll., Act. 392/2005 Coll. and Act no. 267/2015 Coll
. (hereinafter the "Act") to implement § 30 paragraph. 3, § 34 para. 1 and § 77 paragraph
. 5 of the Act, and pursuant to § 21 letter. a) Act no. 309/2006 Coll., which
amend other requirements of occupational safety and health in
labor relations and ensuring safety and health at
activities or providing service outside labor relations (Act
on securing other conditions for safety and health at work)
amended by Act no. 362/2007 Coll. and Act no. 189/2008 Coll., to implement §
paragraph 7. 7 of the Act on securing other conditions for safety and health at work
:
Article I
Decree no. 272/2011 Coll., On health protection against adverse
effects of noise and vibration, as follows:
First In § 1, paragraph 2, including footnote no. 2 is deleted as well
repealing designation of Subsection 1
Second § 2, including the heading and footnote no. 4 reads:
"§ 2 Basic concepts
For the purposes of this Regulation
a) determining indicator of the physical quantity that characterizes the noise
infrasound, ultrasound or vibration and is used to evaluate the adverse effects
noise, infrasound, ultrasound and vibration conservation
public health
b) noise, tonal noise in the frequency spectrum is
level sound pressure-third octave band, or even in two
immediately adjacent octave bands, by more than 5 dB higher than
sound pressure levels in both neighboring
octave bands and in the frequency band from 10 Hz to 160 Hz is equivalent
sound pressure level in the third octave band higher than the level
hearing threshold set for this frequency band in the Annex no. 1 to
thereto; tonal noise is always music or singing; if not
noise tonal identified on the basis of that
definition, you can use a definition based on narrowband analysis
C) impulse noise of high-energy acoustic pulses formed
outdoors, the source of the explosions in quarries and mines
sonic booms, demolition and industrial processes using explosives
shooting from heavy weapons, testing explosives, other sources of explosions
whose TNT equivalent weight exceeds 25 g
and similar sources, and that the site meets the criteria set out in Annex
no. 4 hereto,
D) high impulse noise of sound pulses formed in outdoor
space generated by the firing of light weapons, explosions explosives with
weighing less than 25 g equivalent mass of TNT and when
mutual collision solids, and in the place
assessment fulfill the criteria laid down in Annex no. 4 to this Regulation
E) varying the noise of which the sound pressure level in a given
location varies in dependence on time by more than 5 dB

shift to shorter or longer than the eight-hour workday or a requirement
workplace
A) the reference period for the average weekly noise exposure,
monthly and longer period within the meaning specified standards according to ISO 1999, which is estimated
hearing loss due to noise
L) the reference period for the average exposure to vibrations weekly, monthly
longer period within the meaning specified standards according to ISO 5349-1
which measures and evaluates exposure to hand-transmitted vibration,
M) typical flying day average operating conditions at the airport
derived for the assessment of long-term exposure to noise, which is determined as the average 24-hour
number of takeoffs and landings at the airport,
calculated from the total number of takeoffs and landing of aircraft at the airport
from 1 May to 31 October of the calendar year; while separating
number of moves for a period of time of day and night,
N) old noise nuisance noise in protected outdoor space and
protected outdoor areas of buildings on land transport activity
roads or runways that existed prior to January 1, 2001 and
value exceeded limits set for hygiene
this date for protected outdoor space and outdoor space protected buildings
O) a comprehensive section of road or track section defined by
other laws stationing ^ 4), and if not so compact segment
defined, it is considered as a homogeneous segment in terms of evaluating noise || |
P) stationary sources of noise especially buildings, objects, operations and
areas serving industrial and agricultural production, trade and
administrative activities and services, including transportation of these campuses

whose radius is limited in a business setting, as well as portable and transportable
machinery and equipment which, when applied as a whole
move; for stationary noise sources for the purposes of this Regulation shall not

Third in § 3, section 5 reads:
|| | "(5) in determining the average noise exposure in the workplace during the reporting period
is based on the total number of shifts in the period and the number of shifts,
during which an employee is exposed to noise.."
4 . in § 3 the following paragraphs 6-9 are added:
"(6) the procedure under paragraph 5 shall also apply in the case of regular or irregular shifts
with different duration of 8 hours, while | || varying hours during the reporting period, but each day
noise exposure should first be converted to work for 8 hours.
(7) Average weekly noise exposure LAeq, w is calculated as follows:
Where n is the number of shifts during the weekly working time during which an employee is exposed to noise
.
(8) Average monthly exposure to noise LAeq, to be calculated as follows:
Where n is the number of shifts during the monthly working hours, during which the employee is exposed to noise
, as is the total number of working days in that month
.
(9) According to the relationship referred to in paragraph 8 shall proceed accordingly when
calculating the average worker exposure to noise during the reporting period
longer than one month. ".
Fifth in § 8 paragraph 5 renumbered 2.
sixth in § 8 par. 2 "T is an eight-hour shift 'is replaced by' T
other than the eight-hour workday in minutes."
7. In § 9 par. 3 point. i) the words "establishment of preventive care"
replaced by "provider of occupational services."
eighth in the title of part three, the words "NOISE IN PROTECTED INTERIOR AREAS

10th In § 11 para. 2, the second sentence is replaced by the sentence "In the case of noise

11th In § 11 par. 3, the second sentence is replaced by the sentence "In the case of noise

12th In § 11 para. 4 and 5, the words "equivalent level"
be replaced by the words "equivalent level".
13th In § 12 para. 1, the first sentence is replaced "The crucial factor
noise, with the exception of high impulse noise is equivalent
sound pressure level LAeq, T and adequate levels
frequency bands." and in the third sentence the words "except
purpose communications," are deleted.
14th In § 12 para. 2, the first sentence is replaced "The crucial factor
high energy pulse noise equivalent sound pressure level
LCeq C, T, and both the average sound exposure level C
LCE individual impulses.".
15th In § 12 para. 3 first sentence, the words "equals" are deleted,
word "by" is replaced by "listed in the Table. Part 1
A" and the third sentence is replaced by "V if noise with tone
components, with the exception of traffic noise on roads, railways and air traffic
, plus the further correction -5 dB. ".
16th In § 12 after paragraph 3 the following paragraphs 4-6 are added:
"(4) The old noise pollution LAeq, 16h for daytime and LAeq, 8h night
time is determined by measurement or calculation of data on annual average daily
intensity and composition of traffic in 2000, provided by the administrator or
owner of the road or track. Hygienic limit established for
old noise pollution refers to the comprehensive land
stretches of road or track.
(5) Hygienic limit on the equivalent sound pressure level old | || noise pollution set sum of the basic sound pressure level
LAeq, T 50 dB correction for the old noise levels specified in table no. 1
part a of Annex no. 3 to this Order is maintained and
| || a) after resurfacing the road maintenance and reconstruction
railways or roads expansion while maintaining directional or vertical guiding
roads or paths, and
b) for short bypasses. | ||
(6) Hygienic limit equivalent sound pressure level noise pollution old
fixed sum of the basic sound pressure level
LAeq, T 50 dB correction for the old noise levels specified in table no. 1 || | part a of Annex no. 3 to this Order does not apply in the event that
noise as a result of road transport and railways
after 1 January 2001 in the subject section of the road or the track has increased by more than

17th in § 12 para. 8, the last sentence is deleted.
18. in § 15 paragraph 2 reads:
"(2) in determining the average exposure to vibrations in the workplace
period is based on the total number of shifts in the period and
number of shifts in which the employee is exposed to vibration. ".
19th in § 15 the following paragraphs 3-8 are added:
" (3) the procedure pursuant to paragraph 2 shall also apply in the case of regular || | or irregular shifts with different duration of 8 hours, while
varying hours during the reporting period, but individual
daily exposure to vibration should first be converted to work for 8 hours.
(4) Average weekly average exposure to vibrations expressed
aggregate weighted acceleration level Law, w is calculated as follows:
Where n is the number of shifts during the weekly working time during which an employee is exposed
vibration.
(5) Average weekly average exposure to vibrations expressed
aggregate weighted rms acceleration aew, w is calculated according to the relation

(6) Average monthly average exposure to vibrations expressed
aggregate weighted acceleration level Law, to be determined by the relationship:

exposed to vibrations, as is the total number of working days in that month
.
(7) Average monthly average exposure to vibrations expressed
aggregate weighted rms acceleration aew with is determined by the relationship

exposed to vibrations, as is the total number of working days in that month
.
(8) According to the relationship referred to in paragraph 7 of the proceeds similarly when
calculating the average worker exposure to vibration during the reporting period
longer than one month. ".
20. In § 20 paragraph. 2, the word "must" is replaced by "must".
21st In § 20 after paragraph 2 the following paragraph 3 is added:
"(3) protected outdoor space of buildings sound pressure levels

Former paragraphs 3 and 4 become paragraphs 4 and 5.
22nd in § 20 paragraph 4 reads: | ||
"(4) When measuring noise in protected outdoor areas of buildings,
protected outdoor space and the protected inner space of buildings
states insecurity, which means the expanded combined standard uncertainty
. Uncertainty must be applied when evaluating the measured values
. The resulting sound pressure level does not exceed
hygienic limit if the resultant equivalent sound pressure
after deducting the value of uncertainty is equal to or lower than
hygienic limit or the resulting maximum sound pressure level is
equal to or less than hygienic limit. ".
23rd in § 20 para. 5, the word" assessment "is replaced by" evaluation "
word" noise "is replaced by" determining ", the words" in | || protected interior spaces of buildings ", the words"

24th in § 20, the following paragraph 6 is added:
"(6) the demonstrable increase in noise in the sense of § 77 par. 5 of the Act is deemed
increase of more than 2 db at the date of assessment
demonstrable increase in noise compared to the measured values of noise or noise
compared to the values calculated in the acoustic assessment of noise sources
submitted to the competent authority to protect public health in the context of a request for extradition
opinion pursuant to § 77 paragraph . 2 and 4 of the Act.
Acoustic assessment of sources of noise in the first sentence refers to such an assessment, which is processed
based on data on noise sources not older than 9 months before the date of filing the application
mentioned in the first sentence. ".
|| | 25th § 21 reads:
"§ 21
When evaluating noise and vibration in the workplace and vibration in protected indoor building
applies insecurity, which means
expanded combined standard uncertainty of measurement.
Uncertainty must be applied when evaluating the measured values. The value indicating the quantity
noise and vibration in the workplace and vibrations in the protected inner space of buildings
demonstrably meets the hygienic limit if, after adding the value
uncertainty of less than hygienic limit. ".

For other types of protected interior space in the table, namely
specified values are used for functionally similar spaces.
Purpose of building use is permitted in buildings before January 1, 2007
given final approval decisions for later constructions permitted notification
building office occupancy or consent.
Specified hygienic limits do not apply to noise caused by the use of a protected room.
+) For the noise of traffic in the vicinity of highways, roads I and II. class roads and local roads
I and II. class where the noise from the traffic on the roads
predominant, and in the protective zone of railways is attributed to further correction + 5 dB.
This correction does not apply in relation to the protected inner space
constructions permitted for use for its intended purpose after 31 December
2005th. "
27th title of Annex no. 3 reads:
"Determination of noise limits in protected outdoor areas
structures and in protected outdoor space."
28th in Annex no. 3 part a table called "Table no. 1 . "
29th in Annex no. 3, part a, under the designation table. 1 following headline
added:
" Correcting for setting noise limits in protected outdoor areas
structures and in protected outdoor space. "
30th in Annex no. 3, part a, the text under the table no. 1 reads:
" Correcting listed in the table are cumulative.
For night-time for protected outdoor space structures adds another correction
-10 db, with the exception of traffic noise on railway tracks, where
applies correction -5 dB.
Terms of Use correction shown in Table. 1:
1) shall apply to noise from traffic and stationary sources of noise
railway stations providing vlakotvorné work, especially
rozřaďování assembly and freight trains, train inspection and repair cars.
For noise from railway stations providing vlakotvorné work that
were put into operation before 1 November 2011 is attributed to
night, a further correction +5 dB.

rail safety zone.
4) shall apply in determining the value hygiene limit for old noise
burden. ".
